Fox St. Time Adjourned: 8:45 p.m. Present: Art Prochaska Tom Sowinski Richard Sticka Valerie Burd Jim Nanninga Dave Dockstader Alan Norton Dean Edmeier I Discussion: CANNONBALL HILL This item has gone to Plan Commission. They recommended it with conditions that were minor like landscaping and height elevations. Recommended passing it along with the conditions. However, if these conditions are not met it will not go forward to C.O.W. Alan Norton's representative felt they could be completed within a week. The storm water detention requirements and flood levels were discussed regarding drainage. The only change from Joe Wywrot's letter not made at this time was the setback on one lot. It was verified that they will be connecting to the sidewalk at Blackberry Creek North. They will. The County has agreed to accept the wetland but they want a Phase I Environmental completed. Alan's representative will sit down with Joe Wywrot to review each detail that needs adjusting prior to this going to the next C.O.W. FOX HIGHLAND Dean Edmeier is requesting a change in the original A Agreement. This was explained to the q g g g P members in detail in a memo. There is issue that has come up with the YBSD. They need the upfront money ($595,000) that was agreed to, not just $200,000, in order to upgrade the plant to be able to accept the additional flow from the extension of sewer that this project will create. They are asking for one provision. They would like the City to agree to a time provision for unit 2 to begin, say 18 -24 mos., if Dean has not started unit 2 by that time then the City will give to YBSD $1800 (or some amount) of the $2000 sewer hook up fee for each permit in that unit. Then when unit 2 is started the City would keep the $395,000 that would have gone to the YBSD in one lump sum. The City would give a cash advance, in effect, to the YBSD so they could start paying back their debt for the improvements. Discussion was held over the ramifications of this. The other problem of the expiration of the land with the landowner was discussed. But the situation with the YBSD needs to be settled first. The YBSD just wants to know that if someone other than Edmeier develops unit 2, the agreed to amount will still be paid to them somehow. The golf course will have to be developed in unit 2 -5 due to the land. The YBSD is looking to double their plant in the next two years. Their fees are going to be increased to the citizens. The sewer rehab was done to help the flow for them too. There was concern that the City may get into a position of economic stress with this agreement. There would be no money paid to YBSD until the sewer is finished. Their fee is planned on being increased to usage fee instead of the flat fee that is charged now. Concerns regarding this increase and the outcry that will occur from it was discussed. The possibility of double meters, one for water and one for sprinklers was discussed also. Jim was asked about the effects this will type of agreement will have on the City's budget. He explained that without this sewer being built there won't be any money generated from the building permits in this south area. This sewer will open up the whole south area. This would all be new money. Some of this money was going to be counted in debt service. The Roppolo piece is being looked at seriously to be picked up with the same PUD as well as others. Jim explained that the City would still get $200 /permit of the sewer hook up fee. It was reiterated that the City is not putting any additional funds out or placing the City in any precarious position whatsoever. The City is paying out the same amount of money just at a different time span. It will come from permits as they are taken out and only from that area, that ties into that sewer line. There is not time on the dollars. If the area develops slowly then they get paid at the same time frame. Any additional developments not tying into that new south sewer line would not be involved in this agreement or payout to the YBSD. A timeline of a financial commitment letter stating within 30 days the sewer construction will be started. The YBSD will not vote on this until the City puts together an Agreement. They are asking the City to pass an agreement containing these issues. A Public Hearing must be held. The Doetchman's didn't sign the PUD, so they're zoning right now is Al or the most restrictive zoning. Jim will verify this with Dan Kramer. Dan always says to vote to annex then to zone because the zoning always reverts to the most restrictive. The Doetchman's will not sign without a deal in place with Edmeier or another buyer. The PUD's don't need a signature in a certain amount of time. If the PUD is redrawn than the door for change is reopened. A new PUD needs to be signed for unit 1 with Edmeier only. Doetchman' s are not involved in unit 1. The legal aspect needs to be checked on with Dan Kramer. This concept will go to COW depending on Dan Kramer's approval. ADDITIONAL BUSINESS Art made a statement that City employees are not to give an opinion on land boundaries in relation to unannexed property outside the City. It is between the landowner and the developer, not the City. Carolyn Herron has had some difficulties with determination of her property boundaries, the City should not give any opinion. Jim showed a layout of Fox Hill and the property to clarify the park and commercial areas. This park land is somewhere in the three acre area. Scott is doing a final plan for this park. This will have a public hearing to change the zoning of this parcel one week from Thursday. The Recreation Board did give a positive recommendation for this swap. The Comprehensive Plan language was updated and the land plan was updated in 1997. The boundaries need to be relooked at, we have large lots in the northeast and Montgomery and Oswego are coming in the subdivisions. This area needs to be rethought out. Need to review Montgomery and Oswego's Plans for this area to review and maybe rethink what we want here. The possibility of Bristol becoming part of Yorkville was discussed especially if Montgomery starts trying to bring them in. Meeting adjourned 8:45 pp. 1
