Discussion:
1,) Citizens Comments - Jim Liggett, Lawrence Henning and
Vern Henning attended this meeting because the
Administration Committee controls the money and they
have some control over personnel. The issue is
intertwine with Cannonball Trail. They feel that some
of the problems in the area are over simplified and
some issues are left out or just ignored. They would
like to make sure their lots do not end up being
appraised to low too. After some meetings, and
hearing things that are said after the meeting,
Liggett, Vern, and Lawrence wonder if they were at the
same meeting as the staff members, They feel a lot
of things are left out to a slanted view. Liggett
said there was a meeting on January 3. They heard of
the meeting the Thursday morning prior. The meeting
being held was for the developers. The meeting should
have been held to discuss the water problems. Liggett
was actually notified on January 2 for the meeting
that was being held on January 3. They feel being
notified of the meeting the day before is completely
unprofessional, They all chip in to pay for the
attorney fees and a Water Engineer. Their Water
Engineer would like time to review and think. They
feel the Water testing is getting off track. They
have talked with Mayor Johnson, Mayor Johnson says
that Lindley is the Cites Water Expert. The whole
area needs to be Water researched. Lindley has fund

surprises on some tests only 40 feet apart. It is
estimated to take six months and $30,000. The
developers feel this is too long. Liggett, Vern, and
Lawrence feel the testing should be done thoroughly and
done the right way, not quick and dirty. They do feel
that they will be suing the City, They would like
their Water Engineer to work with Lindley. Lindley
has talked with Liggett and told him he was employed
by the City. Lindley told Liggett that he was told
not to work with the Water Engineer. Liggett, Vern,
and Lawrence feel they are told one thing, then
something else gets done, They have reported water
droppagg in the ponds. They would like to work this
out with the City. The new development has not gotten
out of Plan Commission yet This new development has
not been to any other Committee meeting. Spang is
wondering why the Water issue has not come up in any
Committee meeting in the two y ears that he has been
here? Lindley was hired after the line was put in.
Vern said he has been trying to get here. He said
when the City came in to start the dewatering, the
permits had not even been issued. Normally when you
dewater, the water will come back in three or four
days. At Plan Commission they heard that shallow
wells (35 -40 feet) are not recommended. Lindley is a
Drainage Expert. Lindley only did two test wells in
February of 1996. In June of 1996 someone from the
City spoke to K & K Well Drillingg, K & K reported that
the ground water was stable. Casin must be 10 feet
below the ground. And that the well that they have
are illegal, The wells they have are not illegal.
When Liggett spoke to K & K well drilling he did not
get that same report. Vern said his well is 300 feet
deep. It is now contaminated with sulfur. Lawrence
has lived in this area since 1947. He was the first
person to build on Cannonball in 1956. He has a Sand
well a 105 feet down. He has always had plenty of
water. He built a spring feed lake 14 feet deep. The
water was very cold. The lake supported trout. 30
gallons a minute flowing over overflow. This has all
changed since the City has put in that line. The
water is too warm for trout. His well is
contaminated. Lawrence feels he has been negated. He
is the oldest resident there and he has never been
contacted by the City. He feels the value of his
property has dropped because of all these actions.
Lawrence will support any action taken against the
City. Vern said he sent letters as soon as all this
started happening. Vern said he has contacted every
Administration since. Vern said J.T has been out
once. Vern is also concerned with the standing water
in the field North of Rt. 34 and West of Cannonball

j Trail. He feels that is a flood plain. What is going
to happen when the developers develop that land? Vern
said before the line was put in on Cannonball they use
to get that water. Vern doesn't feel the line was
j installed correctly. Water goes down the trench to
the creek. He thinks there should be plugs in it, and
there is not Liggett would like to come back to the
next Administration meeting. He said there are
further inconsistances. He would like more time to
prepare, Jones thinks that this Water issue and the
new development issues need to be kept separate. The
new development is still in Plan Commission. Liggett
would like the Water testing slowed. He would like to
make sure these people know what they are doing.
Liggett feels that there have been to many
misrepresentations. He would like the drinking water
testing to continue at the same ity pace. Portions of the
new development are in the C limits, but only a
small amount. Liggett does not feel that adequate
testing has been done, Vern said that in the strata,
if you change the Water flow, you are responsible for
it. Prochaska has asked if Lindley is doing what the
City has asked him to do? Lindley is suppose to make
a recommendation and give a cost estimate for doin a
study. He will be reviewing existing data and he will
decide if additional testing needs to be done. This
will need to be stated in writing, that he has tested
the whole area. The City needs to know what effects
the trench has had. Liggett would like copies of any
letters that Lindley has done. Prochaska would like
to find minutes from the meetings where this Water
issue has been discussed. In past meetings, Lindley
has said there is no problem. Spang feels we have two
issues here, 1 - Questioning if the trench may or may
not have an effect on this. 2 - There is a
development that is being held up but the issue is not
being put on the table. Spang thinks this should be
brought up at COW. Jones thinks it would be best to
bring it before all eight members at one time, Dan
suggest maybe a special meeting. Liggett does not
understand the testing, The developers for the new
development were told not to come back to the Plan
Commission until the Water Testing is done. Liggett
would also like to know if the City wants their Water
Engineer to talk with Lindley? Dan did feel it would
be ok for Lindley to talk the their Water Engineer.
Dan thinks it would be the sensible thing to do.
Lindley has been obtained by the City. Dan did not
think that Lindley should talk with the new
developments Water people. Prochaska will ask Mayor
Johnson to draft a letter to Lindley to confer with
Dave Kissler, Connonball Trail Water expert, Vern

