Ordinance No. 2019-48 AN ORDINANCE OF THE UNITED CITY OF YORKVILLE,ILLINOIS,APPROVING A SPECIAL USE FOR A GASOLINE SERVICE STATION WITH AN ACCESSORY CONVENIENCE STORE AND CAR WASH AT 4100 N BRIDGE STREET (Lenny's Gas N Wash) WHEREAS, the United City of Yorkville (the "City") is a duly organized and validly existing non home-rule municipality created in accordance with the Constitution of the State of Illinois of 1970 and the laws of the State; and, WHEREAS, under section 11-13-1.1 of the Illinois Municipal Code (65 ILCS 5/1-1-1, et seq.),the Mayor and City Council of the City(collectively, the"Corporate Authorities")may provide for the classification of special uses it its zoning ordinances; and, WHEREAS, pursuant to the United City of Yorkville Zoning Ordinance (the "Zoning Code"), any person owning or having an interest in property may file an application to use such land for one or more of the special uses provided for in the zoning district in which the land is situated; and, WHEREAS, Lenny's Gas N Wash, LLC is the contract purchaser (the "Owner") of the property located at 4100 N Bridge Street, legally described in Section 2 of this Ordinance (the "Subject Property"); and, WHEREAS, under the authority of the Zoning Code, the Subject Property is located in a designated B-3 General Business District, and a gasoline service station is allowed in this district with a special use permit; and, WHEREAS, the Corporate Authorities have received a request from the contract Owner for a special use permit for the Subject Property to allow a gasoline service station with convenience store and car wash; and, WHEREAS, a legal notice of publication regarding a public hearing before the Planning and Zoning Commission on the proposed special use permit was duly published in a newspaper of general circulation in the City, not more than thirty (30) nor less than fifteen (15) days prior to the public hearing; and, WHEREAS, notice to property owners within 500 feet of the Subject Property identified for the special use permit was delivered by certified mail; and, WHEREAS, the Planning and Zoning Commission convened and held a public hearing on the 14th day of August 2019, on the question of the special use application; and, WHEREAS, the Planning and Zoning Commission reviewed the standards set forth in Section 10-4-9(F) of the Zoning Code; and, Ordinance No.2019-48 Page 2 WHEREAS, upon conclusion of said public hearing, the Planning and Zoning Commission recommended the approval with conditions of the special use for the Subject Property for a gasoline service station use of the Subject Property. NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of Yorkville, Kendall County, Illinois, as follows: Section 1: The above recitals are incorporated herein and made a part of this Ordinance. The site contains 5.63 acres of land (gross) and will dedicate 0.59 acres for Route 47 right-of-way, leaving a net development area of 5.04 acres. The proposed improvements will include automobile and truck fueling stations, convenience store with a drive-thru window, new car wash building, vacuum stations, new right-in / right-out entrance from Route 47 and two full access locations on Waterpark Way, parking, drives, stormwater detention basin, erosion control and related improvements. Existing Condition Drainage The 5.04 acre development site contains a localized high point with 1.65 acres draining south to Waterpark Way, 0.99 acres draining north and the remaining 2.40 acres draining to the northeast toward adjacent farm land. Our review found no upstream off-site areas or flows tributary to the site. Within the 1.65 acres draining to Waterpark way, 0.54 acres are tributary to an existing storm structure that will be tied into as called out in the Existing Drainage Exhibit. Our review of the FEMA Flood Insurance Rate Map (FIRM) found no Special Flood Hazard Areas within the project site. Review of Soil Conservation Service web soil information indicates the site is composed of hydrologic type C/D soils. The existing condition peak discharge from the 1.65-acre existing subarea tributary to Waterpark Way for the 2-year/24 hour and 100-year/ 1 hour thru 24 hour storm events was calculated using Pondpack and the Hydrograph Method, Huff Rainfall Distribution for under 10 square mile basins and utilized Illinois State Water Survey Bulletin 70 Northeast Illinois Sectional rainfall depths. The required detention volume will be calculated based on Kendall County Stormwater Ordinance allowable release rates of 0.04 cfs/acre for the 2-year, 24 hour storm event and 0.15 cfs/acre for the 100-year storm event. The detention volume was calculated for the 2- year/24 hour and 100-year/ 1 hour thru 24 hour storm events using Pondpack routing software and the Hydrograph Method, with Huff Rainfall Distribution for under 10 square mile basins and utilized Illinois State Water Survey Bulletin 70 Northeast Illinois Sectional rainfall depths. The detention basin outlet will be directed to the existing storm sewer system in Waterpark Way. The existing flow to the structure being tied into was calculated to be 0.91 CF/S for the 100 year storm event with a time of concentration of 30 minutes, which exceeds the proposed allowable release rate of 0.76 CF/S. Proposed Detention Basin Summary Method of Analysis Proposed fueling station and car wash required Storm water detention storage was determined for the 24 hour duration 100-year and 2-year storm events using Pondpack routing software and the Hydrograph Method, with Huff Rainfall Distribution for under 10 square mile basins and utilized Illinois State Water Survey Bulletin 70 Northeast Illinois Sectional rainfall depths.
