A RESOLUTION OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY,
ILLINOIS APPROVING A BID TO CONSTRUCT A NEW WATER RECEIVING
STATION BUILDING AND OTHER SITE IMPROVEMENTS
(South Receiving Station)
WHEREAS, the United City of Yorkville (the "City") is a duly organized and validly
existing non home -rule municipality created in accordance with the Constitution of the State of
Illinois of 1970 and the laws of the State; and
WHEREAS, the City plans to construct a new pressure adjusting station building that will
house new pressure reducing components and booster pumps, chemical feed equipment, related
piping components, electrical equipment, and associated appurtenances and site work (the
"Project"); and
WHEREAS, the Project is required for the City to connect to Lake Michigan water
through the DuPage Water Commission; and
WHEREAS, the cost of the Project shall be paid through a combination of Water
Infrastructure Finance Innovation Act loans (the "Loan") and City funds; and
WHEREAS, in compliance with all applicable Illinois laws, bids were accepted to
construct the Project and a public bid opening was held at on October 7, 2025; and
WHEREAS, the City's engineers and staff find that the lowest responsible bidder is
Whittaker Construction and Excavating, Inc., P.O. Box 21, Earlville, IL 60518 ("Whittaker"), with
a total bid amount of $6,875,000 (the "Project Cost"); and
WHEREAS, it has been recommended to the Corporate Authorities that the bid by
Whittaker be accepted, contingent on the City securing the Loan; and
WHEREAS, a Notice of Intent to Award the bid shall be issued to Whittaker.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the United
City of Yorkville, Kendall County, Illinois:
Section 1. The foregoing recitals are hereby incorporated in this Resolution as the
findings of the Corporate Authorities.
Section 2. The Corporate Authorities hereby find and declare that a bid by Whittaker
Construction and Excavating, Inc., P.O. Box 21, Earlville, IL 60518 to complete the Project at a
cost of $6,875,000.00 is the lowest responsible bid and therefore accept the bid, contingent on the
City securing the Loan.
Section 3. That this resolution shall be in full force and effect from and after its
passage and approval according to law.
Passed by the City Council of the United City of Yorkville, Kendall County, Illinois this

TO: Whittaker Construction & Excavating, Inc.

PROJECT Description: South Receiving Station, including all associated
appurtenances, site work, and materials necessary to complete the project.
The OWNER has considered the BID submitted by you for the above described
WORK in response to its Advertisement for BIDS dated August 18, 2025, and
Information for Bidders.
You are hereby notified that your BID has been accepted for items in the amount
of $ Six Million, Eight Hundred Seventy -Five Thousand Dollars ($6,875,000.00).
You are required by the Information for Bidders to execute the Agreement and
furnish the required CONTRACTOR'S Performance BOND, Payment BOND, and
certificates of insurance within ten (10) calendar days from the date of this Notice to
you.
If you fail to execute said Agreement and to furnish said BONDS within ten (10)
days from the date of this Notice, said OWNER will be entitled to consider all your rights
arising out of the OWNER'S acceptance of your BID as abandoned and as a forfeiture
of your BID BOND. The OWNER will be entitled to such other rights as may be granted
by law.
You are required to return an acknowledged copy of this NOTICE OF AWARD to
the OWNER.
