Plan Commission Minutes 2006 04-12-06 Page 1 of 4 APPROVED 08/09/06 UNITED CITY OF YORKVILLE PLAN COMMISSION YORKVILLE CITY HALL COUNCIL CHAMBERS WEDNESDAY, APRIL 12, 2006 Chairman Tom Lindblom called the meeting to order at 7 p.m. ROLL CALL Members present: Charles Kraupner, Clarence Holdiman, Anne Lucietto, Sandra Adams, Jack Jones Michael Crouch and Tom Lindblom. Members absent: Bill Davis and Brian Schillinger. A quorum was established. VISITORS Community Development Director Travis Miller; City Planner Mike Schoppe; Interim City Administrator John Crois; Lynn Dubajic, YEDC; consulting engineer John Whitehouse, Engineering Enterprises, Inc. Also, see attached sign -in sheet. PUBLIC HEARINGS Jack Jones made a motion to open the public hearings. Charles Kraupner seconded the motion. The motion was unanimously approved by voice vote. 1. PC 2006 -20 Pulte Home Corporation, MPLIV 10 LLC, MPLIV 20 LLC, and MLH Yorkville, petition requesting an amendment to an Annexation and Planned Unit Development Agreement and rezoning. See attached. 2. PC 2006 -25 New Life Church of Yorkville and the Baumann family, petition to annex and rezone. See attached. 3. Yorkville Planned Unit Development Ordinance Amendment. See attached. Sandra Adams made a motion to close the public hearing. Jones seconded the motion. The motion was unanimously approved by voice vote. NEW BUSINESS LPC 2006 -20 Pulte Home Corporation Chairman Tom Lindblom asked if there had been any discussion on the school site. Matt Cudney, representing Pulte Homes, said there would be a school site somewhere in the plan and the developers will continue to work with the Yorkville School District on determining the most appropriate location for a school. I Page 2 of 4 John Whitehouse from Engineering Enterprises, Inc., the city's consulting engineer, made an amendment to comments he submitted on the project. He'd like to reserve the right to make comment on the final plat because of an issue with the shallow ground water. Lindblom asked Cudney about putting in a direct access from the Del Webb portion of the development to the commercial section. Cudney, however, said traditionally residents in Del Webb communities don't want a direct access. It's a privacy issue, he said. Also, the streets within the development are private streets and residents don't generally want other traffic on them. As for the Del Webb residents, they'll have access to the commercial area using a frontage road. Crouch said he's glad the developer increased the size of the commercial area. However, he doesn't like the increased density in the residential area. Cudney said that while density in the active -adult section of the plan increase, residents of that community create less of an impact on the community's facilities. Typically, those residents make fewer trips on the road and use less water and sewer facilities. Also, he said the number of conventional homes decreased in the proposed revised plan. The revised plan features 81 additional acres for commercial use and 56 acres, for the Del Webb site. The total acreage decreased 84 acres. In total, the number of homes reduced by 36 and the overall density increased by .01. r Lucietto made a motion to recommend approval of the amendment to the PUD subject to staff comments. Jones seconded the motion. The motion was unanimously approved by roll call vote. Kraupner, Holdiman, Lucietto, Adams, Jones, Crouch and Lindblom voted i . yes. 2. PC 2006 -25 New Life Church Miller said the proposed plan submitted to the city is consistent with the city's comprehensive plan except for the easterly commercial area. The comprehensive plan shows that as a suburban area. In deference to the concerns community members raised at the public hearing, Jones asked if the petitioners could get what they wanted with B -2 zoning rather than B -3 zoning. B -2 is a more appropriate zoning for a downtown area because there are no setback requirements, Miller said. Lindblom asked if the petitioners would be willing to accept B -3 zoning along with a list of acceptable users. By doing that, the city could prohibit uses such as a gas station going into that area and it would alleviate some of the fears neighboring residents raised at the public hearing. A list of allowable uses could then be added to the annexation agreement. Vince Rosonova, attorney for the petitioners, said that is something the petitioners could possibly take into consideration. Likewise, he said the church has a vested interested in what commercial uses go on the property. Page 3 of 4 Crouch said he doesn't have any problems with the proposed uses, he has issues with the retention and detention plans. Also, he said the access to Galena Road is a big problem. He concurs with comments made at the public hearing that the access is too close. Crouch made a motion to recommend annexation approval for PC 2006 -25. Jones seconded the motion. The motion was unanimously approved by roll call vote. Holdiman, Lucietto, Adams, Jones, Crouch, Kraupner and Lindblom voted yes. Lucietto made a motion to recommend zoning approval for PC 2006 -25 contingent upon limiting uses under the B -3 classification, limited access off Galena Road and staff comments. Jones seconded the motion. Lucietto, Adams, Jones, Crouch, Kraupner, Holdiman and Lindblom voted yes. 3. PC 2006 -01 Grande Reserve Unit 14 — Preliminary/ Final Plat Patti Bernhard representing Pasquinelli Homes said Unit 14 is in Neighborhood 3. It consists of 11.48 acres and would house 11 buildings (44 units) and a park. Lucietto made a motion to recommend approval of PC 2006 -01 Grande Reserve Unit 14 preliminary and final plat. Jones seconded the motion. The motion was unanimously approved in a roll call vote. Adams, Jones, Crouch, Kraupner, Holdiman, Lucietto, and Lindblom voted yes. 4. PC 2006 -04 Grande Reserve