Chairman Tom Lindblom called the meeting to order at 7:17 p.m.

MINUTES
Minutes from the August 9, 2006 meeting were approved without changes. Clarence
Holdiman moved to approve the minutes. Charles Kraupner seconded the motion. The
motion was unanimously approved by voice vote.
Minutes from the September 13, 2006 meeting were approved without changes. Kraupner
moved to approve the minutes. Sandra Adams seconded the motion. The motion was
unanimously approved by voice vote.
PUBLIC HEARING
Adams made a motion to got to public hearing. Holdiman seconded the motion. The
motion was unanimously approved by voice vote.
1. PC 2006 -64 Wiseman- Hughes Enterprises, Inc., petitioner, has filed an application
with the City of Yorkville to annex and rezone.
See attached.
Krapner made a motion to close the public hearing. Adams seconded the motion. The
motion was unanimously approved by voice vote.

ACTION ITEM
Community Development Director Travis Miller commented on the Oct. 4 staff report.
He said the city's comprehensive plan calls for a suburban neighborhood in this area with
densities of 1.5 to 2.25 units per acre. This plan proposes a gross density of 2.16 units per
acre so it falls with in the appropriate range.
The comprehensive plan also requires developments with densities above 2.0 units per
acre to comply with the design guidelines outlined in the plan. That would require the
developer to assist with funding of offsite city infrastructure improvements. Miller said
the city has discussed with Wiseman- Hughes and other developers along the Route 47
corridor to help with water and sanitary sever service expansions necessary to serve the
area.
Currently, the city isn't asking for anything specific, and is still working out details with
the developers, Miller said.
The developer also must agree to integrate certain architectural standards as part of the
proposed agreement, Miller said. Although the code requires the developer to incorporate
masonry product on the front fagade of 75 percent of buildings in the community, staff
recommends 100 percent. Also, Miller said that while the code requires 50 percent of the
front fagade to have masonry product, staff is recommending 75 percent, he said.
Likewise, staff recommends that all other building sides have 25 percent masonry on
them and each building must have a minimum of five major architectural features defined
by the appearance code.
Staff also recommends an increase from what is recommend in the code for landscaping
requirements, Miller said.
Meanwhile, the open space provided in the propose plan goes beyond what the city
would require.
Commissioner Jack Jones said he's always in favor of more masonry product and he
asked why the city staff felt it was necessary to increase the requirements for this
development.
Miller said city staff is following the comprehensive plan, which calls for higher
standards where densities are a little higher. He said he believes the city making a
reasonable request.
He also said the city is asking for more parking than what the current city ordinances ask
for. However, the requested amount matches what the proposed city ordinance requires.
Kraupner asked what types of materials qualify as masonry. Miller said brick, premium
siding such as cedar and other stone are included.

Adams made a motion to recommend annexation approval for PC 2006 -64 as requested.
Jones seconded the motion. The motion was unanimously approved by roll call vote.
Kraupner, Holdiman, Adams, Jones and Lindblom voted yes.
Adams then made a motion to recommend rezoning for PC 2006 -64 as requested subject
to staff comments. Kraupner seconded the motion. The motion was unanimously
approved by roll call vote. Holdiman, Adams, Jones, Kraupner and Lindblom voted yes.
Jones made a motion to recommend concept PUD approval for PC 2006 -64. Adams
seconded the motion. The motion was unanimously approved by roll call vote. Adams,
Jones, Kraupner, Holdiman and Lindblom voted yes.
Adams made a motion to recommend preliminary PUD approval for PC 2006 -64 as
presented subject to staff comments. Jones seconded the motion. The motion was
unanimously approved by roll call vote. Jones, Kraupner, Holdiman, Adams and
Lindblom voted yes.
PUBLIC HEARING
Holdiman made a motion to return to public hearing. Adams seconded the motion. The
motion was unanimously approved by voice vote.
2. PC 2006 -65 Yorkville Partners LLC petition to rezone.
See attached.
Lindblom said the attorney for the petitioner requested the public hearing be continued to
the Dec. 13, 2006 meeting.
Adams made a motion to continue the public hearing for PC 2006 -65 to Dec. 13. Jones
seconded the motion. The motion was unanimously approved by voice vote.
NEW BUSINESS
3. PC 2006 -34 Kendall Marketplace Final Plat
Miller said the city wanted a blanket utility easement on the project. The petitioner felt it
would be better if the utility easements were delineated. Miller said city staff isn't
concerned that the delineated easements would substantially change the plat.
Meanwhile, he said the final plat submitted substantially conforms to the preliminary
plan the city already approved.
The staff report does identify some setback issues. The representative for Kendall
Marketplace said it would be impossible to meet the 20 -yard setback requirement for the
way the planned Kohl's Department Store and therefore would need a variance.
Miller said the issue isn't one that's appropriate for the Zoning Board of Appeals. It's
simply an anomaly in the ordinance.

