A RESOLUTION OF THE UNITED CITY OF YORKVILLE, KENDALL
COUNTY, ILLINOIS APPROVING A CHANGE ORDER RELATED
TO THE FAXON ROAD RECONSTRUCTION PROJECT
WHEREAS, the United City of Yorkville (the "City") is a duly organized and validly
existing non home -rule municipality created in accordance with the Constitution of the State of
Illinois of 1970 and the laws of the State; and
WHEREAS, the City has approved a contract in the amount of $193,629 with Engineering
Enterprises, Inc. ("EEI" ), for a project commonly known as the Faxon Road Reconstruction
Project (the "Project"), the price of which has increased from the original contract amount in the
amount of $47,680 (the "Change Order") due to adjustments to the original contract and plans
necessitated by a change in the alignment of the road reconstruction; and
WHEREAS, all change orders increasing or decreasing the cost of a public contract by at
least $25,000 must meet the required findings that circumstances necessitating the change were
not reasonably foreseeable at the time the contract was signed; or the change is germane to the
original contract as signed; or the Change Order is in the best interest of the City as required by
Section 33E-9 of the Illinois Criminal Code (720 ILCS 5/33E-9); and
WHEREAS, it has been recommended to the Mayor and City Council (the "Corporate
Authorities") that a Change Order increasing the total contract price to the amount of $241,300 is
in the best interest of the City.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the United
City of Yorkville, Kendall County, Illinois:
Section 1. The foregoing recitals are hereby incorporated in this Resolution as the
findings of the Corporate Authorities.

Section 2. The Corporate Authorities hereby find and declare that the Change Order to
the contract with EEI to complete the Project, which results in a total increase of $47,680,00, is in
the best interests of the City and is hereby approved, and the City Administrator is authorized to
execute the Change Order as hereinabove identified.
Section 3. That this resolution shall be in full force and effect from and after its passage
and approval according to law.
Passed by the City Council of the United City of Yorkville, Kendall County, Illinois this

Description of Work / Scope Change 1 Reason for Change
City Staff has been working with the property owners on the south side of Faxon Road for the past 12 months to
try and acquire the needed right-of-way to complete the improvements required in Cyrus One's development
agreement. Staff have not had much movement on property acquisition so an alternative alignment to reduce the
land acquisition needs was researched. Staff were able to determine that an alternative alignment is viable, and
the new alignment would reduce the number of parcels that need land acquisition from 3 down to 1. The new
alignment would also decrease the required land acquisition on the remaining parcel. The new alignment
requires that current project plans and specifications need to be updated. The additional scope will include
putting together revised project plans, specifications and land acquisition documents. Attached, please find a
level of effort for the associated work and the amounts are summarized below.
