Chairman Tom Lindblom called the meeting to order at 7:05 p.m.

PUBLIC HEARINGS
Adams made a motion to open the public hearings. Jones seconded the motion. The
motion was unanimously approved in a voice vote.
1. PC 2007 -04 HisGrace Christian Child Development Learning Center, Inc.,
petitioner, request for a Special Use permit for a daycare center in a M -1 Limited
Manufacturing District. The real property consists of approximately one acre located at
210 Beaver St.
See attached.
Lucietto made a motion to close the public hearing. Schillinger seconded the motion. The
motion was unanimously approved by voice vote.
ACTION ITEM
1. PC 2007 -04.
Jones asked if the playground would stay asphalt. Petitioner James Osagie said that part
of it would remain asphalt. The grass meanwhile would be covered with much.
Jones then asked about the Montessori learning practice. Petitioner Victoria Omoike said
children work at centers and then move to the next one once they've mastered the skill or

get bored with it. Conversely, if the children stay at a center too long because they're
having fun, they would be encouraged to move to the next one.
Community Development Director Travis Miller said a daycare center is an allowable
special use in the M -1 zoning classification. He also said the environmental report is
complete and no toxic materials nor contaminants have been found on the property.
Adams said she's concerned about whether adequate parking is provided. At capacity,
she doesn't believe there would be enough parking. Omoike, however, said parents don't
come at the same time to pick up there children. She believes the parking provided would
be sufficient.
Schillinger, said that while he commends the project and agrees more daycare centers are
needed in Yorkville, he also believes parking could be a problem. He doesn't believe the
30 parking places are enough for employees and parents.
Schillinger also has some safety concerns regarding a daycare center located in an
industrial area.
Lindblom asked if the state fire marshal or if the Illinois Department of Children and
Family Services had looked at the building and plans for it. He believes there should be
more exits. Omoike said both parties have looked at the plan.
In order to recommend a special use permit, Lindblom said the Plan Commission must
look at six criteria. The commissioners then reviewed those items.
1. The establishment, maintenance or operation of the special use will not be
unreasonable detrimental to or endanger the public health, safety, morals, comfort
or general welfare. The commissioners said there is no problem with this item.
2. The special use will not be injurious to the use and enjoyment of other property in
the immediate vicinity for the purpose already permitted, nor substantially
diminish and impair property values within the neighborhood. Kraupner said the
commissioner might have to look at this issue to see if the daycare center would
prevent another industrial use from coming to the area.
3. The establishment of the special use will not impede the normal and orderly
development and improvement of surrounding property for used permitted in the
district. The commissioners did not see problem with this item.
4. Adequate utilities, access roads, drainage or other necessary facilities have been
or are being provided. The commissioners reiterated that parking is a concern.
5. Adequate measures have been or will be taken to provide ingress or egress so
designed as to minimize traffic congestion in the public streets. This item was
okay with commissioners. Miller said the city staff didn't ask for a traffic study.
He added the city might want to evaluate whether there is adequate parking for
the facility at full capacity.
6. The special use shall in all other respects conform to the applicable regulations of
the district in which it is located, except as such regulations may in each instance

be modified by the City Council pursuant to the recommendations of the Plan
Commission.
Jones made a motion to recommend approval of the special use permit for PC2007 -04.
Adams seconded the motion. The motion was approved in a 5 -2 vote. Kraupner,
Holdiman, Lucietto, Jones and Lindblom voted yes. Adams and Schillinger voted no.
Kraupner then made a motion to go to public hearing. Adams seconded the motion. The
motion was unanimously approved by voice vote.
2. PC 2007 -03 DTD Investments, LLC, petitioner, has filed an application requesting
annexation and rezoning. The real property consists of approximately 4.22 acres at 6684
Route 47.
See attached.
Lucietto made a motion to close the public hearing. Jones seconded the motion. The
motion was unanimously approved by voice vote.
ACTION ITEM
2. PC 2007 -03.
Lindblom asked if a bank is planned for one of the spaces on the property or if was just
put on the plan as a possibility. Attorney Kelly Kramer, representing the petitioner, said
there are no plans for a bank at this time. The developer doesn't know yet who the end
users would be.
Schillinger said the city's comprehensive plan calls for this are to be zoned M -1, but the
petitioner is asking for B -3. He said he's tired of banks coming in the community and
taking all of the prime locations. He said the city gets nothing out of it.
Kramer said banks typically come before other retail uses as part of the growth pattern in
a community.
Miller meanwhile said the property is contiguous to the city and that annexation and
zoning are the requests up for discussion at the meeting. City staff is comfortable with the
proposed B -3 zoning use of the property. Miller said the corner actually doesn't lend
itself to M -1 use.
Dean Tomich with DTD Investments, the developer of the property, said his company
has been getting similar feedback from other communities regarding the bank issue. On a
positive note, he said the banking industry is pulling back.
Tomich said with his development, he plans to jump start commercial growth on the
south side of the city. He said every foreseeable use is needed on that side of the city now
including day care centers and restaurants. He anticipates retail uses will fill in over the
next 12 to 18 months. A few more rooftops are needed first, he added.

