EDC Minutes 2000 06-20-00 UNITED CITY OF YORKVILLE ECONOMIC DEVELOPMENT COMMITTEE METING MINUTES JUNE 20, 2000 7:00 PM Attendees: Richard Sticka Mayor Art Prochaska Tom Sowinski Valerie Burd Jim Nanninga PC 99 -11 COURTHOUSE SQUARE - REVISED PLAN - Art Sheridan Mr. Sheridan presented his revised plan showing one building of the same square footage. He has moved the berm and planting out 60 feet from the lot line. He has moved the front building forward and the detention area to the southeast corner of the property. He is still reserving the southwest corner for a future use, which will not be a gasoline station in light of the requested "O" Office PUD with business uses. He has moved away from the north lot line, and also presented the elevation of the buildings. Chairman Sticka asked if the existing building on the site now would be used for a residence. Mr. Sheridan stated this would be converted to other uses. The overall plan now has moved 50 feet farther south, but there is a 30 foot set -back requirement at the south also. There was a statement from a Cannonball Trail resident asking why the buildings could be faced the opposite way with the back to route #34, with the parking in the back. I Mr. Sheridan stated that you cannot successfully put parking behind a retail building, and for the sake of the businesses it should face the high traffic road. Mr. Sheridan added that he has installed twice the buffer as before in addition to the buffer already on the north adjoining property owners lot. Mr. Clack, a Cannonball Trail resident asked if these offices would be allowed to operated 24 hours a day. Chairman Sticka stated that the Cannonballl Trail residents had previously indicated that they would accept all office and hours are not the issue. Alderman Sowinski stated that the retail businesses could be put along Cannonball Trail. Mr. Sheridan stated that an L shaped building blocks the view from the highway. i Alder woman Burd asked if IDOT required a larger set -back than the City. Mayor Prochaska stated that parking should be visable from the highway and the required set- back is 20 feet on an artierial roadway for parking. Mr. Sheridan stated he could then move the plan up closer by 10 feet to route #34 since the buildings are 200 feet back. Mayor Prochaska stated that the corner building may be to close and may need to be moved back farther. Mr. Henne, Cannonball Trail resident asked if Mr. Sheridan would own and build right away. Mr. Sheridan answered yes. Alder woman Burd asked if the buildings would look like the courthouse, and that the PUD could specify the look of the buildings. Mr. Sheridan stated they would reflect the same type of look as the courthouse. Alder woman Burd stated that the City of Yorkville had in fact lost a couple of businesses to Plano due to owners not being able to find a suitable site at a reasonable rate. I i Mr. Henne stated he expected the transition from single family to office and then to retail would put the office on this site and the retail on the south side of route #34. Alder woman Burd stated that the shape of the lot and the use of office as a buffer is effective since the north end of the property is narrower. Chairman Sticka stated it was never agreed that this would be all office use. i Alder woman Burd stated that the east property line doesn't show a buffer, but Mr. Schoppe, the City's Land Planner and the landscape ordinance would show what is required. i Mr. Sheridan stated they had shown this buffer on the old plan, and not showing it on this plan did not mean they wouldn't put what is required in, it was a time thing in getting the drawing done for this EDC meeting, and they intend to meet the landscape ordinance requirement. Mayor Prochaska stated they would have Mr. Schoppe show the buffer for the COW meeting, per the landscape ordinance, Mr. Sheridan stated he had also eliminated the entrance onto Mr. Henne's property to the east. Mayor Prochaska stated he wanted that easement onto the east property as Mr. Henne may not own that forever. A question was asked about adequate parking. Mr. Nanninga stated that this is usually 1 stall per a certain number of square feet of retail. Mr. Henne asked about detention. Mayor Prochaska stated this would meet City of Yorkville requirements. Alderman Sowinski asked if the other areas would be green. Sheridan stated it would be all planted. A Cannonball Trail resident asked if the driveway to the office building could be moved to the south side of the building presently on the site. Mayor Prochaska stated they could also move the office building to the west if the driveway was moved to the south. Mr. Henne asked if the zoning would prohibit a gas station on the property. Mayor Prochaska stated that this would require a special use, and any zoning change request would require a public hearing. However, anyone can come back and ask for anything they want. Mrs. Price stated that she did not feel this was a good transition. Mr. Sheridan stated that Mrs.Price understands that they have agreed to what will not be put there, and that he has gone to the limit of what will be there. Mrs. Price stated they wanted only office. � I Another resident asked why not put duplexes along the north and then offices in front, as retail comes and goes. Chairman Sticks stated this will be on the COW agenda for 7/6. Mr. Sheridan thanked the Committee. PC 2000 -06 MENARDS ANNEXATION AGREEMENT Mayor Prochaska stated that the sales tax rebater is an issue the Council will have to agree on. Menards can recoup the cost of extending Countryside Parkway to route 34 with 1 /2 of the sales tax being rebated up to 100% of the cost for extending the roadway. The frontage road will help them develop and they can get some rebate, but with a 10 year limit on any business along the frontage road. i i Nanninga stated they will continue the sewer into the area and the detention will be on the Hamman parcel. Hamman has asked for an outlet to the river from this regional detention. This would be a storm sewer outlet and they may work with Marker and go down his drainage outlet, or some may be able to run over ground. Preliminary estimate would be paid back through rebates in 5 -6 years. Mayor Prochaska stated the wording should be clarified this is meant to encourage business. Chairman Sticka asked if they would provide documentation for all. Mr. Nanninga stated yes they would. Alderman Sowinski asked who would maintain the center median along Countryside Parkway if extended. Mr. Nanninga stated the City would, just like they do Countryside Parkway west of route #34. Gary Colby should have the agreement back from Menards attorneys soon. This should be ready for COW for 7/6. The estimate for first year sales is 35 million dollars. Our 1 /2 of tax would be $175,000 per year. Mayor Prochaska stated he does not believe in giving away the farm, and always wants the City to make something. He would never give 100% of the sales taxes in rebates. This is a start for this entire area. We need to consider the type of out lots they have near Menards up on Randall Road. Alder woman Burd stated we can encourage nice fronts, and then we can put flowers in the boulevard.. Mayor Prochaska stated that F.E. Wheaton did get it all back for a while, but he preferred that we always get something more than what we had before. PC 2000 -07 HAMMAN ANNEXATION AGREEMENT Mayor Prochaska stated he had looked at the detention, Mr. Wywrot came up with a minimum, but we need a maximum. Nanninga stated that Wywrot had done an estimate. Mayor Prochaska stated we need to look at Kendall County for limit to buildings, business or residential. If a park is to develop, we need the maximum number of acres required around a detention, and a maximum number of acres for the detention itself. Nanninga stated there may have been a study done with Smith Engineering. Mayor Prochaska stated that if they want a lake, it has to be 12 -14 feet deep, and Kramer suggested a time limit. Chairman Sticka asked if the time limit would end fast enough for detention area to be developed. Alder woman Burd stated this may be what is in the best economical interest when the time is right. Mayor Prochaska stated Hamman needs to be talked to in order to get a feel for these numbers. LAND -CASH ORDINANCE Mayor Prochaska stated that a while ago this was 1/3 at Final Plat, 1/3 at time of permit with first occupancy, or a maximum of 1 year, and 1/3 two years after Final Plat. A transition fee can only be imposed if there is an annexation agreement. Without the agreement the questions is, can we collect the transition fee We don't want to change this now, but we have allowed them to pay at permit time, and this makes it more attractive.
