AN ORDINANCE OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY,
ILLINOIS AUTHORIZING THE RELEASE OF CERTAIN EASEMENTS
FOR THE CONSTRUCTION OF WATER MAINS
WHEREAS, the United City of Yorkville, Kendall County, Illinois (the "City") is a duly
organized and validly existing non -home -rule municipality created in accordance with the
Constitution of the State of Illinois of 1970 and the laws of the State; and
WHEREAS, the City acquired certain temporary construction easements on property
generally located along Corneils Road, east of Eldamain Road and identified by P1N(s) 02-07-400-
002, 02-07-400-003, and 02-18-200-002 (the "Subject Property") for the purpose of constructing
water mains and storm sewers within the City's corporate limits (the "Project"); and
WHEREAS, the City has completed the Project and therefore no longer needs temporary
construction easements on the Property; and
WHEREAS, the City therefore desires to release the temporary construction easements,
as provided on the Release of Temporary Construction Easements for Installation of United City
of Yorkville Sanitary Sewer and Water Infrastructure, attached hereto as Exhibit A.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United
City of Yorkville, Kendall County, Illinois, as follows:
Section 1. All the Recitals set forth above are incorporated as if restated herein.
Section 2. The Corporate Authorities hereby approve the Release of Temporary
Construction Easements for Installation of United City of Yorkville Sanitary Sewer and Water
Infrastructure, attached hereto as Exhibit A, and authorize the Mayor and City Clerk to execute.
Section 3. This Ordinance shall be in full force and effect after its passage, publication,
and approval as provided by law.

WHEREAS, the property generally located along Corneils Road, east of Eldamain Road
and identified by PIN(s) 02-07-400-002, 02-07-400-003, and 02-18-200-002 (the "Property") is
located within the corporate boundaries of the United City of Yorkville, Kendall County, Illinois
(the "City"); and
WHEREAS, the City recorded a Temporary Construction Easement against the Property
as Document Number 202300008469 on August 1, 2023; and
WHEREAS, the City recorded a Temporary Construction Easement against the Property
as Document Number 202400008394 on July 25, 2024; and
WHEREAS, the construction that necessitated the recordation of these easements has
been completed and the Temporary Construction Easements are no longer required.
NOW THEREFORE, the United City of Yorkville hereby releases the Temporary
Construction Easement recorded as Document Number 202300008469 on August 1, 2023, and the

Temporary Construction Easement recorded Document Number 202400008394 on July 25, 2024
with the Kendall County Recorder of Deeds for the purpose of constructing a sanitary sewer and