Schillinger suggested the developer postpone the annexation and rezoning request for
another year to 18 months to try to get those retail users. He'd prefer that to a bank.
Tomich said he buys property for development. The property likely would take a year to
get ready and he'd like to start now. While he doesn't have plans for a bank, he can't say
one wouldn't be located on the property.
Lucietto made a motion to recommend annexation for PC 2007 -03. Jones seconded the
motion. The motion was unanimously approved in a roll call vote. Holdiman, Lucietto,
Adams, Schillinger, Jones, Kraupner and Lindblom voted yes.
Lucietto then moved to recommend B -3 zoning as requested for PC 2007 -03 subject to
staff comments. Adams seconded the motion. The motion was unanimously approved by
roll call vote. Lucietto, Adams, Schillinger, Jones, Kraupner, Holdiman and Lindblom
voted yes.
NEW BUSINESS
1. PC 2005 -32 Yorkwood Estates Preliminary Plan
Miller said the concept was approved as part of the annexation agreement. The
preliminary plan is in substantial conformance with the concept PUD. He said the
property is unique and the plan celebrates the wooded area.
While the petitioner is not asking for any variances, Miller said the city staff has
suggested some just to make the plan fit the wooded area better. For instance, he said
sidewalks might be allowed to stray from the street if they were to avoid a stand of trees.
Also some steeper grades might be allowed also with conservation and preservation in
mind. In all, 21 items were submitted for variances. The staff reviewed those and there
are a few concerns, he said. But he's confident they'll be worked out. Miller said this is
something the staff initiated and that because the property is unique it will require more
work and thought from the developer and city staff.
Lindblom said he received a letter from resident Bob Saunders regarding a road
connection. A copy of that letter was included the Plan Commission packets. Miller said
the concern Saunders raised has been addressed and changed.
When asked about his comments, Bill Dunn from Engineering Enterprises, Inc., stated
that he's satisfied with the concept plan. The greatest volume of his report deals with
storm water issues. He added he's pleased with the progress made up to this point, but
there's still some work to do.
Rich Guerard, from Wyndham Deerpoint Homes, said after another meeting with the
park board some of the planned trails in the property changed. He said the new path will
be "spectacular."

Overall, he said they tried to save the oldest and best sections of trees throughout the
property. The southern half of the property features plans for custom homes on'h acre
lots. On the northern portion of the property, plans are for homes on 12,000 square foot
lots. The density for the entire project is about one unit per acre with 48 percent open
space.
Guerard presented a plan and pictures from a Wyndham Deerpoint development in Elgin
that featured some of the same topography.
Schillinger and Jones both said they like the cooperative arrangement between the
developer and the city, which creates for a more open and environmentally friendly plan.

Kraupner mentioned that a man spoke at the public hearing regarding this proposal. The
man had concerns about the proximity of the development to his farm and horses.
Guerard said he's not sure what agreement if any had been worked out with the
gentleman, but he would check into it.
Kraupner also had a few questions on the variances. Miller answered that the variances
were suggested if the trees could be saved. In some instances, even moving sidewalks
likely wouldn't save some trees.
Jones made a motion to recommend preliminary plan approval for PC 2005 -32 subject to
staff comments. Lucietto seconded the motion. The motion was unanimously approved
by roll call vote. Adams, Schillinger, Jones, Kraupner, Holdiman, Lucietto and Lindblom
voted yes.
In other business, Lindblom said that a few members would be absent at the next meeting
and he urged others to be in attendance. He said there's a full agenda in April with some
critical items on it.