Unit 15 — Preliminary/ Final Plat Bernhard said this property consists of a little more than 19 acres and is found in Neighborhood 5. Plans are to erect 16 buildings featuring 70 housing units and a large park area. Lucietto made a motion to recommend approval of PC 2006 -04 Grande Reserve Unit 14 preliminary and final plat. Jones seconded the motion. The motion was unanimously approved in a roll call vote. Jones, Crouch, Kraupner, Holdiman, Lucietto, Adams and Lindblom voted yes. 5. PC 2006 -14 Cozy Corner Subdivision — Final Plat Miller said City Engineer Joe Wywrot said there are a few unresolved issues that need to be clarified. One issue is a sign. However, Miller said the petitioner has approached the Zoning Board of Appeals about that issue. Crouch made a motion to recommend approval of the final plat for PC 2006 -14 subject to staff comments. Jones seconded the motion. The motion was unanimously approved by roll call vote. Crouch, Kraupner, Holdiman, Lucietto, Adams, Jones and Lindblom voted yes. 6. PC 2005 -53 Hudson Lakes — Preliminary Plan Jim Olguin, representing the petitioner, said the plat has been in the works for a while and reflects staff comments. Page 4 of 4 The site features 10 acres to attach to a school site immediately north of the property. Those additional 10 acres were requested by the school district. Also, he said some of the streets were relocated including one, which should allow for flexibility to access the school site. Crouch made a motion to recommend approval of PC 2005 -53 preliminary plat subject to staff comments. Lucietto seconded the motion. The motion was unanimously approved in a roll call vote. Kraupner, Holdiman, Lucietto, Adams, Jones, Crouch and Lindblom voted yes. 7. Revised Planned Unit Development Ordinance Lucietto made a motion to recommend approval of the Revised Planned Unit Development Ordinance. Jones seconded the motion. The motion was unanimously approved in a roll call vote. Holdiman, Lucietto, Adams, Jones, Crouch, Kraupner and Lindblom voted yes. The 5 first hearing is PC 2006 -20, Pulte Home 6 Corporation, petitioners, have filed an 7 application with the United City of Yorkville, 8 Kendall County, Illinois, requesting an amendment 9 to an Annexation and Planned Unit Development 10 Agreement and requesting a rezoning to increase 11 the areas presently zoned B -3 Service Business 12 District and R -3 General Residence District and 13 to decrease the area presently zoned R -2 14 One - Family Residence District and to modify the 15 existing Planned Unit Development approved for a 16 part of the real property. 17 The real property consists of 18 approximately 587 acres at the northwest corner 19 of Galena Road and Route 47 in the United City Of 20 Yorkville, Kendall County, Illinois. 21 And for the record, speaking 22 for the petitioner, is? 23 WHEREUPON: 24 MATT CUDNEY, Depo Court Reporting Service (630) 983 -0030 5 1 having been first duly sworn, testified before 2 the Yorkville Plan Commission as follows: 3 MR. CUDNEY: My name is Matt Cudney. 4 I work with Pulte Homes and Del Webb. 5 And I did bring some extra 6 copies of both the old plan and new plan. I'm 7 not sure if you have smaller copies; it may be 8 easier to look at. 9 CHAIRMAN LINDBLOM: We have the new 10 plan. 11 MR. CUDNEY: You have the new plan? 12 I will pass it around so you have a copy of the 13 new plan and old plan. If anyone wants a copy of 14 the new plan, it's here. 15 All right. We will get 16 started. I know that you have a very full agenda 17 tonight, so I will try and keep this brief. 18 We spent a lot of time last 19 summer going over this project and appreciate 20 that, all the time that was spent. 21 I think we've had three 22 different Plan Commission meetings on the 23 project, but the Plan Commission did approve the 24 annexation and zoning of the project on the old Depo Court Reporting Service (630) 983 =0030 i 6 1 plan on August 10th of last year and they 2 approved the PUD plan on September 14th and the 3 City Council approved that same plan on September 4 27th. 5 Since that time we have been 6 approached by the city and also by a few 7 different commercial retail developers expressing 8 interest in the property along Route 47 and 9 expressing an interest in developing a much 10 larger strip than the initial 30 acres that was 11 proposed on the previous plan. 12 So let me start off by saying 13 first off that we are going to be talking about 14 everything south of the ComEd lines, so 15 everything north of the ComEd lines -- and we 16 consider this the Garitano north parcel -- 17 nothing is changing for this parcel whatsoever, 18 so this is going to still be the same. 19 It still has -- it has been 20 annexed and it has been zoned, but when this plan 21 does come through, it will have to be brought 22 through with the preliminary plan and then 23 approved by the Plan Commission and then also a 24 final plan. Depo Court Reporting Service (630) 983 -0030 i 7 1 So for tonight we are not going 2 to be discussing the portion north, so I just 3 wanted to clear that up so everyone -- everyone 4 knows that. 5 So what we are talking about is 6 the parcel to the south, and what that is it's an 7 assemblage of two different parcels. It's the 8 Garitano south parcel, which is basically this 9 area here, this section line runs through here, 10 and this is the Brummel parcel. 