Ordinance No. 2026-06 AN ORDINANCE OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS ACCEPTING THE DEDICATION OF PUBLIC IMPROVEMENTS LOCATED WITHIN THE GRANDE RESERVE UNIT 7 SUBDIVISION WHEREAS, the United City of Yorkville, Kendall County, Illinois (the "City") is a duly organized and validly existing non -home -rule municipality created in accordance with the Constitution of the State of Illinois of 1970 and the laws of the State; and WHEREAS, the City has the ability to acquire and hold real property for corporate purposes pursuant to 65 ILCS 5/2-3-8; and WHEREAS, the water main, sanitary sewer, storm sewer, streets, sidewalks, lighting and parkway trees located within the Grande Reserve Unit 7 Subdivision (the "Public Improvements") have been completed by Grande Reserve (Chicago) ASLI VI, L.L.L.P., an Illinois limited liability limited partnership (the "Developer"); and WHEREAS, the Developer has requested, and the City's engineer has recommended, that the City accept the Public Improvements, as described on the Bill of Sale, attached hereto as Exhibit A, for ownership and maintenance; and WHEREAS, Developer shall be required to provide a performance guarantee bond to cover a one-year maintenance period that shall commence upon the City's acceptance of the Public Improvements; and WHEREAS, the Mayor and City Council of the City are of the opinion that it is in the best interests of the safety, health and welfare of the residents to accept ownership of the Public Improvements for public purposes and for the overall benefit of the residents. NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of Yorkville, Kendall County, Illinois, as follows: Ordinance No. 2026-06 Page 2 Section 1. All of the Recitals set forth above are incorporated herein as if restated. Section 2. That the City accepts the Public Improvements, as described on the attached Exhibit A, contingent on the Developer securing a one-year maintenance bond in the amount of $226,884.77. Section 3. This Ordinance shall be in full force and effect after its passage, publication, and approval as provided by law.
