New Av-reement on Fox Hill & 50% Sales Tax:
This will not be retroactive and will go to Dick Faltz only. The agreement was
only completed 2 hours ago and his attorney will review tonight and answer by
Friday. There needs to be commercial and they would like to remove the
Whereas relating to the discussion of Park. Wants this part taken out. The other
builder in Fox Hill has the same option if (and only if) he develops commercial.
This should go to the next COW on May 6th. Jim will check with Kramer
regarding the need for a public hearing for a fee change. Copies of the change will
be distributed to City Council. Review minutes of Park Board meeting regarding
agreement for Park Swap.
Facade Prov-ram:
The boundary is to be Main Street to Mill, Van Emmon to Hydraulic (both sides).
Kramer has been requested to draft an Ordinance or Resolution for "pilot Program
Area" terminology. This should not be called Facade program; it should be Pilot
Program. Review in 12 months. It is recommended to have a five member board,
and word should get out for volunteers.

Prochaska explained the latest request. Phase I only at this point. Will build
sewer. Prepaid fees (instead of $800,000.) $200,000. The other $600,000. will
come later as Phase 2 starts. Need deadline Nanninga to check with YBSD. Get
Public hearing going. Put in a start time or this will revert back to the original
PUD. The start should be when he submits the "Project Bonds" for public sewer
improvements. Should be within 2 weeks of passage or it reverts back to original
PUD.
Plano Boundary Agreement:
Prochaska is to talk to Sue Nesson. Do not want any provision that Plano can
delay improvements for their southwest corner. Nanninga is to contact Don Falls
at The Department of Commerce and Community Affairs regarding grants since
Eldamain Road is our boundary "City Limits ".
Per the agreement in progress, we will improve Eldamain within our City limits as
a City of Yorkville road according to our development standards when, and only
when Yorkville needs the road improved. We would not restrict Plano from
developing the road for property on the west side of Eldamain.
