Meeting Minutes
04-10-02
Meeting called to order 6:42 p.m.
Present: Chairman Johnson
Commissioner Jensen
Commissioner Putzler
Also Present: Jim Powers
Chief Martin
No minutes for approval.
Communications: Denise Janecek has passed all tests, she will be sworn in on 4-23-02 at
the City Council Meeting.
Bill for Payment: $200 for Denise Janecek and Jeff Ackland (polygraphs)
500 for two medical exams at $250 each. Denise Janecek and Kelly
Garcia.
Unfinished Business: A question was asked to Jim Powers on what would stop us from
hiring someone on a background. Powers responded with felony and misdemeanor
charges, stating that the candidates have to have "good moral character".
Commissioner Jensen asked if past employment was a reason not to hire. Powers
responded my saying no, we are looking for good moral character. If someone contacted
past employment and they failed the FTO and had a bad attitude, etc, we can be justified
in using that to not hire them.
Commissioner Johnson said that before we reject anyone on those grounds we would
contact Powers.
Johnson moved on to the final eligibility list referring to Section 4 of the Fire and Police
Commission Rules. Johnson stated all components are based on scale of 100. The
eligibility list will change based on the scale of 100. Powers suggested that we send a
letter and put out the new list with the letter.
The commission then adopted the new final applicant eligibility list and will make
conditional offers of employment.
Commissioner Putzler moved to strike Kelly Garcia off the final applicant eligibility list
as she has declined our offer of employment. Commissioner Jensen second. Motion
carried.

Commissioner Jensen asked what could happen if someone contests the list. Powers
stated that three things could happen. 1. Someone could file a state administrative action
in Kendall County Circuit Court. 2. Someone could file a federal lawsuit, stating we
violated their constitutional rights. On both of these cases according to Powers, as long
as we can show we did not follow our rules and now we are we should be ok. No
property, vested, little exposure for the city. 3. Discrimination Charges. They would
have to prove we did something against them.
According to Powers, our threat level is low, because we had no offers of employment
that needed to be rescinded.
Commissioner Putzler moved to adopt the revised eligibility list as the final eligibility list
and replace original list of 3-18-02 with said revised list effective 4-10-02.
Commissioner Jensen second. Motion carried.
A new list will be generated for the Lieutenants for the same reason. The oral interviews
must be based ori a scale of 100. A new lette?and list will be sent to the Lieutenant
candidates as well. Diederich 68.22, Schwartzkopf 81.3, Siebenaller 70.96.
Commissioner Putzler moved that because of the miss calculations in scoring the oral
exam on a scale of 100, we have recalculated the list and want said list of 4-10-02 to
replace the list of 3-18-02 for the Lieutenants final eligibility list. Commissioner Jensen
second. Motion carried.
Chief Martin requested three names to offer conditional employment offers to. Jeff
Ackland is the next name on the list, he also has past police experience. Chief Martin
said that the next PTI slot is not available until the fall. DuPage is filled for the next two
sessions, so is Champaign. The State Police Academy may have one for late summer.
Chief Martin said he has four slots this fiscal year, one being filled by Denise Janecek.
Commissioner Putzler moved that we make conditional offers of employment upon
successful completion of the background and polygraph test to Jeffrey Ackland and
Jeffery Johnson. Commissioner Jensen second, Motion carried.
An initial eligibility list was developed for Sergeants. A letter was sent to each candidate
advising them that they have to claim their military points within 10 days.
Commissioner Jensen moved to post the initial Sergeants eligibility roster given to us 4-
10-02. Commissioner Putzler second, motion carried
Chief Martin will post the list and place the letter in everyones mailbox..
The next meeting was scheduled for Sunday 4-21-02 at 6:00p.m. The scheduled meeting
for 4-24-02 was cancelled.
The order of business for the next meeting will be to finalize the Sergeants eligibility list
and a recommendation for promotion.
Commissioner Putzler moved to adjourn, Second by Commissioner Jensen.
