A RESOLUTION OF THE UNITED CITY OF YORKVILLE, KENDALL
COUNTY, ILLINOIS APPROVING A CHANGE ORDER RELATING TO
THE YBSD WATER MAIN EXTENSION PROJECT
WHEREAS, the United City of Yorkville (the "City") is a duly organized and validly
existing non home -rule municipality created in accordance with the Constitution of the State of
Illinois of 1970 and the laws of the State; and
WHEREAS, the City has approved a contract in the amount of $517,247.46 with
Winninger Excavating, Inc. ("Winninger"), for a project commonly known as the YBSD Water
Main Extension project, the price of which has decreased from the original contract amount in the
amount of $5,410.16 (the "Change Order") due to the final balancing of the contract; and
WHEREAS, this change order being a decrease of less than $25,000, and no other change
orders having been submitted on this project, a finding under Section 33E-9 of the Illinois Criminal
Code (720 ILCS 5133E-9) is not required for approval of change order; and
WHEREAS, it has been recommended to the Mayor and City Council (the "Corporate
Authorities") that a Change Order decreasing the total contract price to the amount of $511,837.30,
as set forth in the proposal from Winninger, be approved.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the United
City of Yorkville, Kendall County, Illinois:
Section 1. The foregoing recitals are hereby incorporated in this Resolution as the
findings of the Corporate Authorities.
Section 2. The Corporate Authorities hereby find and declare that the Change Order to
the YBSD Water Main Extension contract with Winninger Excavating, Inc., which results in a

total decrease of $5,410.16, is hereby approved, and the City Administrator is authorized to
execute the Change Order as hereinabove identified.
Section 3. That this resolution shall be in full force and effect from and after its passage
and approval according to law.
Passed by the City Council of the United City of Yorkville, Kendall County, Illinois this