11 And you will notice that what 12 we have done is changed the layout a little bit. 13 What we have done is in order to accommodate the 14 depth in commercial and increasing the commercial 15 to 111 acres from the 30 acres, we have basically 16 taken the Del Webb section and pushed it over and 17 taken it and pushed it over on the Brummel parcel 18 as well, so in order to do that, what we have 19 done, in order to make the land plan work, that's 20 what we did. 21 We ended up reducing the amount 22 of conventional housing, we have increased the 23 Del Webb housing, and in the handout that I gave 24 you, it kind of gives you some of the breakdowns, Depo Court Reporting Service (630) 983 -0030 8 1 so if you look at it, I think two things I would 2 like to point out with this new land plan is that 3 we eliminated all of the duplex units there, and 4 even multi - family units there we have eliminated, 5 and these are all going to be single- family 6 homes. So all single- family detached homes. 7 And the acreage obviously has 8 increased, but if you look at the number down at 9 the bottom where it says the total -- the total 10 number of homes on the old plan versus the new 11 plan, you will see that there is a net reduction 12 of 36 homes, and that's if you add all the 13 conventional and the traditional as well -- and 14 the Del Webb so that's -- the density is 15 basically the same. Everything else is pretty 16 much the same. Don't want to look through a lot 17 of things we talked about at the last public I 18 hearing in terms of the benefits of a Del Webb 19 community, we have gone through that in terms of 20 the decrease in usage and a lot of the different 21 services provided by the city, but we believe 22 that this plan -- there are a couple of really 23 strong advantages. 24 One is obviously the increase Depo Court Reporting Service (630) 983 -0030 9 1 in the commercial. It will provide a lot more 2 sales tax revenue and generate that not only for 3 the city, but for the other taxing bodies in the 4 area, and also the fewer conventional homes means 5 a reduced student impact to the schools, and what 6 you will also have then is an increased tax 7 revenue based on the Del Webb portion with no 8 impact to the schools. 9 So generally it's really just 10 kind of a reconfiguration of the plan, increasing 11 the commercial, moving the density over, and 12 having the north parcel stay the same, and that's 13 generally it, and I don't think I need to go into 14 anymore, we've got a long meeting, so unless 15 anybody has specific questions, that's really 16 about it. 17 CHAIRMAN LINDBLOM: Okay. I am just 5 wondering, I haven't been in on any of the Del 6 Webb meetings before. 7 Are those units taxed -- 8 property taxed individually or is the Del Webb 9 property taxed as a whole, assessed and taxed as 10 a whole? 11 MR. CUDNEY: The Del Webb property 12 is going to be -- will be taxed just like every I 13 other property, house, in Yorkville. I 14 MR. MELODY: Okay. Gentleman over here, 17 please. 18 WHEREUPON: 19 JERRY MURPHY, 20 having been first duly sworn, testified before 21 the Yorkville Plan Commission as follows: 22 MR. MURPHY: Jerry Murphy. And on 23 the original plan, there were three entrances in 24 and out of the housing on the south portion, one Depo Court Reporting Service (630) 983 -0030 11 1 on the new road that bisects and then two onto 2 Galena, and the new configuration just has two, 3 the one on Galena and then one on the new 4 bisecting road. 5 Is that going to be sufficient 6 as far as handling traffic is concerned? 7 MR. CUDNEY: Yes, it will. The 8 traffic studies that are done for an active adult 9 community are quite different than they are for a 10 traditional community. 11 A couple different reasons. 12 One, most of these people, you don't have the 13 same number of people residing in the home, so 14 there are less frequent trips in and out, and 15 also these people have a tendency to travel in 16 off -peak times, so the traffic studies that we 17 have done show that those two exits will be 18 adequate for the community. 19 MR. MURPHY: Are we anticipating any 20 stoplights or anything on Galena at the one 21 entrance? 22 MR. CUDNEY: At this point I can't 23 say whether or not there will be a stoplight on 24 Galena. We have to -- If the need warrants, but Depo Court Reporting Service (630) 983 -0030 . 12 1 I imagine if the commercial develops on the south 2 parcel there, that that may create enough traffic 3 and traffic generated on the north part. 4 I would imagine that there 5 would be a traffic light at least at this 6 intersection at some point when the commercial 7 does develop because there will be a full 8 interchange into the commercial from Galena here, 9 and there is commercial planned in this 10 development here that's already been approved. 11 MR. Baumann, 23 Sr., bypass trust in care of Teresa Hoffman and 24 George P. ROSANOVA, 15 having been first duly sworn, testified before 16 the Yorkville Plan Commission as follows: 17 MR. ROSANOVA: Good evening. I am 18 Vince Rosanova with the law firm of Dommermuth, 19 Brestal, Cobine & West, and we represent the 20 contract purchaser, which is the petitioner, 21 which is the New Life Church of Yorkville. 22 The owners of the subject 23 property are the Estate of Elizabeth Baumann, as 24 well as Henry A. Baumann, Sr., bypass Trust and Depo Court Reporting Service (630) 983 -0030 14 1 the Old Second Bank trust. 2 The New Life Church is 3 petitioning with the City of Yorkville for 4 annexation as well as zoning of the property, R -1 5 zoning in the northern quadrant, to allow for a 6 church facility, as well as a religious school 7 facility. 8 They are also requesting B -3 9 Service Business District zoning in the southern 10 quadrant of the property to allow for a mix of 11 commercial uses. 12 Tonight the following parties 13 are present, which would be Dave Walker, sitting 14 back here, of New Life Church, we have Phil 15 Stuepfert, who is also with New Life Church on 16 the board, the church board, as well as the 17 planning director at SEC Planning Consultants. 