18 having been first duly sworn, testified before
19 the Yorkville Plan Commission as follows:
20 MR. OSAGIE: I think I'll try the
21 slide out. We are here today requesting for a
22 special use permit for 210 Beaver Street.
23 I'm sure everybody has the
24 package for 210 Beaver Street. The applicant is

1 HisGrace Christian Child Care Development
2 Learning Center and 210 Beaver Street, LLC.
3 HisGrace Christian Child
4 Development Center is a for profit center,
5 incorporated in September'of 2003 by Victoria
6 Omoike and James Osagie.
7 We have one facility today in
8 Lombard to the north at 1016 North Rohlwing Road
9 at the intersection of North Avenue and Route 53.
10 That center was opened April of 2004, and if we
11 look at your Appendix V -1 and V -2, we will see
12 the picture of the center.
13 The mission of HisGrace
14 Christian Child Development Center is to provide
15 a Christian -based daycare center and Montessori
16 in any developing community, and also their other
17 mission is to promote developmentally appropriate
18 education for all children where all children are
19 learning in a conducive environment.
20 Also we try to enhance
21 development of all the children in our care and
22 also assist their families.
23 We firmly believe that all
24 children can learn if they are given the

1 opportunity and if they are in the right
2 environment.
3 Also we believe that God is the
4 head of our facility and our staffs work for him.
5 We also believe that every child is precious in
6 the eyes of God, so in all our dealing with
7 family and treatment of children, we believe that
8 they are children of God and we should treat them
9 right in the first place. We believe in prayers
10 in our facility.
11 We accept all children
12 irrespective of their age, race, gender or
13 religion, so because we are just -- we are
14 Christian -based doesn't mean that we are not
15 going to accept children that are not Christian.
16 So currently in our facility in
17 Lombard, we have children who are Muslim,
18 children who don't believe in any. We have
19 Christians there.
20 The purpose. What we are
21 requesting for is a special use permit for 210
22 Beaver Street, and, again, it's for a day care
23 center.
24 In our day care center, we

1 accept children from six weeks to 15 months; we
2 also accept toddlers from 16 months to 24 months;
3 and older toddlers from two to three years.
4 We also have preschool and
5 Montessori. Montessori environment is where
6 children actually go to a set of -- go to a set
7 of assignments, they work from there, and then
8 move to another area once they perfect in that
9 area.
10 So it's not just -- Montessori
11 could be different from the regular school. We
12 like also in this facility to provide a
13 kindergarten before and after school, so it means
14 the parents can drop off their kids when they are
15 going to work, we bus children to school, and
16 then pick them up after school, and then the
17 parents get home from work, they can then stop by
18 our facility and pick them up.
19 Also what we would like to do
20 in this facility is also to provide
21 transportation. We feel that there are some
22 parents who are so busy, they don't really have
23 time to take their children to different sporting
24 activities or they want to take to some sporting

1 activity or some field trip, so what we do is
2 provide transportation, take the children to the
3 sporting activities, and then bring them back to
4 our facility, or -- and then parents can them
5 pick them up from the facility.
6 Impact of HisGrace on the
7 community. Sorry some of this is moved over.
8 What we are trying -- what we are trying to do is
9 to provide a full day care facility for the
10 community.
11 We also want to provide a
12 comfortable area of Christian day care for --
13 where a family might be so comfortable to be able
14 to leave their children, because when you look at
15 what we have today now, most parents, actually
16 they are comfortable with what we have, so we
17 have a whole lot of children there.
18 Also, in this facility we
19 provide a structured learning -- a structured
20 learning place for children and also based on
21 Montessori and also regular preschool.
22 Also, we will provide
23 opportunities also for -- to employ people from
24 the community because where we are, we normally

