AN ORDINANCE OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY,
ILLINOIS AMENDING TITLE 3, CHAPTER 2, SECTION 3-2-4
OF THE YORKVILLE CITY CODE
(Municipal Taxes)
WHEREAS, the United City of Yorkville, Kendall County, Illinois (the "City"), is a duly
organized and validly existing non -home rule municipality created in accordance with the
Constitution of the State of Illinois of 1970 and the laws of the State; and,
WHEREAS, Chapter 2, Title 3 of the Yorkville City Code establishes all municipal taxes
as permitted by Illinois law including a tax on the gross receipts from the transmission or selling
of gas or electricity; and .
WHEREAS, Section 8-11-2 of the Illinois Municipal Code (65 ILCS 518-11-2) establishes
the maximum rates to be imposed on a monthly basis based upon usage of the purchaser of
electricity beginning with the rate for the first 2,000 kilowatt-hours used or consumed in a month
and increasing the rates as the usage of kilowatt-hours increases to a maximum rate of .30 cents
per kilowatt-hours for all electricity used or consumed in excess of 20,000,000; and
WHEREAS, Chapter 2, Section 3-2-413 establishes the electrical utility rates on all persons
engaged in the consumption of electricity within the corporate limits of the City which are the rates
authorized by Section 8-11-2 of the Illinois Municipal Code with the exception of the rate
established for the use in excess of 20,000,000 kilowatt-hours which is .0277 cents, which is
inconsistent with the intended rate structure; and
WHEREAS, the City has reviewed current utility reporting and determined that
Commonwealth Edison (ComEd) reflects the City's rate for this usage tier as 0.285, and the City
desires to formally adopt this rate to ensure consistency and clarity; and
WHEREAS, the City has determined that Section 3-2-413 of the Yorkville City Code
should be amended to correct the typographical error and reflect the appropriate rate for electricity
usage in excess of 20,000,000 kilowatt-hours per month; and
NOW THEREFORE, BE IT ORDAINED, by the Mayor and City Council of the United
City of Yorkville, Kendall County, Illinois as follows:

Section 1. That Title 3, Chapter 2, Section 3-2-4 BI.C.(1)(A)X of the Yorkville City
Code, be and is hereby amended to delete said Section in its entirety and replace it with the
following:
X. For all electricity used or consumed in excess of twenty million (20,000,000)
kilowatt- hours in a month; 0.285 cents per kilowatt hour.
Section 2. This Ordinance shall be in full force and effect upon its passage, approval
and publication as provided by law.