18 Before I begin my presentation 19 tonight, I feel it important to notify the 20 Commission that we are currently under 21 negotiations with a commercial tenant for this 22 southeast portion of the property here. 23 They will be requiring more 24 than the 7.66 acre net property, so we will be Depo Court Reporting Service (630) 983 -0030 15 1 back before the Commission subsequently, perhaps 2 at the time of preliminary plat, to request a 3 rezoning of this property to accommodate that 4 particular tenant. 5 Looking at the plan here, you 6 can see that this property is north of Mill Road, 7 east of Kennedy Road, and southeast of Galena 8 Road. 9 It consists of approximately 10 49.36 acres and currently it's used for 11 agricultural purposes, and there is an existing 12 farmhouse down in this southeast quadrant of the 13 property. 14 The surrounding land uses 15 include B -3, which was part of the MPI Grande 16 Reserve Development in this quadrant right here, 17 which we feel would be in continuity with our 18 proposed B -3 zoning. 19 We have high density 20 residential in the City of Yorkville right here. 21 Where this Cross Lutheran Church is located, that 22 is A -1 Agricultural in Kendall County, and that's 23 occupied by the Cross Lutheran Church. 24 To the north we have Kendall Depo Court Reporting Service (630) 983 -0030 16 1 County R -3 and A -1 zoning, which is currently 2 occupied by single- family detached residential 3 units, and off to the east we have Kendall County 4 A -1 zoning, which also accommodates single - family 5 housing. 6 Currently this property is 7 contiguous to the United City of Yorkville, and 8 we feel that annexation of such property would 9 provide for a logical extension of city 10 utilities, as well as provide for a positive 11 growth opportunity for the city. 12 Looking at our R -1 zoning 13 district up here, proposed zoning district, we 14 would like to put a church facility in there to 15 accommodate the growth of Yorkville, as well as 16 conversations with city staff have indicated they 17 would like to see a religious school facility in 18 there as well. 19 We feel that we can accommodate 20 that, and both of those uses are permitted uses 21 under your R -1 zoning district. 22 Down in this B -3 area we would 23 propose a mix of commercial uses. Right here you 24 can see we have excellent frontage off Kennedy, Depo Court Reporting Service (630) 983 -0030 17 I 1 Galena and Mill Road, and we think that our 2 proposal here fits the land use characteristics 3 of the area. 4 Phil Stuepfert with SEC 5 Planning Consultants will get up here and do a 6 presentation that better defines this plan and he 7 can answer any questions you might have regarding 8 the intricacies of the plan and its design. 9 WHEREUPON: 10 PHIL STUEPFERT, 11 having been first duly sworn, testified before 12 the Yorkville Plan Commission as follows: 13 MR. STUEPFERT: Thank you. Just 14 wanted to point out a few things talking about 15 the land uses and zoning. 16 I think it's important to look 17 at some of the adjacent uses. I think I want to 18 be honest and upfront. 19 If you look at the comp plan, 20 yes, it does show commercial off to the west 21 side, basically in that entire region there, but 22 we are requesting some B -3 zoning over here as 23 well, which is not shown on the comp plan, but we 24 feel that it makes sense. Depo Court Reporting Service (630) 983 -0030 18 1 First of all, as Vince 2 mentioned, B -3 zoning approval right here, 3 eventually -- I know this is not in the city, but 4 most likely I would think that would be converted 5 to commercial use as well, we are not guaranteed 6 of that, but I think it would probably make sense 7 at that corner, and so we have commercial at all 8 those intersections. South of here we have the 9 B -3 selection as well. 10 Over to the east, Vince 11 mentioned about the Cross Lutheran Church. We 12 are actually working with them as well in site 13 planning. I know it's in the county right now, 14 but they are looking at expanding that facility, 15 and I don't want to speak for them out loud, but 16 there is a chance that they would request to 17 annex into the city as well. 18 Of course all this would be a 19 non - residential land use, so it's a good 20 relationship with our B -3 and residential here. 21 The only place where it could 22 be potentially an issue would be down here south 23 of that parcel where it's residential, it's high 24 density attached in the Grande Reserve, so it's Depo Court Reporting Service (630) 983 -0030 19 1 actually transitional when you think about it 2 When you're going from commercial into high 3 density attached, it's not like we are having 4 estate lots backing up to it. So we think that 5 makes a lot of sense. 6 On the north side we have 7 structured it so all the churches are lined up 8 here in our one special use, and we think that's 9 a better relationship to be residential, I know 10 it's not in the city up there, but there are 11 residential homes backing around that property, 12 so we feel that our one special use makes more 13 sense there. 14 When you have R -1 with a county 15 subdivision I'm pretty sure there is not a 16 required buffer, but we are willing to put in a 17 30 -foot landscape buffer along the entire edge 18 anyway. 19 I think that would help give 20 some of those homeowners who would be looking 21 right down into the parking lot, so we would be 22 willing to put a buffer in that area. 23 Plus, I know we are not up for 24 concept plan approval at this time, but we are Depo Court Reporting Service (630) 983 -0030 i 20 1 saying detention up in those areas and back in 2 there could also be a real nice buffer between 3 residential and our uses. 4 The other thing I will point 5 out -- and then I will open it up for I 6 questions -- is we had -- there is an access I 7 point off of Galena in that location because 8 there is a separation from Kennedy. I 9 We want to have those ponds on 10 either side of the entrance for a couple of 11 reasons. One is as you come in, it will be a 12 real nice presentation for the church to have 13 water on both sides. 