AN ORDINANCE OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY,
ILLINOIS, GRANTING A FRONT YARD SETBACK VARIANCE FOR A PROPERTY
LOCATED AT 202 E. WOLF STREET, YORKVILLE, ILLINOIS
WHEREAS, the United City of Yorkville, Kendall County, Illinois (the "City") is a duly
organized and validly existing non -home -rule municipality created in accordance with the
Constitution of the State of Illinois of 1970 and the laws of the State; and
WHEREAS, pursuant to the Illinois Municipal Code (65 ILCS 5/11-13-5) the Mayor and
City Council of the City (the "Corporate Authorities") may provide for and allow variances to
provide relief when strict compliance with the requirements of the City of Yorkville Unified
Development Ordinance (the "UDO") presents a particular hardship; and
WHEREAS, Vera Pleva, on behalf of General Laboratory Products, Inc. (the "Applicant"),
requested relief from Section 10-3-9 of the UDO requiring a minimum front yard setback of twenty-
five (25) feet for the property commonly known as 202 E. Wolf Street and identified by PIN No.
05-04-151-014 (the "Subject Property"); and
WHEREAS, notice of a public hearing on said application was published and pursuant to
said notice the Planning and Zoning Commission of the City conducted a public hearing on
February 11, 2026 on said application in accordance with the State statutes and the ordinances of
the City; and
WHEREAS, the Planning and Zoning Commission made the required written Findings of
Fact, finding that the variation met the standards in Section 10-8-9C of the UDO and recommended
that the variance be granted; and
WHEREAS, the Corporate Authorities of the City of Yorkville have received and
considered the recommendation of the Planning and Zoning Commission.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United
City of Yorkville, Kendall County, Illinois, as follows:
Section 1. The above recitals are incorporated herein and made a part of this Ordinance.
Section 2. That this Ordinance shall apply to the Subject Property legally described as:
THAT PART OF LOT 1 IN BLOCK 2 OF FOX INDUSTRIAL PARK UNIT 4 DESCRIBED AS
FOLLOWS:
BEGINNING AT THE NORTHWEST CORNER OF SAID LOT 1; THENCE SOUTH 81
DEGREES 52 MINUTES 08 SECONDS EAST ALONG THE NORTH LINE OF SAID LOT 1,
164.68; THENCE SOUTH 09 DEGREES 09 MINUTES 49 SECONDS, WEST PARALLEL
WITH THE EAST LINE OF SAID LOT 1, 140.00 FEET; THENCE SOUTH 54 DEGREES 09
MINUTES 49 SECONDS WEST, 28.54 FEET, THENCE NORTH 81 DEGREES 52 MINUTES
08 SECONDS WEST, PARALLEL WITH THE NORTH LINE OF SAID LOT 1, 113.82 FEET
TO THE WEST LINE OF SAID LOT 1; THENCE NORTH 01 DEGREES 44 MINUTES 07
SECONDS WEST, ALONG SAID WEST LINE, 162.19 FEET FOR THE POINT OF
BEGINNING IN THE CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS.
with Property Index Number 05-04-151-014.
Section 3. That the Planning and Zoning Commission made the following findings of fact:
i. That the City Ordinance to be varied is Section 10-3-9 of the UDO.
ii. That, due to the size of the property and existing conditions on the east and west
sides of the property, a cooler addition to the building could not be erected on the
side or back lots of the property.

iii. The conditions necessitating this request for a variation are unique to the Subject
Property, as there exists a drainage ditch on the property, limiting the space for
adding a cooler to the existing building.
iv. New regulations for manufacturing virus test media make the addition of a cooler
on the existing property necessary for the business being operated therein.
V. Permitting the variation will not injure the public welfare generally, or other
properties in the neighborhood.
vi. Reducing the setback variance on the Subject Property to allow the construction of
a cooler addition on the existing building will not impair the adequate supply of
light and air to adjacent properties, will not impair property values within the
neighborhood, and will not increase danger to public safety.
and therefore recommend the City Council grant the requested variation.
Section 4. That a variation pursuant to Section 10-3-9 of the UDO reducing the front
setback at the Subject Property from twenty-five (25) feet to five (5) feet is hereby granted.
Section 5. That the cooler addition shall be constructed, operated, and maintained in
accordance with the requirements of the Yorkville City Code and generally located as shown on
the attached civil site plan provided by the Applicant and made a part hereof as Exhibit A.
Section 6. That this Ordinance shall be in full force and effect upon its passage, approval
and publication as provided by law.
