AN ORDINANCE OF THE UNITED CITY OF YORKVILLE,KENDALL COUNTY,
ILLINOIS,AUTHORIZING THE SIXTH AMENDMENT TO THE PLANNED UNIT
DEVELOPMENT PLAN FOR THE RAINTREE VILLAGE SUBDIVISION
(Lots 264-282)
WHEREAS, the United City of Yorkville (the "City") is a duly organized and validly
existing non home-rule municipality created in accordance with the Constitution of the State of
Illinois of 1970 and the laws of the State; and,
WHEREAS, the City entered into an Annexation and Planned Unit Development
Agreement approved in 1997, and further amended by a First Amendment by Ordinance 2002-
52, a Second Amendment by Ordinance 2004-01, a Third Amendment by Ordinance 2005-02, I
and a Fifth Amendment by Ordinance 2013-50 to the Raintree Village Planned Unit

Development Plan; and,
WHEREAS, the current owner/developer, CalAtlantic Group, Inc. have requested a
major change pursuant to Section 10-8-913 of the Yorkville Zoning Ordinance to the Amended
Raintree Village Planned Unit Development to permit a reduction to the side yard setback from
ten feet (10') to six feet (6') for the benefit of Lots 264-282 in Raintree Village Subdivision Unit
4; and,
WHEREAS, notice of a public hearing on the proposed major change to the Planned

Unit Development was published and pursuant to said notice the Planning and Zoning j
Commission conducted a public hearing on January 8, 2020 on said petition in accordance with
the State statutes and the ordinances of the City; and,

WHEREAS,the Planning and Zoning Commission after the hearing recommended to the
Mayor and City Council approval of the side yard reduction by amendment of the Planned Unit
Development Plan.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the
United City of Yorkville, Kendall County, Illinois, as follows:
Section 1: The above recitals are incorporated and made a part of this Ordinance.
Section 2: That the Amended Raintree Village Planned Unit Development Plan is
hereby further amended by amending the side yard regulations for the benefit of the following
legally described property:
Lots 264, 265, 266, 267, 268, 269, 270, 271, 272, 273, 274, 275, 276, 277, 278, 279, 280, 281
and 282 all in Raintree Village, Unit 4 Subdivision, recorded as document 2006000015999. All
in part of the SW 1/4 of Section 3 and part of the NW 1/4 of Section 10, all in Township 36
North, Range 7 East of the Third Principal Meridian, the United City of Yorkville, Kendall
County, Illinois.
to reduce the side yard setback from ten feet (10') to six feet (6') as attached hereto and made a
part hereof by reference as Exhibit A "Raintree Village—Unit 4 Side Yard Setback Exhibit".
Section 3: This Ordinance shall be in full force and effect upon its passage, approval,
and publication in pamphlet form as provided by law.
Passed by the City Council of the United City of Yorkville, Kendall County, Illinois this