14 Also we want to leave it all 15 viewable from Galena so the church has a lot of 16 visibility. It's real important for the church 17 to be seen from a major road. 18 We could ask for commercial on 19 that road, but we would rather have a view into 20 the site so you can see the church. 21 Down on the south side we are 22 held to that access point right there because 23 that is where the Grande Reserve entrance is, at 24 that location, so we line up directly across from Depo Court Reporting Service (630) 983 -0030 I 21 1 that. 2 So with those two points, the 3 reason I am pointing this out, we actually placed 4 the zoning line division in that area, we want to 5 have connection between those two access points, 6 didn't want a road to go straight through there. 7 You can see we kind of came 8 into this location from the boulevard and church, 9 and you enter the road down through this area 10 there. 11 And the main thing on this, 12 it's important to note is, this road isn't set in 13 stone, you could adjust either way, but the fact 14 is we want circulation through there, and that's 15 going to be the division between B -3 and our R -1 16 use. 17 Over here, again, like I 18 mentioned earlier, we think that makes a lot of 19 sense, nonresidential use, so the zoning line 20 that you see in your zoning plat between B -3 and 21 R -1 special use, actually follows that road, 22 comes up to this point and crosses at that 23 connection right there. 24 The only other thing that I Depo Court Reporting Service (630) 983 -0030 22 1 would point out -- and we don't know the details 2 of engineering at this point, but we do have 3 Scott May from SEC here in case you have any 4 questions on just overall engineering, it's 5 probably premature to get too much into detail, 6 but we have started to look at the overall 7 engineering aspects of this property. 8 One last thing I will mention 9 is the hours of operation, you may wonder about 10 that, and this church basically in the morning is 11 very busy. There is a curve there. 16 The way it comes -- people come 17 around that curve -- and we have already, even in 18 our rural area, as a rural site there, had cars 19 in people's front yards, in their houses. 20 Now, anything that you do that 21 you are going to be bringing people turning on 22 and off of Galena Road, plus you've got Kennedy, 23 I think you are making a major mistake. 24 MR. We have 15 been in discussions, different members of each 16 congregation have been in discussions, as far as 17 there is no sense of doing -- reinventing the 18 wheel and doing two things on two sites closely 19 located together, so if they were going to do X, 20 we're going to do Y, that type of thing. So we 21 are 100 percent behind this. 22 The coming and going is already 23 taking place. Before us tonight, of course, it is 22 just annexation and zoning; however, we put the 23 concept plan out there just to make reference, so 24 it is a general plan. WHITEHOUSE: I hope I use the 18 right standard pitch tonight. 19 As most of you well remember 20 from a lot of these residents' testimony during 21 the Grande Reserve public hearing four or five 22 years ago that there have always been major 23 drainage areas in Storybook Highlands, mainly 24 because they don't have any stormwater detention Depo Court Reporting Service (630) 983 -0030 42 1 facilities because that subdivision was put in i 2 prior to that requirement. 3 Their streets are very flat, 4 their ditches are very flat, and the water does 5 not move very swiftly throughout their 6 subdivision. 7 I would also caution the 8 engineer, especially because they have not done 9 the design yet, that there are most likely septic 10 systems in the rear yards of those homes that 11 back up to this property, and it is a very 12 granular nature of the soil in this vicinity, and 13 we do not want a retention facility in there 14 that's going to have fluctuating water levels 15 that make the water levels saturated so the 16 septic systems don't function, or which would 17 allow leaching of the septic systems to come into 18 those retention basins, so those are some of the 19 issues. 20 Additionally, as with any other 21 subdivision, any opportunity that the city ever 22 has, it's pretty much standard engineering 23 practice as well as the city's policy, that any 24 opportunity we have in conjunction with new Depo Court Reporting Service (630) 983 -0030 43 1 annexation or new development, if we can help 2 assist adjoining, even unincorporated, 3 neighborhoods in solving drainage issues, we will 4 do what we can to do that. 5 So if there is any particular 6 drainage issue in any one of those areas, we 7 would make sure that these detention facilities, 8 regardless of where they are located, are � 9 designed such that they will not increase any 10 existing problems, and do the best that we can to 11 alleviate them. 12 CHAIRMAN LINDBLOM: Okay. WHITE: Will that go into the 5 stormwater piping that's going in now on the I 6 other side of Mill Road? They've got a 24 -inch I 7 going in there. 8 MR. MAY: Some of that possibly 9 will. 10 MR. WHITE: Now, right now that 11 24 -inch pipe that's going in now for stormwater i 12 retention is feeding all of Grande Reserve going 13 all the way up to Galena Road on the north, so 14 that's servicing a large, large area. Is that 15 going to hold that much water again? 16 Because you've got 49 acres 17 that is 80 percent under parking lot, but with a 18 commercial site, that's all going to be parking 19 also. 20 MR. MAY: What happens is we have to 21 retain our water on our property and release it 22 slowly through the system, so we are not going to 23 flood anybody out downstream. 