PC 2005 -62 — 47 Corneils LLC and 1"' United Bank as Trustee Under Trust Agreement petition to annex and rezone. Crouch asked if there was a potential use. Janine Boggs said that there was not at this time. They will rezone to meet the comprehensive plan and see how things develop in the area. John Whitehouse said with the Rt. 47 improvements there may be additional Right of Way requirements that they must be aware of. Lucietto moved to recommend annexation to the City Council. Crouch seconded the motion. All moved to pass with a roll call vote. The motion passed with a 6 -0 vote. Crouch, Davis, Holdiman, Lindblom, Lucietto, and Schillinger all voted yes. Crouch, Davis, Holdiman, Lindblom, Lucietto, and Schillinger all voted yes. 5. PC 2006 -03 — CCTF 500, LLC and Frank J. Calabrese, Jr., Successor Executor for the estate of Lucille Calabrese, petition to annex and rezone. This is a 12 acre parcel zoning B2 to the City of Yorkville. The comprehensive plan shows residential in this area. There is a residential plan to the North. Dan Kramer said there will be no industrial uses. This will be geared for offices. There will be heavy landscaping along 126. The buildings are along the rear of the property, and the asphalt will be broken up. Crouch asked if they were opposed to office zoning. Dan Kramer said they would like to add some B1 /B2 uses that would allow for things such as a Montessori school or a small sit -down restaurant. An annexation agreement could be worked out with the city with a permitted and prohibited list. There would be another Public Hearing for the annexation agreement. Crouch said the other issues that were raised were the traffic. Crouch asked if there was sufficient buffering, how would that affect the plan for the property? Dan Kramer said it would not affect the plan at all. There will be an extra wide buffer to include a Right of Way that would accommodate the eventual widening of Rt. 126. Crouch said another issue was the height of the buildings. Dan Kramer said they would be looking at a 1 or 2 story limit that would be no taller than a 2 story house. Dan Kramer said they will try to preserve the tree line to the North that would create a large buffer for the development to the North. There would be destination users on this property that would not generate a lot of trip traffic. Lindblom asked the public if they had any comments after what they had just heard. There was a concern about parking lot lights. That is addressed by City Ordinance that limits the amount of light that goes beyond the lot line. The citizen asked if the lighting could be aimed at the parking lot so the glare would not go to the South. There was a question about sidewalks and bike paths. There will be sidewalks or a Bike path along the North side of Rt. 126. Joanne Buchner says she feels the traffic issues are not being addressed. She says there is a lot of traffic backed up at the beginning and the end of school and she is concerned that the start times and end times of businesses on this property would be at the same times as the school starts and ends. She was also concerned that there is no crossing guard at the nearby intersection. Pap-e 4 of 5 Dan Kramer said before building can begin they have to submit a traffic study to the City and submit an application to the State to get a cut onto Rt. 126 for the main access and for the right in and right out. Then they will be told what improvements will need to be made. IDOT will be looking at 126 as a whole and what improvements will need to be made and the developer will have to pay their fair share of the improvements. Dan Kramer said professional offices generally open a little bit later than school hours and also close a little bit later. This will be a phased in development over a number of years. John Whitehouse said that the Kendallwood development had a panhandle access to 126 and had an alternate that would connect to the road opposite Wooden Bridge Dr. This is a through road to Van Emmon that was a requirement the Plan Commission and the City had for the Kendallwood development. This is the best location for this access point because it is opposite Wooden Bridge and the 3 ra lane for a turn lane would be continuous from the school to this development. If the traffic study warrants signalization in the future, that will be discussed with the developers for this parcel as well as with the Kendallwood development. Crouch moved to recommend annexation