said he had been to a couple of meetings on Tuesday
mornings. He said these meetings are for the
developers. Vern said there are book that the
develo have that tell them what the are suppose
to do, but no one does it. Liggett said that the
Comprehensive Plan is for Comprehensive. It is the
decision of the people. Vern said he is really tired
of listening to other people deciding what is going to
happen to his property. The builders do not decide
what they are going to do. Liggett would like to come
back to this meeting with the personnel issues. The
Water issue will go to COW.
2.) Resolution - Hotel /Motel Tourism Tax -City Portion -
Would like to set up fund for this money. Judy would
like to see it official. Money should be spent for
promoting the City and events. Need to decide on a
procedure for spend the money, These funds are
encumbered funds. Marketing events and Tourism in
Yorkville. You would want to use tourism, otherwise
the money would only be available for specific events,
Who will determine how the money is to be requested
and how the money is dispensed? The purpose of the
money is to promote events and tourism in Yorkville.
Prochaska thinks there should be a policy and a
resolution. It could be reviewed by Administration
and then approved by City Council.
3.) Land Cash Account - This account is set up for Land
Cash money to be deposited into. This issue has been
to COW. Prochaska thinks that it may need a
resolution. The Park portion of the Land Cash is
voted on at the beginning of the budget year. Amount
of money to be spent is voted on. Span would like to
keep some control over their spending. P rochaska said
the amount of money has already been voted on and
approved in the budget. Spang suggest the Park
Board bring a request for the money before it is
spent. Lynch thinks that they should not have to do
that if they have already said what they want to spend
the money on and it has been approved and voted on by
the City Council, That is why the budget gets
approved. Spang just feels it should rest with the
City. Prochaska said it is also in their report what
the money will be spent on. Spang thinks the City
should have final say on large expenditures.
4.) Municipal Building Fund - Committee will discuss this
on January 28, 1997 with the Budget.
5.) Job Descriptions - Nanninga has job descriptions. J.T.
has turned in an amended description for City

Engineer, No one has seen the descriptions.
Prochaska would like everyone to take a look at them.
He would like them to go to Public Works Committee and
have them oked there. Then take to COW. Prochaska
would like to have descriptions with titles at next
Administration Meeting.
6.) Current Budget Report - November SO is the most recent
report. All journal entries have been made, Revenue
is down. Expenditures are down also. Nanninga would
like to use revised budget for now. He will also like
to put percentages with the revised budget.
7.) Treasurer's Report - Attached to report is the due tos
and due froms. Scheffrahn suggest consolidating some
funds, Discuss on January 28, 1997,
8.) 97 -98 Budget Schedule - Committee will discuss this on
January 2S, 1997 with the budget.
9.) Tax Exemptions - Dan Kramer - City needs to notify the
County every year with the properties that the City
owns. It needs to be done parcel by parcel. The City
needs to have a City certified person notify the
County that all parcels are the same. They will need
to go over Tax Exemptions to make sure everythin is
the same. This all needs to be done by January
1997. Prochaska thinks we should do it, Dan will
send letter to Jim at County with listing of all
properties with parcel numbers,
10.) New Sewer and Water Connection Fund - Committee will
discuss this on January 28, 1997 with the budget,
11.) Additional Business -
Lots for Sale on Rt. 47 - Marx said there were a lot
of good calls in the beginning, Several of the calls
he received wanted to know if the property was zoned
commercial. It is zoned residential. Marx has shown
property to a Modular Home dealer. He has also been
faxing listing to area realtors. Marx said the
building permits for the two lots on Rt. 47 are near
$10,00 each. He suggest offering some incentives.
Talking with investor to come in and purchase all
three lots, this is including the home on the lot in
the middle. Then property owner could request a
special use zoning. Prochaska thinks we should check
the Comprehensive Plan, Special use means it would
have to be something unique. The property owner in
- the middle would need to be consulted. The City can
dedicate variances on the property. Discuss at
Economic Development.

Tower Ordinance - Telecommunication Licenses
Agreement, The City would issue a Telecommunication
Licenses Agreement to lease an area for reception.
Need to check with other communities to find out what
is being charge.