24 We will retain whatever we need Depo Court Reporting Service (630) 983 -0030 46 1 to retain for however long we need to retain it. 2 MR. WHITE: But is that running into 3 that 24 -inch, so is everybody else running into 4 it, so how do they -- Where are they going to run 5 that water off, the outlets to that? 6 MR. WHITEHOUSE: If I can interject 7 right here, you are correct, that is serving that 8 entire northern section of Grande Reserve. 9 There is a 36 -inch pipe that is 10 going to outlet across Kennedy Road to the 11 drainage swale in the regional park. 12 There is a very limited release 13 rate, of which the Grande Reserve property does 14 not use up all of that capacity of that pipe with 15 their release rate. 16 The triangular area north of 17 new Mill Road will go into that, and then this 18 development will have to prove that their 19 property is naturally tributary in that 20 direction. 21 We will have to evaluate 22 because this site was not included in the Grande 23 Reserve stormwater calculations, okay? 24 If their water naturally drains Depo Court Reporting Service (630) 983 -0030 47 1 to the southwest, after accounting for any 2 additional storage on this site, they may be 3 required to put in a second discharge pipe that 4 takes it westerly into Blackberry Creek. 5 That will all be evaluated when 6 we get into preliminary and final engineering. 7 MR. WHITE: Most of the water from 8 the west end of that site goes under Galena Road 9 and goes down through the ditch in front of my 10 property. 11 Naturally when we have any 12 large rains at this point, it comes off, goes 13 underneath Galena Road, into my ditch and floods 14 the ditch downstream. 15 MR. WHITEHOUSE: Okay. Which house 16 are you, sir? 17 MR. WHITE: I am at the corner of 18 Kennedy and Galena. It's off -site of the 19 picture. 20 MR. WHITEHOUSE: Right over there a 21 little bit? 22 MR. The other 2 standard policy the city has is that if the 3 natural course of drainage -- and we never let 4 discharges go into highway ditches. 5 If the course of that natural 6 drainage is into a highway ditch and that 7 includes somebody's property that is not in an 8 established creek, we do not allow them to 9 discharge in that direction without either 10 getting an easement to put in a pipe so that your 11 property -- any impact to your property is 12 minimized from surface drainage, or they would 13 have to -- since it's all tributary to Blackberry 14 Creek, that section is tributary to Blackberry 15 Creek west of Galena and the southwest corner is 16 tributary probably to Blackberry Creek west to 17 Kennedy, is that their release rate would be 18 restricted to only that section that's tributary 19 to the southwest, but then all of their site 20 would drain that way, they would just be required 21 to put in a larger detention volume, so their 22 release rate would be no more than what is 23 naturally tributary and naturally discharged. 24 But we would make sure, and I Depo Court Reporting Service (630) 983 -0030 I 49 1 would encourage you to come back when we are 2 looking at this from a preliminary standpoint and 3 take a better look at the plans, but we will be I 4 looking at those in that regard to make sure I 5 there is no impacts on other properties. 6 MR. WHITE: Now, on the other 7 retention ponds that are in the park at this 8 point, they put in three retention ponds in the 9 new park for Grande Reserve? 10 MR. WHITEHOUSE: Those -- Yes, those 11 are compensatory storage areas -- 12 MR. WHITE: Correct. 13 MR. WHITEHOUSE: -- because when 14 they built the baseball fields, they filled in 15 some of the floodplain areas, so they had to 16 compensate one and a half times that fill volume 17 by creating some more. _ 18 There is some detention volume I 19 in there for that use that's there, but most of I 20 that's just compensatory storage for the 21 Blackberry Creek link. 22 MR. WHITE: So all the stormwater I 2 coming from Grande Reserve and from that site, if 3 they dump into that, will dump into those three 4 ponds and then release into the creek? 5 MR. WHITEHOUSE: And then release 6 into Blackberry Creek. And the purpose of those 7 are wetland basins that provide some water 8 quality because of that water coming to it, it 9 would flow through these wetland basins before it 10 gets to Blackberry Creek. 11 MR. WHITE: And as I walk those, now 12 that they have built those, I don't feel that 13 those are a significant enough height from what I 14 have seen the creek rise to in the 25 years that 15 I have lived there. I have seen that creek come 16 up eight feet. I 17 MR. WHITEHOUSE: Right. 18 MR. WHITE: And I think that they 19 are going to flood over into those when we do 20 have that ten, 20 -year rain. 21 MR. WHITEHOUSE: Yes. Those 22 particular basins are designed so that when 23 Blackberry Creek gets up to its ten -year flood 24 elevation that it does flow over into those Depo Court Reporting Service (630) 983 -0030 I 51 1 basins. That's the design. 2 The compensatory storage for 3 the floodplain, when it does fill up, they will 4 flow into those basins, from Blackberry Creek 5 into those basins, because it's storage for 6 Blackberry Creek. I 7 MR. WHITE: So what does that do 8 with the inlets going into there for the -- for 9 that large storm sewer that's feeding that whole 10 thing? 11 MR. WHITEHOUSE: The water still 12 comes that way because the elevation of the 13 basins upstream is higher than that elevation 14 downstream, so all the discharge rates for those 15 upper basins are all based on that ten -year flood 16 elevation for Blackberry Creek. 17 And you probably know this 18 because you seem very knowledgeable regarding 19 detention basins, is that Blackberry Creek is a 20 very large watershed that begins way up in Kane 21 County. 