to the City council. Lucietto seconded the motion. All moved to pass with a roll call vote. The motion passed with Davis abstaining. Crouch, Holdiman, Lindblom, Lucietto, and Schillinger all voted yes. Lucietto moved to recommend zoning subject to specific design standard and uses as part of the annexation agreement. Crouch seconded the motion. This will come back to a Public Hearing at some time in the future. All moved to pass with a roll call vote. The motion passed with Davis abstaining. Crouch, Holdiman, Lindblom, Lucietto, and Schillinger all voted yes. 6. PC 2006 -05 Bristol Ridge — Concept Plan — Kevin Carrera and Rich Olson were here on behalf of the petitioner for this concept plan. This is a 190 acre proposed development that would be zoned in a combination of R2 and R3. It is located South of Galena road and is divided almost in half by Cannonball Trail. There will be 245 single family lots with a minimum lot size of 12,000 square feet, a maximum lot size of 28,863 square feet, and an average lot size of 14,168 square feet. There will be 102 units of 2 — 3 unit townhomes and 73 units of 4 — 6 unit townhomes. There is an 11.8 acre school site located off the comprehensive plan and a 5.5 acre park site. The gross density is 2.2 units per acre. There is a portion of this property that is currently under an annexation agreement, but it was pulled off of the agenda for the Committee of the Whole to allow the development to go through as a whole. There is a through East — West road and there is a stub that lines up with the road the existing school is on. There will be trails throughout the development and 3 detention areas. There will be no zoning variations requested. Lindblom is not comfortable with traffic going onto Charity Lane. Lindblom suggested this could be more of a walkway to the school instead of a road. If lot 123 was eliminated an access can be made to Comeils Rd. John Whitehouse said it could be a temporary access until the East -West road connects to other subdivisions. It may also be a right in right out. i Pap-e 5 of 5 The school site is located next to Railroad tracks and power lines. The developer has not yet discussed this location with the school. Crouch was concerned that the school board would not like this location for a school site. There was a suggestion that the 4 — 6 unit townhomes could be removed and the school site would be located in this area. Lucietto was concerned with the road stub into an existing home. The developer is planning for future development and that this property could connect to this stubbed road in the future. The Commission was asked if they were comfortable with the land uses. Davis said he feels the City is overdeveloping on Townhomes. The annexation agreement allows 40 duplexes on the West side of the development. The developer was trying to balance the development to match the Bristol Bay development. The townhomes to the south are backing up to B3. Lindblom suggested they get a different name because of Bristol Ridge Road, and this development does not touch Bristol Ridge Road. 7. PC 2006 -07 Caledonia Unit 1— Final Plat — The Final Plat for all of Caledonia was previously approved, but the property has been sold and the new developer wishes to develop it in phases. Crouch moved to recommend approval to City Council on the Final Plat. Lucietto seconded the motion. All moved to pass with a roll call vote. The motion passed with a 6 -0 vote. Crouch, Davis, Holdiman, Lindblom, Lucietto, and Schillinger all voted yes. ADDITIONAL BUSINESS Crouch wanted to commend the chairman for moving the meeting along. There will be 2 meetings each month for the next 2 months. Lucietto moved to adjourn the meeting. Crouch seconded the motion. The motion was unanimously approved by voice vote. The meeting adjourned at 8:55 pm. Minutes submitted by Laura Leppert. KRAMER, 9 having been first duly sworn, testified before 10 the Yorkville Plan Commission as follows: 11 MR. KRAMER: Thank you, 12 Mr. Lindblom. Dan Kramer here on behalf of the 13 joint petitioners this evening. 14 On my easel to my left we have 15 a concept plan. Frank Sakelaris is here behind 16 me tonight representing both the property owners 17 and is principal of the actual developer of the 18 project. 