ORDINANCE OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY,
ILLINOIS AMENDING TITLE 4, CHAPTER 4, SECTION 4-4-6-E OF THE
YORKVILLE CITY CODE
(Noise Ordinance)
WHEREAS, the United City of Yorkville (the "City') is a duly organized and
validly existing non home-rule municipality created in accordance with the Constitution
of the State of Illinois of 1970 and the laws of the State; and,
WHEREAS, the City pursuant to Section 5/11-60-2 of the Illinois Municipal
Code (65 ILCS 5/11-60-2) may define, prevent, and abate nuisances pursuant to the
City's authority to protect the public health, welfare and safety; and
WHEREAS, the Mayor and the City Council have determined it to be in the best
interest of the City and its residents to adopt an ordinance limiting noise generated by
construction or maintenance activities with certain exceptions, all as hereinafter
provided.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of
the United City of Yorkville, Kendall County, Illinois, as follows:
Section 1. That Title 4, Chapter 4, Section 4-4-6-E of the Yorkville City Code, as
amended, be and is hereby amended to read as follows:
"E. Construction or maintenance: Noise generated by construction or maintenance
activities, performed for the improvement or maintenance of real property, from 7:00
a.m. to 7:00 p.m. Monday through Saturday. Construction activity is strictly prohibited
on Sundays, except for homeowners performing construction or alterations on their own
property with a permit, if required, between the hours of 7:00 a.m. to 7:00 pm. and in
compliance with sound level limits established in Section 4-4-5 of this title."
Section 2. This Ordinance shall be in full force and effect upon its passage,
approval, and publication as provided by law.