22 MR. WHITE: Yes. 23 MR. WHITEHOUSE: And the peak water 24 service elevations for Blackberry Creek happen Depo Court Reporting Service (630) 983 -0030 I 52 1 probably two days after a rainstorm in the upper 2 reaches of that watershed because of how that 3 watershed contributes. 4 MR. WHITE: Comes down. 5 MR. WHITEHOUSE: If it's the same 6 storm that happens over in Kane and Kendall 7 County, these detention basins in this vicinity 8 will have functions where the discharge water 9 will be gone and down Blackberry Creek before 10 Blackberry Creek raises to that flood stage from 11 all of its upper reaches and then spills into 12 those spaces. 13 MR. WHITE: Another question for 14 you, the church, what was the preliminary design 15 on there for occupancy, occupancy level? 16 MR. ROSANOVA: We haven't reached 17 that stage at this point. 18 MR. WHITE: So you have no idea what 19 the church is -- You've got a square footage of 20 how much parking and stuff designed for it, you 21 should have at least an estimate of what that 22 church is going to hold per occupant. At this point 9 the developer is asking for annexation and 10 zoning. 11 Then if that is granted, then 12 they move forward and they come back to this 13 group again with a preliminary plan. SCHOPPE: It's not a public 16 hearing. 17 CHAIRMAN LINDBLOM: It's not a 18 public hearing, but you are welcome to come and 19 hear what is being said at the preliminary plan 20 stage, and then understand that recommendation 21 goes to City Council. Ultimately then they come 22 back with a final plan, and that goes to Council 23 also. 24 MR. WHITE: And then again -- and I Depo Court Reporting Service (630) 983 -0030 54 1 think everybody here is concerned about it -- why 2 is that going to B -3 instead of a B -2 or a B -3 3 with restrictions since it is in the middle of a 4 completely residential area? 5 MR. If you look at the 7 Comprehensive Plan of the City of Yorkville, this 8 is Kennedy Road, this is Galena and the existing 9 Mill Road. 10 They foresee that this be a 11 commercial area, and we think that B -3 is an 12 appropriate zoning district for this area. 13 CHAIRMAN LINDBLOM: Betty? 14 MS. As 15 a resident that waits two, three minutes or more 16 to get out on Galena Road now with Caterpillar 17 traffic. 18 I know Cross Lutheran is happy 19 with their 200 children there, but there is high 20 density housing south of Mill Road, commercial 21 developments there, B -3. The traffic conditions 22 will greatly change in our area. 23 There has been a concern about 24 water flow. It's a good 9 idea. 10 But you are butting up right on 11 Kennedy Road there, to put in commercial 12 buildings there. Like the lady says, she lives 13 right across the street and she doesn't need to 14 be looking at a bunch of cars parked there and 15 whatever, wrappers are flying around, if they 16 have a fast food place or whatever, and that 17 whole section needs to be just shut down, two 18 commercial areas, next to the road. 19 Also the retention ponds, if 20 you put four lanes in there in the future -- 21 that's what we've heard -- that creates a 22 problem. 23 What are you going to do, fill 24 them up, tear them out? WHITEHOUSE: I guess it's 10 probably appropriate now to give the 11 transportation end of my spiel just to fill 12 everybody in in the room as to what's going on 13 because there were some comments regarding the 14 cart before the horse, which is unfortunately 15 always the way it seems to happen. 16 The Grande Reserve annexation 17 agreement provided for the improvements, 18 reconstruction, widening, of all of the 19 preliminary roads to Grande Reserve, including 20 Kennedy, all the way across Bristol Ridge, you 21 know, to -- and in conjunction with another Pulte 22 development all the way to Menard's, Bristol 23 Ridge Road, which has been reconstructed already, 24 and Mill Road, as well as intersection Depo Court Reporting Service (630) 983 -0030 60 1 improvements at Bristol Ridge and 34, which has 2 been accomplished with that light, as well as 3 Kennedy and Galena. 4 With regard to the Grande 5 Reserve perimeter roads, Kennedy Road south of 6 the railroad tracks, from there to Bristol Ridge, 7 will most likely be constructed this year, all at 8 the expense of Grande Reserve. Actually, all of 9 these road improvements are at the expense of 10 Grande Reserve. 11 Mill Road has been scheduled 12 for reconstruction probably in the year 2007, but 13 if this development moves along quicker, then I 14 believe the city would probably -- and I will 15 state for the record that we would want them to 16 contribute via the annexation agreement to the 17 advancing of those Grande Reserve -- or the Mill I 18 Road improvements soon. I 19 The railroad crossing upgrade 20 alone is going to be about $400,000, and the rest 21 of Mill Road is about another mil, two. 22 There will eventually be 23 signals at Galena and Kennedy, and I just want to 24 state for the record that even though there may Depo Court Reporting Service (630) 983 -0030 61 1 be signals there, it's not going to lessen the 2 potential impact of the curve because unless all 3 of you drive like I do, some of you will get a 4 green light if you are eastbound on Kennedy and 5 that curve will be just like it is now, so the 6 stoplight there will really have no impact on the 7 curve. 8 It would be best probably in 9 the long -term if that speed limit was lowered on 10 Galena, but that is under the jurisdiction of the 11 Kendall County Highway Department. 