19 I told Mr. Crouch before the 20 meeting, given the current school situation, it's 21 nice being here with a commercial development 22 hopefully to help the city's tax base and the 23 school's tax base. 24 As Mr. Lindblom has indicated, Depo Court Reporting Service (630) 983 -0030 12 1 it's a little bit over a 12 -acre parcel that's 2 located on the north side of 126, and 3 Mr. Sakelaris has designed it with this platting 4 so the major entrance of the property would be 5 directly across from Crooked Tree Subdivision -- 6 or Crooked Creek Subdivision, which is, in fact, 7 a Kendall County subdivision that's not annexed 8 completely into the city. Some homes at the very 9 back with Wildwood when you drive through that 10 are part of the city. 11 They are looking to do a very 12 high -end office -type project with buildings that 13 would be masonry in character. We showed that to 14 the Plan Commission, and when we did the concept 15 plan with the City Council and Committee of the 16 Whole, some Frank Lloyd Wright designs, all brick 17 and masonary product. 18 They are looking for 19 professional offices, not big users, but a very 20 high -end. 21 And as you can see with the 22 detention pond in the back, the property has a 23 lot of roll to it, a very naturalized feature, 24 with naturalized conservation -based detention Depo Court Reporting Service (630) 983 -0030 13 1 ponds. 2 They would use the creek on the 3 site for building look -outs over the creek, and 4 try and make it an amenity to attract those 5 upscale office users and the smaller users we are 6 going to need as the town develops here. 7 A feature that Frank and his 8 planning team have been particularly careful in 9 preserving the creek corridor is to have heavy 10 buffering on the landscaping along Route 126. 11 We realize it is a residential 12 user to the south, you're going to have other i 13 residential users to the back and the north in i 14 the large area, but as you can see, there is a 15 heavy growth of trees along our rear property 16 line as well, so you are using the natural 17 features of the land. 18 Again, what they don't want to 19 have is a sea of asphalt, and you can see with 20 the landscaping, they staggered the parking lots, i 21 they split up the building locations, and we 22 think a very, very creative design. 23 So we are asking you as Plan 24 Commission to make a positive recommendation to Depo Court Reporting Service (630) 983 -0030 14 1 the City Council to annex the property. 2 We are also asking for a 3 positive recommendation as to the zoning, and 4 obviously this is the first time that you as a 5 Plan Commission are seeing the concept plan, so 6 we are interested in any comments you have on 7 that certainly. 8 Obviously we've got a lot of 9 work to do with staff and with Travis Miller and 10 your planner just coming on the Board, and I have 11 had some contact from residents in the area that 12 in particular have asked us are we going to do 13 buffering, are we going to make sure we've got 14 good photometrics so we don't have bleed off with 15 commercial lights, and I can assure you it's, 16 again, office in nature and not retail. 17 So we'll be happy to answer any 18 questions we can and, again, if there is anything 19 directed to Frank as petitioner, he is here as 20 well, although I've got to warn you, he did come 21 in after you swore the witnesses, so you will 22 have to swear him in, please. 23 CHAIRMAN LINDBLOM: Dan, for the 24 record, just before we get into that, just for Depo Court Reporting Service (630) 983 -0030 15 1 the record, I have two letters from apparently I 2 guess neighbors. 3 MR. KRAMER: I got the copy of one 4 Mr. and Mrs. Engelhardt that -- 5 CHAIRMAN LINDBLOM: Victoria and 6 Jeffrey Moorehouse; is that correct? For the 7 record, I would like to read this for everybody's 8 information. I am going to paraphrase part of 9 this. 10 The first one is addressed to 11 the City Clerk. We, Mike and Pat Engelhardt, are 12 in receipt of public notice regarding this 13 meeting. We will be out of town at the time of 14 the first hearing, February 8th. We would like 15 it noted that we are opposed to the rezoning from 16 Kendall County A -1 Agricultural to the United 17 City of Yorkville B -2 General Business District. 18 The legal address for the 19 Engelhardts is as follows: It's 15 Crooked Creek 20 Drive, Yorkville, Illinois. 21 The second one that we just 22 have copies here that I got here tonight is from 23 Victoria and Jeffrey Moorehouse. 24 It's regarding the annexation Depo Court Reporting Service (630) 983 -0030 16 1 and rezoning of the property along Route 126. 2 Official notice and legal description attached. 