City Council Minutes 2022 03-22-22MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF YORKVILLE,KENDALL COUNTY,ILLINOIS, HELD IN THE CITY COUNCIL CHAMBERS, 800 GAME FARM ROAD ON TUESDAY,MARCH 22,2022 Mayor Purcell called the meeting to order at 7:00 p.m. and led the Council in the Pledge of Allegiance. Mayor Purcell stated that he has determined that under the Governor's orders the meeting can be held with electronic attendance for the safety of the council members and the public and to help prevent the spread of the coronavirus. Clerk's Note: Due to COVID-19, in accordance with Public Act 101-0640 and Gubernatorial Disaster Proclamation issued by Governor Pritzker pursuant to the powers vested in the Governor under the Illinois Emergency Management Act,the United City of Yorkville encouraged social distancing by allowing remote attendance to the City Council meeting. Members of the public were able to attend this meeting in person while practicing social distancing as well as being able to access the meeting remotely via Zoom which allowed for video,audio,and telephonic participation. PUBLIC HEARINGS Timber Ridge Estates—Dormant SSA Mayor Purcell opened the public hearing for the Timber Ridge Estates—Dormant SSA.He asked if anyone wished to comment on the Timber Ridge Estates—Dormant SSA.Upon hearing no public comments,Mayor Purcell then closed the public hearing. Ayes-8 Nays-0 Koch-aye,Plocher-aye,Funkhouser-aye,Tarulis-aye, Transier-aye, Soling-aye,Marek-aye,Peterson-aye REPORTSEORTS MAYOR'S REPORT Parks and Recreation Event Updates Even with the colder weather,Parks and Recreation Director Evans said St. Patrick's Day parade had a great turnout.Mayor Purcell said he heard great things about the firework show.On April 2,2022,is the Easter Egg-Stravaganza at Town Square Park.Then coming up in May is Margaritas En Mayo on May 26, 2022. Bright Farms Development Agreement CC 2022-05) City Administrator Olson explained three new topics on the Bright Farms Development Agreement matter. The first item they have discussed is the timeline for Corneils Road improvements required by the City for the development.The second item discussed is the project's overall price and total contributions from the City,Bright Farms,and the sanitary district. Then the third piece that is being discussed is the building permit fees.This is the first time the City had this size of a project for industrial development. Staff is currently surveying other towns'permit fees before making a recommendation to the Council. The water well analysis was submitted to staff this afternoon,and there are plans to bring it to a future meeting as a presentation.Mayor Purcell said there is no vote tonight,but if anyone on the Council had any questions,they could ask. Alderman Transier asked if there were any updates on the grant application.City Administrator Olson said the state has asked for post submittal material and additional documents,but there is no timeline. Alderman Funkhouser asked when we will have building permit fee recommendations,to which City The Minutes of the Regular Meeting of the City Council—March 22,2022—Page 3 of 6 Administrator Olson said hopefully by the April 126'City Council meeting.Alderman Funkhouser asked if staff saw any issue with small payments. City Administrator Olson noted this doesn't come up that often to make a comparison. Sean O'Neil with Bright Farms said they are not looking for a deferred payment but more to pay as they complete work. Mr.O'Neil also brought up that Bright Farms does not need Corneils Road improved the entire length,but they understand it's a requirement by the City.Bright Farms questioned if they could improve a smaller part of the road,possibly a few hundred feet. Letter of Understanding for a Shared Use Path and Maintenance—IL—71 Reconstruction CC 2022-11) Mayor Purcell entertained a motion to approve a revised Letter of Understanding with IDOT for the Route 71 expansion project and authorize the Mayor to execute. So moved by Alderman Koch;seconded by Alderman Peterson. Alderman Funkhouser asked, if the trail needs to be replaced,does the City have to replace the trail?City Administrator Olson said it's not clear,but he does believe the state would still replace it when they come through to do their repaving on the street.Alderman Soling asked what the term"good working order" means by the state's standards.Administrator Olson said it