Resolution 2025-031Resolution No. 2025-31 A RESOLUTION OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS, AUTHORIZING PARTICIPATION IN THE STATE OF ILLINOIS BULK ROCK SALT PURCHASE PROGRAM WHEREAS, the United City of Yorkville, Kendall County, Illinois (the "City') is a duly organized and validly existing municipality of the State of Illinois pursuant to the 1970 Illinois Constitution and the Illinois Municipal Code, as from time to time amended (the "Municipal Code') (65 ILCS 5/65-1-1-2, et seq.); and WHEREAS, the State of Illinois (the "State") conducts an annual bulk rock salt purchase, in which municipalities may participate (the "Program"); and WHEREAS, for the City to participate in the Program, the Mayor and City Council (the "Corporate Authorities") of the City must, by official action, authorize representatives to act on behalf of the City, including delegating authority to enter into contracts and joint participation agreements with the State of Illinois on behalf of the City; and WHEREAS, the City has participated in the Program for years, and the State of Illinois began to require this authorization in 2024; and WHEREAS, the Corporate Authorities find it is in the best interests to authorize City Administrator Bart Olson and Director of Public Works Eric Dhuse to act on behalf of the City for the purposes of the Program. NOW, THEREFORE, BE IT RESOLVED by the Mayor and the City Council of the United City of Yorkville, Kendall County, Illinois, as follows: Section 1. The recitals set forth above are incorporated into this Resolution as if fully restated herein. Section 2. That City Administrator Bart Olson and Director of Public Works Eric Dhuse are hereby authorized to act on behalf of the City in the bulk rock salt purchase program, including to the authority to enter into contracts and joint participation agreements with the State Resolution No. 2025-31 Page 1 of Illinois and any of its agencies or departments, and are further authorized to execute any documents that may be necessary to the City's participation in the bulk rock salt purchase program. Section 3. That the City Clerk is hereby authorized to complete and execute the "Certificate of Authority by Vote", attached hereto as Exhibit A. Section 4. That this Resolution shall be in full force and effect from and after its passage and approval as provided by law. I hereby certify that said vote has not been amended or repealed and remains in full force and effect as of the date of the contract or joint participation agreement to which this certificate is attached. I further certify that it is understood that the State of Illinois will rely on this certificate as evidence that the person(s) listed above currently occupy the position(s) indicated and that they have full authority to bind the Governmental Unit.