3 We regret that we will be 4 unable to attend the public hearing on 5 February 8th. We wish to submit this letter to 6 the Plan Commission for the record. 7 We strongly object to the 8 rezoning of this property as referenced above 9 from Agricultural to B -2 Business -- General 10 Business District. 11 This rezoning greatly alters 12 the benefits of living in a rural setting and the 13 ability to enjoy the reasons that we purchased 14 property and build out here. 15 We have businesses that might 16 be anything from a medical clinic, college, 17 hospital or billiard parlor /bowling alley. It 18 does not seem to benefit the atmosphere of this 19 area. 20 The idea that structures up to 21 35 feet could be built along Route 126 certainly 22 cuts down on the scenic views of rural country 23 living. 24 Also, the traffic along Depo Court Reporting Service (630) 983 -0030 17 1 Route 126 has greatly increased in the past few 2 years. The construction of a business district 3 along here will greatly impact the noise that we 4 currently experience. 5 The current traffic using this 6 area of Route 126 rarely adheres to the posted 7 speed limit, jeopardizing the safety -- the safe 8 entry onto Route 126. 9 The increased traffic produced 10 by this type of rezoning will greatly impact the 11 safety of the area. 12 We hope that the Yorkville Plan 13 Commission rejects this rezoning proposal. 14 The address for the Moorehouses 15 is 14 Wooden Bridge Drive, Yorkville. And I 16 trust that's Crooked Creek. 17 Okay. We have that into the 18 record. And at this time then I would like to 19 ask the audience if they have questions or 20 concerns for Mr. Kramer. 21 Yes. Would you please come 22 forward and state your name, please? 23 WHEREUPON: 24 JOANNE BROOKNER, Depo Court Reporting Service (630) 983 --0030 18 1 having been first duly sworn, testified before 2 the Yorkville Plan Commission as follows: 3 MS. BROOKNER: My name is JoAnne 4 Brookner. I am a resident of Yorkville, and I 5 live in Crooked Creek. 6 I have a real estate license 7 and I also have a business as an interior 8 designer. 9 I am just so opposed to 10 annexing this property. One of the main reasons 11 is my concern with the two schools that are on 12 this property, there are Circle Center and the 13 new school, and the traffic is very, very 14 difficult at different times of the morning and 15 afternoon, and these are small children in both 16 schools, and I am terribly concerned about trying 17 to get out on 126, and by adding more traffic 18 from industrial businesses, where they will be 19 large and filled with people, would cause very 20 much of a hazard for these small children. 21 I'm also having property in 22 Crooked Creek, and because of the property, I am 23 afraid of the values that will go down in our 24 area by having a commercial establishment so Depo Court Reporting Service (630) 983 -0030 19 1 close to us. That's all I have to say. 2 CHAIRMAN LINDBLOM: JoAnne, just for 3 my clarification, your objection is to the 4 annexation and to the business zoning? 5 MS. BROOKNER: Yes. 6 CHAIRMAN LINDBLOM: That's correct? 7 MS. BROOKNER: Yes. 8 CHAIRMAN LINDBLOM: Okay. Thank 9 you. Other comments? Questions? 10 WHEREUPON: 11 BILL MORTL, 12 having been first duly sworn, testified before 13 the Yorkville Plan Commission as follows: 14 MR. MORTL: Sir, my name is Bill 15 Mortl, 19 Wooden Bridge, and I oppose the 16 annexation also, along with having the said 17 buildings, because of the traffic that it would 18 cause, and taking away our natural settings that 19 we've had for many, many years. 20 I would hope that everyone 21 would decline or not allow this to go through. 22 Thank you. 23 CHAIRMAN LINDBLOM: Okay. Thank 24 you. Any other comments, questions? Depo Court Reporting Service (630) 983 -0030 20 1 (No Response) 2 CHAIRMAN LINDBLOM: Okay. Hearing 3 none, then I would entertain a motion to close 4 the public hearing. 5 MR. KRAUPNER:. So moved. 6 MR. HOLIDMAN: So moved. 7 MR. CROUCH: Second. 8 CHAIRMAN LINDBLOM: That was in 9 stereo. 10 MR. CROUCH: I defer. 11 CHAIRMAN LINDBLOM: Seconded by 12 Crouch. Further discussion on the motion? 13 (No Response) 14 CHAIRMAN LINDBLOM: Hearing none, 15 those in favor signify by saying aye. 16 (A Chorus of Ayes) 17 CHAIRMAN LINDBLOM: Opposed? 18 (No Response) 19 CHAIRMAN LINDBLOM: Motion passes. 20 (Which were all the 21 proceedings had in 22 the public hearing 23 portion of the 24 meeting.)
