A RESOLUTION APPROVING CHANGE ORDERS RELATING TO
EAST MAIN STREET IMPROVEMENTS
WHEREAS,the United City of Yorkville, Kendall County, Illinois (the "City") is a duly
organized and validly existing non home-rule municipality created in accordance with the
Constitution of the State of Illinois of 1970 and the laws of the State; and
WHEREAS,the City entered into an agreement with Holiday Sewer and Water
Construction, Inc ("Holiday Construction") for certain improvements to East Main Street for a
total cost of$1,111,222.23; and
WHEREAS, due to the ongoing labor strike by operators in local aggregate producer
quarries, in order to proceed with the project, certain aggregates for asphalt production had to be
procured from other, more distant sources thereby resulting in additional expenses and the
imposition of a surcharge in the amount of$12,490.70; and
WHEREAS,the City has received and reviewed Change Order No. 1 from Holiday
Construction itemizing the specific expenses incurred as a result of the use of alternative sources
and acknowledges that these additional charges were unforeseen and necessary and in the best
interest of the City in order to proceed with the Project.
NOW, THEREFORE,BE IT RESOLVED,by the Mayor and City Council of the
United City of Yorkville, Kendall County, Illinois, as follows:
Section 1. That the foregoing preambles are hereby adopted as if fully restated in this
Section 1.
Section 2. That the Change Order No. 1 as submitted by Holiday Construction in the
total amount of$12,490.70 is hereby approved.
Section 3. That this resolution shall be in full force and effect upon its passage and
approval as provided by law.