Bill Dunn, the city's consulting engineer from EEI said the majority of concerns he had
have all been addressed.
Jones said originally the Plan Commission was concerned about the density of the
townhome component and suggested wider road widths in that area.
The representative for Kendall Marketplace said the plan was altered to widen the drives
by 15 feet. They're now at 65 feet.
Adams made a motion to recommend final plat approval for PC 2006 -34 as requested
subject to staff comments. Jones seconded the motion. The motion passed by a 4 -1 vote.
Holdiman, Adams, Jones and Lindblom voted yes. Kraupner voted no.
4. PC 2006 -36 Aspen Ridge Estates Final Plat
Rob Gamrath, representing the petitioner, said the final plat is in substantial compliance
with the preliminary plat. There's only one outstanding staff comment. He said the city
wants the developer to remove existing barbwire on the property and the developer is
willing to comply.
Dunn said his engineering comments have been addressed.
Jones made a motion to recommend approval for final plat approval for PC 2006 -36
subject to staff comments. Kraupner seconded the motion. The motion was unanimously
approved by roll call vote. Adams, Jones, Kraupner, Holdiman and Lindblom voted yes.
5. PC 2006 -68, 69 and 70 Bristol Bav Final Plats
Miller said the plats conform to the preliminary plan. There were some setback issues but
those seem to have been met.
Dunn said he has requested the petitioner revise some of the language in the plats and
those revisions are being addressed.
Jones made a motion to recommend final plat approval for PC 2006 -68, 69 and 70 Bristol
Bay subject to staff comments. Adams seconded the motion. The motion was
unanimously approved by roll call vote. Jones, Kraupner, Holdiman, Adams and
Lindblom voted yes.
6. PC 2006 -66 Nelson Mile and a Half Review
Attorney Dan Kramer representing the petitioner said the property is located just west of
the PNA camp. The petitioner, Glen Nelson, is seeking to rezone the property from
Kendall County A -1 to Kendall County R -1. The lots would be at least three acres. The
petitioner also would put in a private black top road.
Kramer said the Plan Commission's charge is to determine if the requested zoning is
appropriate. According to the city's comprehensive plan, the 11 -acre parcel falls under
estate zoning.

Miller said the zoning request is consistent with the comprehensive plan. He said the staff
is requesting a permanent access easement. Also, City Engineer Joe Wywrot has
requested a turn around be put at the end of Glen Nelson Road.
Kraupner said a development like this is refreshing to see.
Adams made a motion to recommend approval of the 1.5 -mile review for PC 2006 -66
Nelson property as requested subject to staff comments. Jones seconded the motion. The
motion was unanimously approved by roll call vote. Kraupner, Holdiman, Adams, Jones
and Lindblom voted yes.
7. PC 2006 -74 X -PAC Easement Vacation
John Curtis said his client purchased lots 2 and 3 in the development and would like to
put a 15,000 square foot retail center on the two parcels. To do so, they would need to
vacate the lot line and the easements associated with the lot line between the two parcels.
He's reviewed the issue with NICOR, ComEd, the cable company, and AT &T and three
of the four have signed off on the vacation.
Miller said the city's staff advised the petitioner to make the request.
Jones made a motion to recommend the easement vacation for PC 2006 -74 as requested.
Adams seconded the motion. The motion was unanimously approved by roll call vote.
Holdiman, Adams, Jones, Kraupner and Lindblom voted yes.
At 8:07 p.m. Jones moved to adjourn the meeting. Adams seconded the motion. The

