Citizen Comments: None Minutes for Correction/Approval: September 7, 2023 The minutes were approved as presented. New Business: 1. PS 2023-17 Monthly Report Review for August 2023 – September 2023 For both months, Chief Jensen reported on the number of employees, community policing, initiatives, community participation and training hours. Directed patrols, accidents, criminal cases and total calls for service were also reviewed. In addition, he said officers were in 5 schools at the school year start. A new crossing guard is stationed at the high school and the department is saving $30,000 since it is now a school function. Alderman Tarulis asked about the process when a driver ignores a crossing guard and Chief Jensen explained. The Chief also shared information about a recent major arrest and crisis calls. He said that a social worker works with the department 8 hours a week on domestic calls. He hopes for a grant to increase those hours. 2. PS 2023-18 Adjudication Reports for September 2023 – October 2023 There were violations for cannabis, curfew, expired registrations and water usage. Alderman Soling asked about an alleged noise complaint at a nearby car place which the Chief briefly addressed. Page 2 of 3 3. PS 2023-19 Pre-Order of Police Vehicles for the FY25 Budget Chief Jensen commented that there is money in the current budget for one car and two cars are budgeted in FY25. He also said the officers like the feature of a single cage in the back seat. A van was originally desired, however, a retired ambulance may be purchased instead to save money and it would be shared with the Parks Department. Normally the PD goes with the state bid and after discussions with Sutton Ford, there are no vehicles available at this time and a 5-6% increase is possible. Morrow Brothers (located in Greenfield) currently has vehicles, the price will stay the same and is $4,400 less than the anticipated Sutton increased price. The Chief would like to purchase from Morrow Brothers, ordering them now with delivery after May 1. Morrow does the outfitting while Sutton does not. Alderman Funkhouser asked if the same vehicle color package would be used and if “ghosting” would be used. The cars will have the same colors and Chief Jensen noted that the officers like the black and white. He said the ghosting is beneficial at night. In relation to the “ghosting” markings, Alderman Funkhouser said the public perception is that the PD is bad and not there to protect. Vice-Chair Tarulis commented that Alderman Funkhouser's statement warrants a future discussion. In summary, theChief would like to purchase squads from Morrow Brothers and it would require a Council majority vote to be placed on a list to pre-order 3 vehicles. Possession cannot be taken until May of 2024. 4. PS 2023-20 Taser Lease Agreement – Discussion The current taser lease agreement expires May 14, 2024. The Department currently has eight X2's. The X2's are no longer being supported and Chief wishes to move to an X10 model which is the newest version and officers will require updated training. He wishes to lease 8 of the X10's which is $34,000 over a 5 year-period and he will apply for a grant. The training is an added cost and he would like 2 officers to be trained. He said he would keep the X2's as well which would give 18 total tasers with the new ones. Chief Jensen said paramedics remove the taser probes which can be considered as evidence. He said tasers are the most effective non-lethal method they have. This item moves forward to City Council. 5. PS 2023-21 Meeting Schedule for 2024 All committee members concurred with the proposed 2024 meeting schedule. This moves forward to City Council. Old Business: None Additional Business: Chief Jensen wrote a grant last year for funding to purchase a training simulator for de-escalation of mental health calls. The grant was written for the “Virtra” system. He went to a conference that presented a real-life scenario on a computer screen, giving a 300 degree view and is state of the art. Chief Jensen wrote the grant so that all Kendall County PD's would have access to this training. He was informed last week that a grant of $241,000 was awarded. A 30' x 30' fixed space is needed because the cost to move the equipment is $5,000. Several spaces are being Page 3 of 3 considered. An IGA will be needed with all other agencies who use the equipment and the Chief wants 24/7 access to use it. A press release will be issued and a media day will be held. Alderman Funkhouser said this is one of the biggest grants ever received. In another matter, committee members accompanied Chief Jensen to the second floor of city hall for a tour of the open space near the PD administrative offices. The purpose was to discuss a potential information center for major incidents within the county. He is considering converting the space into a real-time information center, funded with a private donation along with a possible grant he would write. He met with all Chiefs of Police recently and all were very receptive. He discussed other advantages of such a system including intelligence-gathering and for use during special events. Staffing ideas were briefly discussed. He would like to see the center opened by February or March and he will provide an update in January There was no further business and the meeting was adjourned