Discussion:
1.) Van Emmon Property - Dick Ellis step son of Rudy Horton. Ellis is
concerned with his Horton's property. Horton has lot just west of
baseball diamond. Horton owns the lot in the back. Part of Horton's
home is on City property. This started about a year ago. There was
kind of an agreement. City would consider selling lot where driveway
is. All the driveway is City property. Horton had to have land
surveyed. Land is also used by people using ball diamonds. The
current situation has never in 50 years been a problem. The property
appraised out at $5000. Horton talked to Kramer. Kramer said that
the City may want to use the land. The Park District my want to use
this property for recreational use. This is the only property on this side
of the river available for recreational use. The City thought it was only
about 1/2 acre. The City will consider selling him 25 feet along east
side of property or allow him easement forever. City is willing to work
with Mr. Horton. Ellis will take this information to Mr. Horton and get
back to the City.
2.) Budget Review - Treasures Report $50,000 budgeted for court house.
Estimate of $200,000. Will need that money in two years so City
offices . can be moved into old court house building. Starting balance
was $77,000. Used $27,000. Spang was concerned where the
money was spent. Nanninga was going to check and find out. No
line item for the City building and police department renovations.
Where was that money taken from? Line items need to be monitored
closely. On certain line items the money will not be spent. Things
need to be more clarified. Development fees go into the general fund
revenue. Prochaska would like council members to make some notes
and recommendations to Nanninga for next years budget. Prochaska
feels Scheffrahn, Nanninga, and Kim should sit down and start looking
where changes came be made. Council is accepting report.
3.) Water Step Increases - Most cities have allowed step increases. Phase
out discounts for large users. This will a five year four step phase. In
five years everyone will be paying the same amount per gallon of

water. There is not anyway to upgrade without increasing the water
rates. Mayor Johnson has heard from people that Yorkvilles water
rates are high. Higher than other areas. Recommend to Council and
COW a full five year equations merge in four steps. Put on COW
agenda. Effective November 1, 1995 with collection starting in
January 1996.
4.) Codification's - Nanninga found a place in Idaho that will do it for $18
per page. Judy and Nanninga are going to gather all ordinances
(about 110 pages) and send them. Judy will start sending them out
as the ordinance is passed. Bring back to next Administration meeting
for update.
5.) Real Estate Sales - Walnut Street and Rt.47 Properties. Mrs Gauer
wasn't real happy with duplex idea. There has been no interests in
someone buying for single family. Prochaska thinks maybe offices but
wouldn't be able to put in offices until something is done with Rt. 47
because of the traffic problems. Offices there would increase Mrs.
Gauer's property value. City could rezone her house as office and
allow her to live there until she wanted to move. Prochaska feels that
would increase traffic. Spang feels we should try to sell property
before 4 -5 lanes come through Yorkville. [DOT will probably take out
the curve on Rt. 47. Dick Auten is interested in single lots and would
take two lots, wants to build homes. J.T. thinks we should put in
sewer and water and sell lots for $25,000. It would be easier to sell
with sewer and water. J.T thought each lot was suppose to pay 1/3
of the cost for sewer and water. Spang suggest as an option,
auctioning off the property with a minimum bid. J.T. says we would
have to let them know it would cost approximately $6000 for sewer
and water. J.T. to talk to Dick Auten and Spang to talk to Frank.
Walnut Street Property splitting property north and south. Selling
north side to Inland if they want it. Dividing south part into three
single family lots on Walnut Street. There is an interest in single
family lots. Nanninga to talk to Inland.
6.) Old City Hall - Talked to Historical Society. They have a meeting on
October 16, 1995. Can't give a definite until after the meeting. They
want the bell. Mayor Johnson will give okay. J.T. feels there should
be some restrictions on the bell. Historical Society is busy with fund
raisers now and probably won't be able to do anything until Spring.
7.) Land Cash Ordinance - Nanninga needs about five different answers
from Dan Kramer. If Nanninga gets them by COW he will take it there.
8.) Billing Procedures - Recreational - J.T., Nanninga, and Kim need to go
over it again and make sure it is being done correctly. City Council
has to okay bill list, can it come back on us? Actual expending of
money has to be backed by Council. Park Board expends its own
checks. Need more clarification from Kramer.
9.) Employee Manual - Spang concerned with last statement. Reduce pay
or rank by 2/3 vote of Council. Have to have 6 -8 votes. Spang feels

it should be majority of the Council vote. Employee Manual can not
go against State law. Mayor Johnson feels that since that has been
in the manual all along that is should be left as is. Sowinski was
concerned if 6 months of sick time was a little extreme. Mayor
Johnson said is not unusual for a government body. Employees get
paid for 50% of days not used. Spang was concerned about eligible
part -time employees. Mayor and Council has to state eligible
part -time. Is vacations for department heads budgeted in? Can it be
taken in cash? Grievances can be taken to Council. Meals and
lodging reimbursement of up to $75 per day, there must be receipts
to show expenses. Spang feels there should be EOE statement in the
manual. Mayor Johnson said there is a separate EOE Policy.
Nanninga is to bring a copy of EOE to COW. Every discharge requires
approval by Mayor and Council. Dan needs to give legal opinion and
look up state stature. Have for COW on October 19, 1995.
Prochaska is going to contact someone from the Municipal League.
10.) Additional Business
Nanninga starts interviewing for Engineering position on October 11,
1995.
Nanninga talked to Fox Metro. They are not concerned with trading
area.
Property on Eldamain Road are in trust. Keep zoned Ag 1 or negotiate
zoning. Need to show advantages Yorkville is able to offer if they
want to come into City. Could put a recapture fee on the big Rob
Roy line.
