Plan Commission Minutes 2007 02-14-07 Page 1 of 2 APPROVED 4/11/07 UNITED CITY OF YORKVILLE PLAN COMMISSION City Council Chamber Wednesday, February 14, 2007 Chairman Tom Lindblom called the meeting to order at 7:03 p.m. in the Council Chambers at Yorkville City Hall. ROLL CALL Members present: Charles Kraupner, Brian Schillinger, Anne Lucietto, Clarence Holdiman, Michael Crouch, Bill Davis and Tom Lindblom. A quorum was established. CITY STAFF AND VISITORS Mayor Art Prochaska; City Administrator John Crois; Community Development Director Travis Miller and City Attorney John Wyeth. Guests who signed the sign -in sheet: Richard Scheffrahn, resident; Lynn Dubajic, YEDC; Wade Joyner, attorney; Gregg Ingemunson, attorney; and Dan Kramer, attorney. MINUTES Minutes from the December 13, 2006 meeting were approved. Kraupner made a motion to approve the minutes. Holdiman seconded the motion. The motion was unanimously approved by voice vote. PUBLIC BEARINGS PC 2006 -97 Castle Bank Trust #8342, petitioner, has filed an application with the United City of Yorkville, requesting annexation and rezoning from Kendall County A -1 County Agricultural to Yorkville B -3 Service Business District and R -4 General Residence District. The real property consists of approximately 13.998 acres located at 2200 Route 47. Lucietto made a motion to go to public hearing. Holdiman seconded the motion. The motion was unanimously approved by voice vote. See attached. Crouch moved to continue the public hearing for PC 2006 -97 to the April 11 Plan Commission meeting. Lucietto seconded the motion. The motion was unanimously approved by roll call vote. Lucietto, Holdiman, Kraupner, Crouch, Schillinger, Davis and Lindblom voted yes. Page 2 of 2 I I Schiller then moved to close the public hearing. Kraupner seconded the motion. The motion was unanimously approved by voice vote. NEW BUSINESS 1. PC 2006 -101 Lot 4 Baker's Subdivision 1.5 mile review Miller a series of staff reports were included in the Plan Commission packet for the commissioners' reference. He said the proposed land use is consistent with what the city's comprehensive plan recommends. He added there are a couple of odd issues. For one, the comprehensive plan recommends an extension of Countryside Parkway south of Route 34, which would affect this proposed project. However, he said the property owners are aware of the city's plans. Secondly, Miller said that city staff recommends easements be dedicated for public utility and drainage for a future storm sewer. Lindblom said it seems as if there are too many concerns expressed by staff at this time to recommend approval. Holdiman agreed with his sentiments. Kraupner made a motion not to recommend approval of PC 2006 -101 due to staff concerns. Lucietto seconded the motion. The motion was unanimously approved by roll call vote. Holdiman, Kraupner, Crouch, Schillinger, Davis, Lucietto and Lindblom voted yes. 2. PC 2007 -02 Yorkville Market Square Final Plat Wade Joyner, attorney for the petitioner, said the final plat conforms to the approved preliminary plat. Miller also said that the final plat conforms to the final PUD plan. Miller said the setbacks are not consistent in the plan. But Joyner said that could be rectified. Schillinger asked if a cross access with Ace Hardware could be created. Joyner said that Tucker Development has property between the other properties. Yorkville Market Square, however, does have a cross access agreement with Tucker Development. OTHER BUSINESS City Administrator John Crois said that plan commissioners will receive a letter from the city inviting them to join in the process of drafting a mission statement for the city. I am an attorney 16 licensed to practice law in the State of Illinois 17 and represent the petitioner, Castle Bank Trust. 18 We filed our application and 19 have noticed the public hearing, served the 20 owners within 500 feet as required by City 21 ordinance, and we talked about the meeting when 22 it was going out with the Community Development 23 Director, Travis Miller. 24 We are sitting down with Depo Court Reporting Service (630) 983 -0030 5 1 Mr. Ratos, as to what would like to see on the 2 property, how he's marketing and so on. 3 So rather than just take it off 4 the agenda and republish, we ask that it be 5 continued to the April, 2007 agenda. That gives 6 us time to work with Staff on it. 7 At this point I can tell Plan 8 Commission Mr. Ratos has no end users for it. 9 He's generally asking that we do a flex -type 10 zoning like we did with the Conover piece 11 immediately to the south where in the Comp Plan 12 we've looked at that potentially being a commuter 13 station.