at 7:39pm. This event will be from 9:30 -11:00am at Grace Coffee and Wine, located at 42 West Countryside Parkway. Facebook Post (October 5, 2023): Please join us at Grace for our Coffee with a Cop event. We will be here till 11am. Facebook Post (October 10, 2023): Rt. 34 West of Rt. 47 Incident: Officers responded the area of Rt. 34 & Rt. 47 for a retail theft that just occurred. The suspect in this case was extremely belligerent and confrontational causing a breach of the peace at the business. When approached by responding officers at the intersection of Rt. 34 & Rt. 47 he charged an Officer and struck that officer with a closed fist in the face causing injury. Due to the offenders actions a less lethal device was required to subdue the offender and he was taken into custody, however, continued to fight with officers. Pursuant to department policy, the offender was transported for an evaluation at an area hospital. The officer that was struck in the face was treated for injuries on scene. Charges are pending and an update will be provided at a later time. Facebook Post (October 14, 2023): Yorkville Police Department is on scene at a personal injury accident at Center Parkway and West Kendall Drive. Traffic will be delayed in this area as the accident investigation is active. ***Update***: As of approximately 5:50pm the roadway is open to traffic. Today, at approximately 1:50pm the Yorkville Police Department was dispatched to a two-vehicle traffic accident at the intersection of Center Parkway and West Kendall Drive. One of the occupants from the accident sustained life threatening injuries and was transported to a local hospital by EMS. The Yorkville Police Department is currently on scene and is being assisted by the Illinois State Police with the traffic accident investigation. Traffic will be delayed near this intersection as Police continue to investigate. Facebook Posts Facebook Post (October 4, 2023): Yorkville Police have responded to the 100 block of E. Detectives Ketchmark and Johnson both attended seminars to better assist them in future death investigations. From October 16th through October 19th, Detective Sergeant Nelson attended the FBI LEEDA Command Leadership Institute training held in Oswego, Illinois. This training provided Detective Sergeant Nelson with valuable leadership training that can be implemented here at the Yorkville Police Department. On October 31st, Detectives met with each of the registered sex offenders on Halloween, and passed out hanging placards, that reminded them that they are not allowed to participate in Trick-or-treating events. No issues were reported with any of the registered sex offenders living in the City of Yorkville during Trick-or-treating. At approximately 6:34am Police and Fire were dispatched to a chicken coop that caught on fire ( the source is believed to be a heat lamp). Vincent noticed the fire and alerted his grandfather to the fire next door. His grandfather helped put the flames out as the fire reached a detached garage. Yorkville Police Department is just checking in, hoping all had a great weekend, and a start of an amazing week! Facebook Post (11/17/23): On Friday November 17th, 2023 Yorkville Police arrested Radu A. Mogos for possession and distribution of child pornography. The release can be viewed at the link below. Prior to receiving the investigative tip from the National Center for Missing and Exploited Children Mogos was in training as a community service officer with the Yorkville Police Department. Once our agency was alerted of the allegations Mogos was removed from service and resigned his position from Yorkville P.D. Mogos was employed less than 6 weeks during which he was under the constant supervision of a field training officer. Once the investigative process confirmed the allegations, the case was turned over to the Kendall County State’s Attorney for approval of charges. An arrest warrant was then issued for Mogos at which point he was taken into custody by our agency and transported to the Kendall County Jail. It is important to the Yorkville Police Department to be transparent in our duties and actions. While Mr. Mogos was employed for a short time with the Yorkville Police Department, we had no knowledge of his personal off-duty online activities until reported to us by the National Center for Missing and Exploited Children. The men and women of the Yorkville Police Department hold ourselves to a higher standard of performance and expectations and must hold ourselves accountable when an individual’s actions are illegal and affect the integrity of our organization. Yorkville Police Department cannot and will not condone inappropriate or unlawful action by its employees. Mogos for possession and distribution of Child Pornography. This investigation began on October 24 th after the Investigations Unit received a Cyber Tip from the National Center for Missing a nd Exploited Children. According to that tip, Mogos was possibly in possession of Child Pornography. Mogos, who was a recent employee of the Yorkville Police Department, was removed from service and later resigned from his position. A search warrant was executed on Mogos’ residence and on devices in his possession. After an extensive investigation, Mogos was charged with 1 count of Distribution of Child Pornography (Class X Felony), 1 