PC 2000 -15 Overstreet Acres /Doug Overstreet reauest for re- zoning and re- nlattina of a 24 acre
parcel in Kendall County within 1 1/2 miles of the United Citv of Yorkville.
Chairman Sticka stated that since this parcel is located in unincorporated Kendall County the
City acts only in an advisory capacity. Engineer, Joe Wywrot's comments should be sent to
Kendall County. His letter omits the street width issue and this should be included.
Alderwoman Burd stated that the radius was OK.

Mayor Prochaska stated that the detention issue was resolved at Plan Commission due to the low
density.
Chairman Sticka stated that was due to Lot 1 being 9.77 acres which will be left open as a
conservation area and will serve as a detention.
Mr. Overstreet stated that the basically one lot is 18 acres with the outlot being 9 acres, and the
other four lots are on average 1.25 acres. This is low density on a high volume of land, and
regarding the sidewalks, he stated he understood that the sidewalks would be recommended and
Kendall County will consider, but may, or may not require them.
Mayor Prochaska stated that the street should be 28 feet in width with striping at 25 feet, and he
suggests we recommend to Kendall County per our letter that they meet City of Yorkville
standard. This should go to City Council with a recommendation to follow.

PC 2000 -16 Robert & Gail Fisher. petitionerreauestina to rezone from Kendall Countv A -1
Agricultural to Kendall County R-2. One Family Residential District of 2.409 acres located on
Conover Lane in unincorporated Kendall Countv within 1 1/2 miles of Yorkville.
This is simply a split of a 5 acre parcel to two 2 1/2 acre parcels to allow a family member to
build a home. This should go to City Council for r consideration.
PC 2000 -17 Carolvn Herren. petitioner reauestina to annex into the United Citv of Yorkville and
re -zone from Kendall County A -1 Agricultural to United Citv of Yorkville B -3 Service Business
District.
Mayor Prochaska stated that we approached her on this and the Plan Commission vote to
approve. This is the Asparagus Crate on the northeast corner of Route #47 & Corneils Road,
and will be coming in as B -3 with a clause that off route #47 in would be allowed to convert to
R -2 Single Family at some later date. Take this to City Council for consideration.
PC 2000 -18 Robert Kunicek, petitioner reauestina to annex into the United Citv of Yorkville and
re -zone from Kendall County A -1 Agricultural to United Citv Yorkville M -1 Limited
Manufacturina District.
Mayor Porchaska stated this is the balance of the parcel he sold to accommodate the Enron
Electric Generation Plant, and both will become annexed when contiguous. Plan Commission j
voted unanimously to approve. This can go to City Council for consideration. j
DATE CHANGE FOR COW
Mayor Prochaska stated that the date for the first COW in October will be had on Wednesday,
October 4th due to the IML Conference.
SALVATION ARMY CONTRACT
Mayor Prochaska stated that he has received the regular contract for the Beecher Center, and
while it is the same as it is every year, it currently states that the City is responsible for
inspections and meeting all the fire and health codes. We may want to change this line to add
that the Salvation Army must make provisions to meet this requirement. Personnel have been
stacking articles in front of electric boxes and things of this nature. The City should not be
responsible for meeting this requirement. We also may need an agreement regarding the storage
areas and their uses, and by whom. We can hold this up for a few weeks and update the contract.
We will allow them to operate as usual until this contract has been updated.
Alderwoman Spears asked if they have been advised of where their storage area is.
Mayor Prochaska stated that they have never defined this, but as the building is being used more
and more heavily it needs to be addressed so everyone knows where they can put their stuff.

Alderman Sowinski stated that two memos outlining these 2 requests for reduction, and Mr.
Wywrot recommends they be approved.
Mayor Prochaska stated this should go to City Council for consideration.
ADDITIONAL BUSINESS
Mayor Prochaska asked if this is all in order for the final loan payment for SSES for both
Hamilton and Deuchler.
Alderman Sowinski stated that there could be a slight revision to this amount, plus $700. in
charges.

Mayor Prochaska asked if the new total includes engineering and everything, and that all work is
complete and there are no problems.
Mr. Nanninga stated yes to both.
Alderman Sowinski asked J.T. if he was aware of any problems with this.

Mayor Prochaska stated this should be on the agenda for City Council.
ANTENNAS
Alderman Sticka stated he had been in a meeting with Tom Cross & Representative Schmidt. We
need to ask for help from Tom Cross and Representative Schmidt regarding telecommunications
antennas going up everywhere they want. Mr. Cross was not aware of the problem. We need to
control where they can go, most places across the country they are controlled by zoning, but in
Illinois they can put them anywhere they choose. We want Springfield to help us so that our
standards will be imposed within the 1 1/2 miles of Yorkville. We have to look at these things,
but we get no tax revenue from them. Tom Cross & Schmidt hope to get something done.
Alderwoman Burd asked why not a state -wide ordinance?
Alderman Sticka stated that the statute is not completely clear. A state ordinance could be
challenged, and we would have very little chance of winning. We should call or write to Tom
Cross and let him know how we feel as elected officials.
Mayor Prochaska stated they are going up all over.
Alderwoman Burd stated that the state officials should be looking after us all as residents.

Alderman Sticka stated that the feds won't allow us to ban antennas, but we should have input,
and on a County level they can only be sure it meets code and nothing more. They should be on
our water tower. We all recognize the need for cell phones and antennas, but we need to have
some say so.
Mayor Prochaska stated we need a resolution of support as a council.
Alderman Sticka stated that he would mentions this at the Cable Consortium, and ask for input
from the other communities involved in that. Perhaps an intergovernmental agreement would
have statutory powers. I don't think this can be controlled by zoning.
Mayor Prochaska asked Alderman Sticka to speak to George Glass and get any information he
may have on a resolution.
NICOR & MERCURY

Mayor Prochaska asked Mr. Nanninga and Chief Graff about a mercury contamination in
Yorkville.
Mr. Nanninga stated that it was minor. They cleaned it up in one day and they were not
evacuated. Tom Kallay responding to this stated they were responding to requests only and they
are not sweeping the town.
NOISE IN COUNTY
Mayor Prochaska stated that the noise at the PNA camp on both Saturday and Sunday over this I
past weekend was a problem for us all. Kendall County is now putting something together on
how special events will be handled in the County. We all received calls about the noise and
could do nothing except refer callers to the County since the noise came from outside the City. It
was very directional and louder than the Riverfront Festival. There will be a special meeting at
the Kendall County Board Room Tuesday at 7:OOPM to discuss special events and noise.
Mr. Nanninga stated he had asked the IML, and they have a sample. It is regulated from the
noise level at the property line. This is the point where it can be limited.
Mayor Prochaska stated that it needs to be controlled for other residents. Our only answer was
that it was coming from outside the City.
STORAGE OF RECORDS
Bob Allen asked about record storage such as bank statements, etc.
Mayor Prochaska stated he should take that to Administration.
PUBLIC WORKS BIDS
J.T. Johnson stated that they went to bid for the sale of several items. For the Step Van we asked
for a minimum bid of $500. and had a bid from Hinsdale Nursery for $550. On the Dump truck
we asked for a minimum bid of $3000. We got a bid for $1000. After biding John & Scott

Sleezer made an offer of $2500. Attorney Kramer has stated it was OK to accept this bid
providing we had the clause in the bid notice about reserving the right to accept or reject any bid,
which we did. On the old squad car, the Chevy Caprice we asked for a minimum of $500., and
received no bids. After the bidding, Tony, a part-time employee offered $100. J.T. Johnson
recommends we get rid of them all, just accept these bids.