12 There will be a requirement by 13 Kendall County for a 60 -foot half right -of -way on 14 the southeast side of Galena, and prior to this 15 development being approved, prior to that access 16 being approved, so there will not be a need at 17 some future date to fill in any detention basins 18 in order to make a widening improvement to Galena 19 Road. 20 In addition to that 60 -foot 21 half right -of -way, there are statutory 22 requirements from the Illinois statute that 23 regard setbacks of detention basins from pavement 24 such that they are not a danger to the public. Depo Court Reporting Service (630) 983 -0030 62 1 There will be additional 2 right -of -way required on the section of Kennedy 3 Road between Galena and the existing Mill to the 4 tune of about 90 feet from the existing center 5 line to the east, so there is going to be a much 6 larger setback because that section of Kennedy 7 Road between Galena and Mill is going to be S probably a five -lane section, okay, for that last 9 section or at least three lanes at Mill, at new 10 Mill, and then it's going to widen out to provide 11 a left turn, a right turn, possibly a dual left 12 turn on Galena for future improvements when 13 Galena is widened. 14 So as far as the city's 15 foresight with regard to transportation 16 improvements in this area, not that I am 17 advocating commercial, I'm just saying that from 18 a transportation standpoint, it has been well 19 thought out. 20 CHAIRMAN LINDBLOM: Yes, sir. 21 MR. WHITE: Bill White. Do you know 22 if there is -- still in the long -term plan are 23 considering taking Kennedy Road clear to 30? 24 MR. There had been a plan of extending 2 Gordon Road from the Village of Montgomery down 3 across Blackberry Creek and connecting with i 4 Kennedy, but because that would require another 5 bridge over Blackberry Creek and both communities I I 6 are sensitive to the Blackberry Creek's watershed 7 committee, you know, requirements or 8 recommendations regarding minimizing crossings, 9 Gordon Road is going to swing west and connect 10 with Cannonball at Galena. It will not be i 11 connecting here to Kennedy. 12 MR. WHITE: So Gordon Road will turn 13 in and come in by Dixon? 14 MR. WHITEHOUSE: Gordon Road will 15 swing down with a southwesterly swing and come 16 down and hit Galena at Cannonball. 17 Dixon will be cut off short and 18 will come in and T into Gordon before it gets to 19 Galena. And that plan is being advanced. 20 MR. WHITE: Okay. I understand. I 21 understand. 22 CHAIRMAN LINDBLOM: Yes, sir. 23 MR. One last 10 time, any further questions that we have not 11 talked about? 12 (No Response) 13 CHAIRMAN LINDBLOM: Hearing none 14 then, I will move on to public hearing number 15 three, United City of Yorkville will hold and 16 conduct a public hearing before the Plan 17 Commission on April 12, 2006, at 7:00 p.m. in the 18 City Council Chambers, 800 Game Farm Road, 19 Yorkville, Illinois, for purposes of amending its 20 Planned Unit Development ordinance. 21 Travis? 22 WHEREUPON: 23 TRAVIS MILLER, 24 having been first duly sworn, testified before Depo Court Reporting Service (630) 983 -0030 68 1 the Yorkville Plan Commission as follows: 2 MR. MILLER: Sir, in your packet you 3 received a memo from myself dated April 5th that 4 summarizes the staff recommendations. I am going 5 to be going through that summary. 6 Basically staff recommendation 7 before you tonight is to modify the PUD 8 ordinance, which is a portion of the zoning 9 ordinance. 10 The purpose of this 11 recommendation stems from multiple issues, one of 12 those being timing and expense for the petitioner 13 in the case of a PUD application. 14 I understand currently under 15 the PUD ordinance a concept plan is presented, 16 input is given on that, and then subsequent to 17 that a preliminary plan is submitted and 18 approved. 19 It isn't until the preliminary 20 plan is approved that the petitioner has any 21 entitlement in terms of zoning and the actual 22 land use that's being permitted. 23 That preliminary plan requires 24 preliminary engineering, photometrics, and a Depo Court Reporting Service (630) 983 -0030 I 69 1 pretty high level of detail, which takes time and 2 expense on behalf of the petitioner before 3 getting any approval at all to move forward with 4 the project. 5 Smaller projects may not be an 6 issue, but with the larger projects that we are 7 seeing coming in that becomes more and more of an 8 issue with the petitioners. That's one purpose. 9 The second purpose as I see it 10 from a planning standpoint as I review the 11 current ordinance, this is in my opinion a tool 12 mechanism that would be useful for a petitioner 13 that has a laundry list of variances and things 14 that they are requesting. 15 Rather than coming through with 16 straight zoning and requesting those variances, 17 the PUD can roll that into one as a PUD, granting 18 those variances all at the same time. 19 That's fine, I think the city 20 needs to get something in return for that, and I 21 believe that a true PUD should have, and state 22 guidelines for architectural details should 23 have, should provide attributes in excess of 24 conventional zoning. Depo Court Reporting Service (630) 983 -0030 I I 70 1 So if a petitioner comes in and 2 requests a PUD, it should be above and beyond 3 what a standard straight zoning request would 4 provide. 5 There should be architectural 6 detail, there should be something unique about 7 the project to justify it to be a PUD. 8 Thirdly, from an administration 9 standpoint and just recordkeeping, currently the 10 PUD is treated as a special use to a straight 11 zoning classification, so the zoning map, there 12 is no way to distinguish what has been approved 13 as part of a PUD and what hasn't been without 14 going case -by -case into the files to determine 15 that. 16 As you know, PUD's can vary i 17 from case to case. By establishing a PUD as a 18 separate zoned classification, the Zoning Act 19 would then read each of these as PUD, that would 20 be a zoning classification, that would be I I 21 codified, and you would know exactly at a glance 22 what's a PUD and what has different governances I 23 and different entitlements than what straight 24 zoning does.