count of Reproduction of Child Pornography (Class X Felony), and 10 counts of Possession of Child Pornography (Class 2 Felonies). Mogos was taken into custody at his residence without issues. Background The United City of Yorkville Police Department received an anonymous donation of $100,000.00 for the construction of an Information Center to be located in the administrative portion of the Yorkville Police Department. This center will house computers, monitors, televisions, software, and other associated equipment to provide an investigative tool to assist with criminal investigations at no cost to the participating agencies. Participating agencies, which include the Plano Police Department, Montgomery Police Department, Oswego Police Department, and the Kendall County Sheriff’s Office will be provided secure physical workspace at the police department with twenty-four (24) hour access Staffing for the Center will be provided by each agency one day a week. The Yorkville Police Department will maintain full control and final decision-making authority on all financial matters regarding the Center. The Yorkville Police Department Information Center would be in operation for a term of two (2) years. Prior to the end of the third year, participating agencies would meet to discuss Center performance, potential improvements, and continued use. Upon determination of continued usage any costs associated with this center would be split between participating agencies. W I T N E S S E T H: WHEREAS, the Constitution of the State of Illinois of 1970, Article VII, Section 10, and the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq., (collectively, Authority”) authorize units of local government to contract or otherwise associate among themselves to obtain or share services and to exercise, combine, or transfer any power or function in any manner not prohibited by law; and, WHEREAS, Yorkville is in the process of establishing a Yorkville Police Department Information Center (the “Center”) which will house computers, monitors, televisions, software and other associated equipment to provide an investigative tool to the Agencies to assist with criminal investigations; and, WHEREAS, Yorkville is prepared to permit all of the Agencies full use of the Center pursuant to the terms and the conditions as hereinafter set forth in this MOU; and, WHEREAS, all of the Agencies are interested in working together to maximize the use of the Center as a tool to undertake criminal investigations thereby benefitting all residents, businesses and property owners within Kendall County. NOW, THEREFORE, in consideration of the recitals hereinabove set forth, the mutual promises and obligations expressed herein and other good and valuable consideration, the sufficiency, adequacy and receipt of which are hereby acknowledged, it is hereby agreed by the parties as follows: Section 1. Yorkville agrees to provide computers, monitors and televisions, and other associated equipment including software for use solely at the area designated by Yorkville at the Yorkville Police Department (“YPD”) headquarters at 651 Prairie Pointe, Yorkville, Illinois, for a term of two (2) years commencing __________________, 2024, at its sole cost. Section 2. Yorkville agrees to provide the Agencies a secure physical workspace at the YPD with twenty-four (24) hour daily access to the Center including secured parking at the YPD location and agrees to discuss future use and funding of the Center no less than thirty days prior to the termination of this MOU to determine whether its operations should be continued, improved or expanded. 2 Section 3. The Agencies agree: (a) To staff the Center one day a week on a day determined by the participating representative of each of the Agencies and approved by the YPD to assure coverage five days a week; (b) To staff the Center during emergency situations or critical incidents to assist an affected member of the Agencies; and, (c) To properly use the equipment and software and never remove any equipment, software or other associated tool used at the Center. (d) To utilize information acquired by the center for authorized law enforcement purposes only and to restrict distribution of information to authorized personnel. Section 4. All Agencies agree as follows: (a) The YPD shall maintain full control and final decision-making authority on all financial matters regarding the acquisition, replacement or addition of equipment and all matters concerning the operation of the Center; (b) Each representative from a participating Agency shall be governed by the rules and regulations of their respective Agency and the YPD shall not enforce any rules promulgated by any Agency as applied to their representative; and, (c) All Agencies shall adhere to professional standards expected in a professional work environment. Section 5. This MOU may not be assigned by any participating Agency. Section 6. This MOU may be executed in two or more counterparts, each of which shall be deemed original but all of which shall constitute the same instrument. Execution of this MOU shall be by such person as authorized by the participating Agency to bind the Agency to its terms. 3 IN WITNESS WHEREOF, the parties have executed this Memorandum of Understanding by their authorized representatives as of the last date of signature shown below.