1 employ teachers within the community and also
2 directors within the community.
3 With this what we also provide
4 will be actually be important -- will actually be
5 improving the shortage of day care center within
6 the area of Yorkville. Also we provide
7 transportation, we already discussed.
8 If we are given this special
9 use permit, we do plan to open from 6:30 a.m. to
10 6:30 p.m., Monday to Friday.
11 Our environmental impact of
12 HisGrace. We believe that -- from what you would
13 see later through the pictures -- that with this
14 facility, we know it's in an industrial area, but
15 we believe that it is not going to be detrimental
16 or it's not going to endanger the public health,
17 safety, or moral comfort or general welfare.
18 Children safety is always
19 number one for us, and our door is in an area
20 where the children will not have access to the
21 parking lot.
22 They have a playground. The
23 playground would be fenced out, fenced through,
24 so that they can only go from the building to the

1 playground, so they won't be able to go outside
2 the building and get in the parking lot, so their
3 safety is actually guaranteed.
4 We have a facility, we believe
5 that we have enough ingress and egress so that we
6 will not -- to minimize traffic congestion in the
7 area.
8 We also believe that we have
9 the adequate road and drainage for the
10 facilities.
11 And also we believe that
12 HisGrace will not impair the normal and orderly
13 development or improvement of the surrounding
14 properties for -- of surrounding properties in
15 the area.
16 We also believe that we have
17 adequate parking for both the staff and for
18 parents to drop off their children.
19 We do plan that if we are
20 granted a special use permit to employ up to
21 about 30 teachers when we are at full capacity;
22 however, within that, there is ten or -- 18 or 20
23 teachers to be in the facility at any given time,
24 so with that, we have -- we think we do have

1 enough parking space for the parents to drop off
2 their children.
3 Regulations. The day care
4 facilities are regulated by the City, because the
5 City will grant you the special use permit to
6 build there or to use the facility.
7 Secondly, by the DCFS. The
8 Department of Children and Family Services has to
9 grant you the license to operate there.
10 Third, by the County Health
11 Department. The County Health Department has to
12 make sure the place is clean enough for children
13 to be there.
14 And then the City Fire
15 Department has to make sure the facility is okay
16 or is safe for people to be there, and then the
17 State Fire Marshal has to do a final inspection
18 for the area.
19 Now we are going to go to the
20 next one. We are going to take a look at our
21 current facility in Lombard. This is our current
22 facility in Lombard. This is the inside. If we
23 sort of -- this is like the hallway entrance to
24 the facility, and this is like in the front room,

1 and this is part of the front room. And then we
2 have the imagination center, and then this is
3 just a picture on the wall.
4 So this just gives you an idea
5 of what we do intend if we are granted the
6 special use permit, how we'll actually make this
7 facility to look like.
8 Now we are going to go ahead
9 and take a look at the building we are
10 discussing. If you look at this, the building we
11 are discussing is 210 Beaver, which is here, and
12 all the -- on the east of us we have Premier
13 Plumbing, Heating and Air Conditioning, and on
14 the west of us we have -- on the west we have
15 Accurate Crank Shaft Company, and from we -- from
16 the House Road, which is 126, to where our
17 facility -- where the 210 Beaver is, it's about
18 615 feet. Sort of tried to measure.
19 And then we have the Plastic
20 Molding Company here, and then you have the
21 Martial Arts School here, and then you have
22 Martin's Plumbing, Grace Community Church, and
23 then you have the Beaver school on this side.
24 So in the middle of House --

1 And then on the west of us we have the Kendall
2 County Fire Department with this -- at the
3 intersection of Beaver and Deer Street.
4 On this one we tried to show
5 the pictures of the houses around us. It's a lot
6 of glare, so we will go to the next one.
7 This is -- this building is
8 located in Fox Industrial Park, and this is the
9 building that we are discussing. There is a
10 glare, but I think if you look at your
11 Appendix I, it shows the building.
12 Now, what we have -- this is
13 the entrance to the building, so if you are --
14 this would be the entrance to the building. This
15 would be the entrance to the building and this
16 would be the waiting area.
17 Again, most of the drop -offs
18 would take place within these two parking spaces,
19 unless a person wants to come and the person has
20 to go to the side parking space.
21 This is the side of 210 Beaver,
22 so we -- there is mostly parking -- eventually
23 parking would be around the side of 210 Beaver.