21 evening. My name is John Philipchuck. I am an
22 attorney with the law firm of Dommermuth,
23 Brestal, Cobine & West, with offices at 123 Water
24 Street, Naperville, Illinois.

1 I am here this evening on
2 behalf of Weisman- Hughes Enterprises, Inc., the
3 petitioner.
4 As the Commission may recall,
5 we were before you last -- I think it was last
6 year, late last year, with a concept plan for the
7 Dhuse property, and I think that as you look
8 through your packet, you will see that the
9 concept plan that we have submitted for our PUD
10 and the preliminary plan and plat that you are
11 looking at this evening are very, very similar.
12 We did receive some good
13 comments from the Plan Commission, and as we went
14 on through the process we received comments from
15 the City Council, and so we are now before you
16 this evening requesting that the property be
17 considered for annexation.
18 It is contiguous to the
19 corporate limits of the United City of Yorkville
20 along the north boundary of the property.
21 As you have indicated,
22 Weisman- Hughes is currently developing a detached
23 subdivision, Windett Ridge, and, in fact, in a
24 component of this particular plan -- there was a

1 slight extension of that particular product from
2 the single- family that finishes that off, if you
3 will.
4 I think the Plan Commission
5 commented about the large open space when we were
6 before you last time, and we liked the elements
7 that were brought into the plan.
8 The annexation of the property
9 would be a logical extension of the corporate
10 boundaries and allow for the extension of
11 sanitary sewer and water along the frontage of
12 the property, and the plan, of course, is to
13 continue ultimately to the south crossing Ament
14 Road to get to the Heartland Crossing subdivision
15 that the Plan Commission has previously made
16 recommendations on.
17 The rezoning is a PUD, and,
18 therefore, there is no actual underlying zoning
19 classification. It is being treated as a PUD,
20 but then I think --

plan on the
left is the concept plan. That

doesn't have
quite the level of detail, of
5
course, that
the preliminary plan does, and so
6
this would
be the preliminary plan. It was part
7
of the PUD
review process as you know.

You are looking at the concept
9
plan, then
taking it to the next level for the
10
preliminary
plan.

So the -- I am here this
12 evening with Carrie Hansen from Weisman - Hughes
13 Enterprises, Inc. and Mike Schoppe from Schoppe
14 Design Associates.
15 Mike will take you through the
16 plan and some of the rationale behind the concept
17 and the preliminary plan, how we have integrated
18 our open space within the development, and Dave
19 Schultz from Smith Engineering is here to answer
20 any civil engineering questions that you may
21 have.
22 So, with that, I would
23 introduce Mike Schoppe.

4 MR. SCHOPPE: For the record, Mike
5 Schoppe with Schoppe Design Associates. Glad to
6 be back.
7 Let me go through some of the
8 highlights of the plan. Just briefly, you may
9 have remembered, it was a year ago when we
10 brought the concept plan forward. There hasn't
11 been a lot of changes, but I will review the plan
12 and maybe some of those changes that we have
13 made.
14 Really, as you can see from the
15 plan, the key component here is the amount of
16 open space that's in the project.
17 There is more than 50 percent
18 of the property that's in open space, and that's
19 a function of the fact that there is a townhome
20 product in the property at what we normally see
21 as a single- family type of density, and when you
22 put those two together, the outcome is a lot of
23 open space, and what that has provided for then
24 is this large 21 -acre school and park site, and

