AN ORDINANCE OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY,
ILLINOIS, APPROVING THE FINAL PLAT OF SUBDIVISION FOR
KENDALL MARKETPLACE LOTS 4 AND 5
WHEREAS, the United City of Yorkville (the "City") is a duly organized and validly
existing non home-rule municipality created in accordance with the Constitution of the State of
Illinois of 1970 and the laws of the State; and,
WHEREAS, Alexander L. Berman on behalf of Kendall Holdings I, LLC, (the
"Petitioner") has filed an application and petition for approval of the Final Plat of Resubdivision
for Lots 4 and 5 of the Kendall Marketplace development, generally located in the northwest
quadrant of Cannonball Trail and U.S. Route 34 (Veterans Parkway), for a total of 3 commercial
lots on approximately 3-acres; and,
WHEREAS, the Planning and Zoning Commission convened and held a public meeting
on October 11, 2023, to consider the Final Plat of Resubdivision for Lots 4 and 5 of the Kendall
Marketplace development; and,
WHEREAS, the Planning and Zoning Commission reviewed the standards set forth in
Chapter 3 and 4 of Title 11 of the Yorkville Subdivision Control Ordinance and made a
recommendation to the Mayor and City Council ("the Corporate Authorities") for approval of the
Final Plat of Resubdivision for Lots 4 and 5 of the Kendall Marketplace development.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the
United City of Yorkville, Kendall County, Illinois, as follows:
Section 1. The above recitals are incorporated herein and made a part of this Ordinance.
Section 2. That the Corporate Authorities hereby approve the Final Plat of Resubdivision
for Lots 4 and 5 of the Kendall Marketplace development as prepared by HR Green, dated last
revised August 24, 2023 attached hereto and made a part hereof as Exhibit A and authorize the
Mayor, City Clerk, City Administrator and City Engineer to execute said Plat.

Section 3. That the City Clerk is hereby authorized pursuant to Section 11-2-3.H of the
Yorkville Subdivision Control Ordinance to file a copy of this ordinance and the Final Plat of
Resubdivision for Lots 4 and 5 of the Kendall Marketplace development with the Kendall
County Recorder of Deeds.
Section 4. This Ordinance shall be in full force and effect upon its passage, approval, and
publication as provided by law.