would include fixing potholes and cleaning up trash. Alderman Funkhouser asked if this would cover new sidewalks,and City Engineer Sanderson said it would not cover 100%of the sidewalks because some of the sidewalks are being maintained and are still in decent shape.But it would cover the entire street. Ayes-8 Nays-0 Marek-aye,Peterson-aye,Koch-aye,Plocher-aye, Funkhouser-aye Tarulis-aye,Transier-aye, Soling-aye Fox Hill Roadway Improvements Pavement Condition Update PW 2022-26) Alderman Marek made a motion to approve the staff recommendations to update the punch list to include any noted deficiencies,additional crack routing and filling to address centerline issues,milling of the uneven joint at Diehl and Cottonwood Trail,and the requirement of applying asphalt rejuvenator to the entire project and also collect the calculated liquidated damages in the full amount of$39,525.00; seconded by Alderman Peterson. Alderman Funkhouser explained residents'concerns and wanted to know if this resolves all issues.City Engineer Sanderson said yes,this should resolve the issues;there is no timeline yet,but they will start working on the punch list once approved. Motion approved by a roll call vote. Ayes-8 Nays-0 Funkhouser-aye,Tarulis-aye, Transier-aye, Soling-aye, Marek-aye,Peterson-aye, Koch-aye,Plocher-aye Ordinance 2022-11 Amending Water Service Rates and Sewer Maintenance Fees ADM 2022-19) Alderman Funkhouser made a motion to approve an Ordinance Amending Service Rates and Sewer Maintenance Fees and authorize the Mayor and City Clerk to execute; seconded by Alderman Tarulis. Mayor Purcell said the first increase would not occur until September 1's, slightly increasing the base rate. Then the second increase is a bimetric increase that will start on January 155.Alderman Funkhouser said this is very challenging for him to do these increases, but we will do more harm pushing this out,which makes this necessary.Alderman Transier mentioned he would like to look at volume usage and how it's billed out currently regarding the base rate.Alderman Koch and Soling agree with Alderman Transier regarding looking at the base rates. COMMUNITY& LIAISON REPORT Fox Metro Alderman Soling reported that Fox Metro would be doing smoke testing,so if you see smoke coming out of your sewers,don't panic. Hydrant Flushing Public Works Director Dhuse said they would start hydrant flushing in April. This will be a modified schedule because the well is down.This summer,Mayor Purcell mentioned that we might have to restrict water if it's a dry summer. STAFF REPORT No report. Ayes-8 Nays-0 Transier-aye, Soling-aye,Marek-aye,Peterson-aye, Koch-aye,Plocher-aye,Funkhouser-aye,Tarulis-aye The Minutes of the Regular Meeting of the City Council—March 22,2022—Page 6 of 6 Water Study Update CC 2021-38) Administrator Olson said that he added Oswego's real estate transfer tax proposal to the packet.A few of the alderman requested information about what the real estate transfer tax was and about Oswego's proposal. In general,this is a tax on property sales. Since researching,staff has found out this is only available for home rule municipalities.This can't be added to a referendum if you are not home rule. We can look at this for the City after we become home rule.Mayor Purcell mentioned that from a budget perspective looking at transfer tax,you have to keep in mind it would not be steady and wouldn't be able to count on the same amount month to month.Mayor Purcell said he is open to ideas of where else the City can find funds to help with the water project cost and to keep water rates low. Budget for Fiscal Year 2022-2023 CC 2022-09) City Administrator Olson explained there are three budget adjustments in the packet. There was also a FEMA reimbursement of$80,000.00. Staff plans to have the ordinance and a motion at the next City Council meeting. ADDITIONAL BUSINESS Ward 4 Alderman Peterson wanted to thank Public Works Director Dhuse on behalf of Ward 4 and Grande Reserve for getting the lights turned on at Freedom Place and Kennedy Road.Alderman Peterson also asked if there was any update on the Tuma Road and Route 34 light getting fixed, and City Administrator Olson said we are still waiting to hear back from ComEd. FORE! Yorkville Golf Outing Alderman Marked shared that the FORE! Yorkville Golf Outing is live,and registrations are open.The event will take place on Thursday,June 9,2022. CITIZEN COMMENTS None.
