Discussion:
1.) School Transition Fees — We can justify the fees with an assessment. It is Sticka's
concern because we can not justify it. Sticka suggest talking with the school board.
We tried this once before. The school board did not want to indemnify the City for
any previous transition fees that were collected. Now we have annexed business
property into the Plano school district. The City collects the transition fee and passes
it along to the school district. We have just gotten some businesses interested in
Yorkville again. We need to be careful. If we were to waive the fees and increase
taxes by a small amount it actually works out better. Sugar Grove and Elburn do this.
The school board would be willing to do a study and to help pay for it. Maybe the
City liaison could bring it up at school board meeting. We need to look at all our
options and we need to be careful on how we approach it. We are already at the
higher end of things. The transition fee is $1,500. We need to consider abolishing
the transition fee if the school district does not want to enter into an agreement with
the City. We need to get feed back from the school district. We need to explain what
we are doing, but we need to be careful with the perception. We do not know how
the residents of Sugar Grove or Elburn perceived it. Maybe we need to indemnify our
current ordinance. The City would be responsible to return the money because we
collected it. Roger Dalstrum will do a study for approximately $10,000. We need to
ask him to attend a meeting and see what it will take to get a study done. We need to
look at the best interest of the City. Mayor Prochaska would like everyone to have a
copy of that last ordinance we tried to pass. We had an ordinance all ready to go but
the school district would not agree to part of it. We may have to pass the ordinance to
force the school district to do anything. The ordinance would require indemnification
on any transition fee collected from here on. The ordinance will need to cover any
school district that we build into. We should also talk with the Piano school district.
We have two separate fees, a land cash fee and a school transition fee. Sugar Grove
and Elburn collect only one fee. If the school district does not want to indemnify the
City then the City needs to stop collecting the fee. Bring to COW.
2.) Land Cash — TAW.
3.) Zohiklg Changes for k -I and Estate Lot Zoning — This is just a clean up for the
codification. The Codification Company has asked us to clean this up and clarify it.

R -1 zoning is 18,000 square foot lots with a side yard set back. Do we want to make
it 15 feet, lot size was 20,000 square feet, it is still more then 10 percent. It makes
sense to change it. The codifiers are looking for clarification.
4.) Ordinance Banning Portable Signs — Banning portable signs went to public safety.
This is for a variance. Someone has challenged us. Since we have been challenged
be can not enforce it. It we ban portable signs then we have to ban it for everyone.
This would include police and fire department, schools, and foundation using the sign
for charity events, etc. Portable signs are basically signs on wheels. We should be
able to find another community that has banned or restricted the use of this type of
sign. The Chamber of Commerce wants them banned. We need to find out from
Melissa what our next step needs to be. We need to get the study from Detmer. The
Becker's asked for the variance. Mr. Becker said he spoke with Bob Johnson.
Johnson said they never spoke. What does the City need to do? Appealing to City
Council. Nanninga will check with Melissa. We will probably deny the variance.
Becker bought the sign business. The grandfather was specific to the Shopper's
property.
5.) Private Sewer — Lawrence Gardner - Gardner's property is on the small street that
leads back to the cemetery off of Somonauk Street. He wants to put in a septic. Plan
Commission recommends. Take to COW.
6.) Additional Business — Shopper Driveway — If the drive becomes a cut through then
they would loose it. Now they have a ladder going across it.
Annexation Agreement — Moving ahead with the annexation agreement at the north
end along Route 47. What would the City be willing to do to get people to annex into
the City? How would we service that area with water and sewer? How would it be
looped? Mayor Prochaska asked Nanninga and Wywrot to get some costs together.
If we increased the lift station would it cover any commercial development along
Route 47? We need to be able to show willingness and a plan. Fox Metro can
service part of the area east of Route 47. We need to look at different options for
sewer in that area. Blackberry Creek subdivision has not annexed yet. They are
contiguous. They would annex in as R -1.
York Meadow — They came in and asked if they could build six buildings instead of
eight. Could they consolidate the lots and rearrange them? If they do this they will
have to get different permits and have a public hearing to request a variance. We are
still working on this. The six months expires in February. They can ask for an
extension.
Shell — We did get a call from the architectural firm. They are coming in for a
meeting.