2 This is the back of 210 Beaver.
3 If I were to go towards the end, this is where we
4 plan to actually put the playground.
5 Right now we have a fence on
6 two sides of it and the building is on the other
7 side, so if we are granted a special use permit,
8 what we will do is to put a fence across from the
9 building all the way to the other fence.
10 I think I will show you a
11 picture that actually shows the dimension of the
12 playground.
13 Again, this is just showing the
14 building by us, this is Premier, this is the
15 Crank Shaft, and this is 1204 -A Deer Street, is
16 the building by us, and this is the Plastic
17 Molding, which is located west of 210, and also
18 this is the Martial Arts & Fitness school, which
19 is located at 205 Beaver, and this is Beaver
20 Street in front of -- in front of the building.
21 This is showing the intersection of Beaver and
22 Deer Street and this is the entrance from 126 to
23 Deer Street and Beaver Street.
24 So I want to say that from this

1 entrance toward the building, it's about 615
2 feet.
3 On the street, on Deer Street
4 at 126, you have Martin Plumbing, and across from
5 the street we have the Grace Community Church.
6 By Grace Community Church, you have the middle
7 school on 126. On the west entrance to Beaver we
8 have the Kendall County Fire Department, and this
9 is showing the area we are going to use for the
10 playground.
11 Now, the next thing I would
12 like to show is the layout of the building. The
13 current layout. This is the current layout of
14 the building. I tried to lay it out in about
15 five sections. I think they are in Section 1,
16 they have most of the rooms or most of the
17 offices, so Section 2. Section 3, 4, 5 are
18 basically empty huge rooms.
19 Our plan, if granted the
20 special use permit, is to try and -- not to --
21 try and let out the building, but actually do it
22 in phases, so we are going to take Section 1 and
23 Section 2 and five class -- five classrooms, so
24 we have five classrooms, three are -- three in

1 Section 1 and two in Section 2.
2 So in Phase 2 we will lay out
3 the whole building with more classrooms. If you
4 look at this, it's about two -- two to three
5 classrooms per section, so on the whole, we have
6 13 classrooms if we use the full facility.
7 Now, the entrance would be
8 towards the front of the building. There are
9 doors on the side, but the entrance would be
10 towards the front of the building, so that's what
11 we are showing in Appendix D.
12 Now, the parking is on the west
13 of the building here. We show only 14. But the
14 parking -- you can start parking from the front
15 all the way to the end and also on the right -hand
16 side of the building, and then there is
17 handicapped parking here, we do know that we
18 might need to create a second handicapped
19 parking, which we will try and create on the
20 side.
21 The playground, again, if
22 you -- For the playground -- for the playground,
23 this is going to be at the back. Right now we
24 have a fence on the east and on the south, so

1 what we will do is if we are granted the special
2 use permit is to get a request for a permit to
3 actually put a fence on the west part, so that
4 would enclose the playground so our kids cannot
5 get to the parking lot, and then there will be a
6 door at the back leading to the playground.
7 So if you look, this is how the
8 playground would look like so we actually -- if
9 you look towards the end, there is an overhead
10 electric wire eight feet to the east and also six
11 feet to the south of the playground, and then we
12 are to provide -- DCFS rule, we have to
13 provide --
14 MR. SCHILLINGER: How big is that
15 playground, 14 by 36?
16 MR. OSAGIE: The playground would be
17 38 feet seven inches by 33 feet ten inches.
18 MR. SCHILLINGER: For how many
19 students?
20 MR. OSAGIE: For -- I think
21 capacity -- at full capacity -- what was it?

4 MR. SCHILLINGER: I realize that.

13 allowed to any use in the office district, B -1
14 and B -3 also.
15 At this point in time the
16 developer has developed across the street in the
17 area of Route 71 and 47 a very, very nice brick
18 building that he is starting to get some tenants
19 in at this point in time and seeking to do more
20 of a destination center on the three lots that
21 are before you here tonight.
22 Basically here would be the
23 extension of Fountainview Drive, and then the
24 County Highway Department is directly south of

4 end -users at this point in time identified, but