1 this is all additional open space in terms of
2 stormwater management, and land that would be
3 owned by the homeowner's association.
4 That in conjunction with a very
5 large setback off of Route 47, that's about 200
6 feet back -- actually it would be more than that.
7 200 feet back from our property line is where the
8 first building would be built, and there is very
9 few projects that we have in town that have that
10 kind of setback.
11 Like I said, we're going to be
12 a little bit further away from Route 47 than that
13 because between our property and the Route 47
14 right -of -way there is actually some land that's
15 owned by Commonwealth Edison, so the homes are a
16 little bit further back from the actual Route 47
17 right -of -way.
18 But it's spoken to in the
19 Comprehensive Plan about doing things a little
20 bit different here in the south part of town, and
21 that's the reason for the amount of open space
22 and using that open space for a large 200 -foot
23 setback along Route 47.
24 We've had discussions with

1 IDOT. On the earlier plans that we had we were
2 looking at making our road connection to 47
3 here.
4 Gerald and Dave and I had gone
5 down and talked with IDOT; they had asked us to
6 make that entrance down a little bit further
7 south.
8 That works for this plan for
9 the extension further east. It will also provide
10 that connection and a place to connect when the
11 property to the west of this is developed. That
12 road will be picked up and continued west.
13 This is a collector. It's
14 going to head over here west -- or east of
15 Penman, and then from Penman it's planned to
16 continue east over to Ashley.
17 This is a planned collector
18 that the city has had in the transportation plans
19 for some time.
20 So it's now being -- Originally
21 it was a 70 -foot right -of -way. We have now
22 increased that at the Staff's request to an
23 80 -foot right -of -way.
24 Most of this land -- All of the

1 development, most of the development, is pushed
2 up here to the west side of the property. That's
3 a function of road connections, but also a
4 function of the way the property will be served
5 in terms of gravity sewer going to the existing
6 sewer line up here.
7 We are making a new connection
8 to Windett Ridge in here, as well as picking up
9 the extension of existing right -of -way in Windett
10 Ridge, so we have -- as well as an extension of
11 another minor street, a local street, in here, so
12 we have looked at the surrounding uses and
13 provided adequate expansion for the road network.
14 A few of the -- We've gone
15 through Plan Council, we've got a -- we've worked
16 through a number of the Staff comments, we have
17 added additional townhomes -- or visitor parking
18 in the townhomes areas that had been requested,
19 we have made some minor adjustments to some
20 details of the cul -de -sac.
21 As you can see, we don't have
22 any lots with homes fronting on this drive.
23 That's at the request of the staff as to the --
24 respecting the amount of traffic that that would

1 eventually have.
2 We have talked to the school
3 district and the park district -- or park board
4 about the 21 -acre site.
5 Remember in Windett Ridge there
6 is an existing seven -acre park site. That's this
7 piece right up in here.
8 So collectively, when all is
9 said and done, there is going to be a 28 -acre
10 open space area that's going to be used for two
11 things; one is a school, an elementary school
12 site, and the balance of it will be a park site,
13 and all that will be designed -- the Staff will
14 be working on some plans to see how all of those
15 components, whatever park components need to be
16 incorporated, can be organized and fit on the
17 property.
18 Once we have a better idea what
19 those plans are, then the line that's created
20 that says okay, here is the park line and here is
21 the school line can be created, but at this time
22 not knowing what all those improvements are
23 intended to be, striking a line is -- it really
24 can't be done.

1 But what we have to do with
2 both of them is that yes, this is a desirable
3 site for an elementary school. They like the
4 size of the site, the geometry of the site, both
5 the park board and the school district.
6 Now we just have to work out
7 how those features are going to be organized on
8 the property and where that line can be created
9 that splits the two, but that will be confirmed
10 as we go into the final platting process.
11 So with that, that's an
12 overview of some of the highlights as to why
13 we've organized things the way we have, and I
14 guess that would end our presentation.
