COUNTY OF KENDALL ) i2 la -10 0 0 0 :F_ -4 , ef s o :E F=N " BEE I E F_F-_ET - rE KENDALL COUNTY, IL RECORDED: 8/19/2010 10:12 AM ORDI: 49.00 RHSPS FEE: 10.00 PAGES: 4 Ordinance No. 2010 -L AN ORDINANCE OF THE UNITED CITY OFYORKVILLE, KENDALL COUNTY, ILLINOIS, APPROVING A VARIANCE IN HEIGHT FOR A TELECOMMUNICATIONS TOWER FOR U.S. CELLULAR I WHEREAS, the United City of Yorkville (the "City ") is a duly organized and validly existing non home -rule municipality created in accordance with the Constitution of the State of Illinois of 1970 and the laws of the State; and, WHEREAS, U.S. Cellular is the lessee of property located at 1947 US Route 34, Yorkville, Illinois, identified as permanent index number (PIN) 02 -19- 300 -009, legally described in Exhibit A, attached to and made a part of this Ordinance (the "Subject Property "); and, WHEREAS, U.S. Cellular has requested that the Mayor and City Council of the City (collectively, the "Corporate Authorities ") grant them relief from Section 10- 15 -5(D) of the City Code of Ordinances (the "City Code "), which requires that no telecommunications antenna, antenna structure or tower shall exceed a height of one hundred (100) linear feet in aerial height, by approving a variance to permit a telecommunications tower of one hundred ninety -four feet (194') in height; and, WHEREAS, the Zoning Board of Appeals ( "ZBA ") convened and held a public hearing on the 7` day of July 2010, to consider the request to increase the maximum height of the telecommunications tower from one hundred feet (100') in height to one hundred ninety -four feet (194') in height; and, WHEREAS, the ZBA reviewed the standards set forth in Section 10- 14 -5(C) of the City Code, and found that: 1) because the particular physical surroundings, shape or topographical conditions of the specific property involved, a particular hardship to the owner would result, as distinguished from a mere inconvenience, if the strict letter of the regulations was carried out; 2) the conditions upon which the variation petition is based are unique to the Subject Property for which the variation is sought and are not applicable, generally, to other property within the same zoning classification; 3) the alleged difficulty or hardship is caused by the City Code and has not been created by any person presently having an interest in the Subject Property; 4) the granting of the variation will not be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the Subject Property is located; 5) the proposed variation will not impair an adequate supply of light and air to adjacent property, or substantially increase the congestion in the public streets, or increase the danger to the public safety, or substantially diminish or impair property values within the neighborhood; and, WHEREAS, upon conclusion of said public hearing, the ZBA recommended the approval of the requested height variance to one hundred ninety -four feet (194'); and, WHEREAS, U.S. Cellular requested a special use permit, for the Subject Property for a telecommunications tower before the Plan Commission and received a favorable recommendation which will be addressed before the United City of Yorkville City Council simultaneously with this Ordinance. NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of Yorkville, Kendall County, Illinois, as follows: Section 1. The above recitals are incorporated and made a part of this Ordinance. Section 2. The Corporate Authorities hereby approve the variance to permit a telecommunications tower of one hundred ninety -four feet (194') in height for the property located at 1947 US Route 34, Yorkville, Illinois, identified as permanent index number (PIN) 02 -19- 300 -009. Section 3.
