A RESOLUTION OF THE UNITED CITY OF YORKVILLE, KENDALL
COUNTY, ILLINOIS APPROVING A BID TO CONSTRUCT WATER
MAIN IMPROVEMENTS ALONG ILLINOIS ROUTE 126
(IL Route 126 Water Main Improvements)
WHEREAS, the United City of Yorkville (the "City") is a duly organized and validly
existing non home -rule municipality created in accordance with the Constitution of the State of
Illinois of 1970 and the laws of the State; and
WHEREAS, the City plans to install approximately 6,800 feet of water main and 1,100
feet of sanitary sewer to connect a planned water receiving station with the City's existing water
infrastructure system (the "Project"); and
WHEREAS, the Project is required for the City to connect to Lake Michigan water
through the DuPage Water Commission; and
WHEREAS, the cost of the Project shall be paid through a combination of Water
Infrastructure Finance Innovation Act loans (the "Loan") and City funds; and
WHEREAS, in compliance with all applicable Illinois laws, bids were accepted to
construct the Project and a public bid opening was held at 11:00 a.m. on November 5, 2025; and
WHEREAS, the City's engineers and staff find that the lowest responsible bidder is Austin
Tyler Construction Inc., 23343 S Ridge Rd., Elwood, IL 60421 ("Austin Tyler"), with a total bid
amount of $2,559,902.21 (the "Project Cos("); and
WHEREAS, it has been recommended to the Corporate Authorities that the bid by Austin
Tyler be accepted, contingent on the City securing the Loan; and
WHEREAS, a Notice of Intent to Award the bid shall be issued to Austin Tyler.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the United
City of Yorkville, Kendall County, Illinois:
Section 1. The foregoing recitals are hereby incorporated in this Resolution as the
findings of the Corporate Authorities.

Section 2. The Corporate Authorities hereby find and declare that a bid by Austin
Tyler Construction Inc., 23343 S Ridge Rd., Elwood, IL 60421 to complete the Project at a cost
of $2,559,902.21 is the lowest responsible bid and therefore accept the bid, contingent on the City
securing the Loan.
Section 3. That this resolution shall be in full force and effect from and after its
passage and approval according to law.
Passed by the City Council of the United City of Yorkville, Kendall County, Illinois this

PROJECT Description: Route 126 Water Main Improvements; which consists of
approximately 6,834 feet of 16-inch ductile iron water main 163 feet of 8-inch C900 PVC
Sanitary Sewer Main 962 feet of 4-inch C900 PVC Sanita Sewer Force Main all related
appurtenances, sidewalk removal and replacement, pavement removal and replacement,
and all other appurtenant work and materials necessarV to complete the promect.
The OWNER has considered the BID submitted by you for the above described
WORK in response to its Advertisement for BIDS dated September 17 2025, and
Information for Bidders.
You are hereby notified that your BID has been accepted for items in the amount
of $ Two million five hundred fifty-nine thousand nine hundred two and twenty-one
hundredths Dollars 2 559 902.21 .
You are required by the Information for Bidders to execute the Agreement and
furnish the required CONTRACTOR'S Performance BOND, Payment BOND, and
certificates of insurance within ten (10) calendar days from the date of this Notice to you.
If you fail to execute said Agreement and to furnish said BONDS within ten (10)
days from the date of this Notice, said OWNER will be entitled to consider all your rights
arising out of the OWNER'S acceptance of your BID as abandoned and as a forfeiture of
your BID BOND. The OWNER will be entitled to such other rights as may be granted by
law.
You are required to return an acknowledged copy of this NOTICE OF AWARD to
the OWNER.
