Discussion:
1.) Fox Mill Landing - Existing buildin plans are
changing, Phase One was passed in Plan Commission if
five items were taken care of. The P.U.D. agreement
needs to be done. They would like the a concrete pipe
instead of PVC. Plan Commission thinks that they
should follow the Cit Engineer. Developer can not
put in split rail fence because they have not gotten
easement from the railroad. The developer thinks he
will be able to get the easement in Phase Two. What
if he never gets easement? Spang suggest maybe
putting fence up right before driveway, then once the
easement is acquired then move fence, The road is not
in yet. Burd will check on road. They don't have
P.U.D. agreement yet. There is an easement to the
second lot, but they can't use it for anything. Won't
have sidewalk until Phase Two. The railroad is very
hard to deal with. The developer really needs to get
the easements from the railroad. The spur is still
there and needs to be removed first. Prochaska feels
the City is being put in an awkward spot. It is a
great development but there is a live railroad two
feet out the front doors, If someone was to purchase
Robb Container and want to use the railroad spur, its
still there and they would be able to use it. FS also
uses the spur. Spang suggest making the front doors
for emergency use only. The entrance and exit will
be on the South side of the building. The garages are

on the South side. Fence is to protect from the main
line because that line is used on regular basis.
Prochaska suggest covering the door with some type of
railing, but still make it so people can get out in
case of emergency. They will need to make sure it
will pass the fire codes. This development needs two
sources of water Plan Commission recommended a loop
A loop will cost approximately $20,000, They could
loop through Robb Container back up to Van Emmon.
They would need to get easement back to Van Emmon.
Current Ordinance requires two sources of water. The
water at the end of a line usually is not very fresh
and for hydrants. Wywrot said that if Phase Two is
never developed he would rather see a short water
main. Burd will talk with Darrin. The Storm Sewer
needs to be deeper. The current Storm Sewer will
handle Phase One. Wywrot recommends extending all the
way to the River. They would have to go under the
railroad tracks. Nanninga would like to suggest that
Darrin to put sewer in under the railroad tracks and
paying for all supplier and the City will install the
remainder of the line to the River. Wywrot is
concerned that if too many items are put on Phase Two,
it may not get completed. Wywrot will talk with
Darrin, if he agrees it will be put in the P.U.D.
agreement. This will either come back to next EDC or
will go to COW on 2/6/97.
2.) Lot at Orange and Mill - Old lots should be developed
as is. Prochaska would like to know the State
Stature. State Stature does not give anyone the right
to override a City Ordinance. If a resident within
12,000 feet complain, then the City can issue a Stop
Permit. This needs to be looked at. Once an old lot
is turned, then it becomes a new lot and must conform
to the current City Ordinances. A lot of older lots
are more narrow. The City currently has no way to
look at the lot. There needs to be a way that the
City is notified when a lot is moved. Spang said that
is this case, the old plat was there with new
configurations. There are several of these older lots
in town and there needs to be some way to address it.
Hiles said there is not an easy answer for this.
Jones suggest asking Detmer to next meeting. If
someone wants to change the configuration they should
have to request a variance. Hiles said the City could
do an Ordinance for this.
3.) Roppolo /Coach Road Hills - Nanninga had a meeting with
Dan about three weeks ago to see where everything is
at, If the Sewer issue is solved with Edmeier, then
it will take care of this. Roppolo will still only be

able to put in the first 177 units. When they get to
178 then he will have to front fund the money to get
the line from Rt. 71 to the new River crossing.
However, ca at the Plant is limited. The first
177 units will o to the temporary lift station just
north of the Industrial Park. On the first 177 units
Roppolo will be paying a double recapture. Those 177
units will be moved to the permanent line, When
Roppolo gets to unit 178 the City will deduct the
Pot -O -Money and the remainder amount would need to be
j paid. Roppolo will have the option to front fund the
money or wait until someone else puts in the line.
Country Hills will also be paying a recapture fee.
Roppolo said he will be paying in prepaid fees, the
building permits are $10,500, City sewer connection
fee of 52000, and $642 in recapture fees. The $2000
is not meant to extend the lines, The P.E. averages
3.5 per home. Anyone that taps onto the Rt. 47 line
has to pay a reca fee. The Rt. 47 line is a
commercial line. The recapture fee for the Rt.47 line
is paid to the County. Roppolo has approximately 40
units that can hook into the Rt. 47 line. Nanninga
feels that Edmeier needs to be approved before Roppolo
but it could go to COW the same night. There is an
Intergovernmental agreement being drafted now. If
Edmeier is not in first or approved first the Roppolo
will not get 177 units. Roppolo went to Park Board
last week. Nanninga would like to see P,U.D. before
COW on 2/6/97, Hughes wanted to know if there -are any
delays with Edmeier could Roppolo be approved on
continent of Edmeier? Dan thought that would be
ok. Hughes will work with Dan on everything except
the sewer. COW with P.U.D.
4.) Land Cash Ordinance (Park Standard) - Nanninga would
like to add "at time of preliminary plat. Nanninga
would then like to make sure that preliminary and
final plat are the same. This should go to Park Board
before Plan Commission before preliminary after
concept. Wywrot is finding. some conflicting items in
the Ordinance. He would like some time to review and
bring back. The purpose of this Ordinance is to
discourage developers to give the City their worst
piece of property. Prochaska thinks this should cover
anything that someone wants the City to take and also
anything that will go into a Homeowners Association.
Including anything on private property. Nanninga
thinks that if there is a Homeowners Association then
the City would be collecting fees and would hire a
landscaping company to maintain the grounds. Jones
would like Nanninga and Wywrot to look at it, if ok
take to COW, if we need to make changes bring back.

5.) December Building Report - Looks good.
B.) Parking Standards - Looking for all Parking to be
independently accessible, to townhomes requirement is
two car enclosed. Need to get some clarification on
apartment hotel. Sowinski would like to know about
parking boats, trailers, and motor homes in driveway,
or next to a garage for the winter months. Would the
City consider allowing this in summer months only?
7.) R -3, R -4 Zoning Modifications - R -3 will allow five
units per acre, This is at the low end but is
acceptable. For townhomes, Ordinance states that Not
more than 30 percent of the area of a zoningg lot may
be covered by buildings or structures, including
accessory buildings, Jones would like a description
of a structure. There is a minimum if 12 ,000 square
feet for a single stor and 14,000 square feet for a
two story space excluding the garage. Nanninga got
the minimums from Detmer. R -4 Apartments - Five acres
are per gross acres. Minimum lot area per dwelling
was increased by 20 percent to decrease density,
8.) Storm Water Storage Requirements - This Ordinance is to
discourage detention /retention in the front of the
property. However, if it has to go there then there
will be some restrictions on it. If the area is less
then five feet, then the City will accept Blue /Green.
To be in accordance with the current Ordinance,
Ordinance will read that all grass areas should be
maintained as a normal grassed yard with grass height
in accordance with the current Ordinance.
9,) Additional Business
Wednesday night there is a Building Code Workshop at
F.E. Wheaton. Thursday there is a Public Hearing.
Large Estate Zoning is going to COW, combine sewer and
water together.
Dunkin Donuts will be reopening approximately 2/1/97,
Thornton Oil will be giving some references, Thornton
Oil, gas station with Convenience Store. They might
also be looking at a liquor licenses to sell packaged
liquor.
Home Page - Lynch said it is just a map of Yorkville.
There is no text. Nanninga has talked to Library and
Park Board to maybe come up with something. Need to
have some key words. Some Cities are making money off
their Home Page, The City could consider selling
advertising space to local business owners.
