Brian Schillinger arrived at 7:30 p.m. Member absent: Clarence Holdiman. A quorum was established. Anne Lucietto made a motion to open the public hearings. Sandra Adams seconded the motion. The motion was unanimously approved by voice vote. Chairman Lindblom swore in those who intended to speak at the hearing. PUBLIC HEARINGS 1. PC 2005 -19 Woodlands, Inc. and Meadowbrook Homes, Inc., petitioners, have filed an application with the city to annex and rezone. See attached. 2. PC 2005 -52 Herb and Pam Kleinwachter and the Old Second National Bank Trust 8051, petitioners, have filed an application with the city to annex and rezone. The petitioners also are seeking a special use permit. See attached. 3. PC 2006 -22 Richard Marker Associates, Inc., petitioners, have filed an application with the city to annex and rezone. See attached. Lucietto made a motion to close the public hearings. Jack Jones seconded the motion. The motion was unanimously approved by voice vote. Page 2 of 4 NEW BUSINESS 1. PC 2005 -19 Woodlands Inc. and Meadowbrook Homes, Inc., petitioners, request to annex and rezone. The proposed plan shows two black lines indicating major collector roads the city would like to extend. One goes from Route 71 north and the other is an extension of Greenbriar. Lindblom asked what happens to the part of the black line that doesn't quite reach Route 71. Attorney Dan Kramer, representing the petitioner, said that since the petitioner doesn't own that property, that area would be up to the city. At this point, there are access routes to the property from the south. Kramer said that the developer would put in a temporary egress to Route 71, so that there wouldn't be just one entrance to the subdivision until other accesses are available. Community Development Director Travis Miller said the black line north and south represents Beecher Road and the east/west line is Greenbriar. Those road extensions were recommendations of the city and are based on the comprehensive plan. Brian Schillinger said he'd like to see another stub going to the south. Kramer said the developer would consider it. The land use in the proposed development is OK according to the comprehensive plan, Miller said. And, because the density of 2.16 gross units per acre exceeds what is allowable, the developer will have to follow the specified design guidelines. The commission then took a vote on the annexation and zoning requests. Lucietto made a motion to recommend annexation of PC 2005 -19. Jones seconded the motion. The motion was unanimously approved by roll call vote. Charles Kraupner, Lucietto, Bill Davis, Adams, Schillinger, Jones, Michael Crouch and Lindblom voted yes. Lucietto then made a motion to recommend zoning of PC 2005 -19 as requested. Jones seconded the motion. The motion was unanimously approved in a roll call vote. Lucietto, Davis, Adams, Schillinger, Jones, Crouch, Kraupner and Lindblom voted yes. Discussing the concept plan presented, Lindblom said he has concerns about the long dead -end corridor. Making a more general comment on the plan, Lindblom said the cul- de -sacs through the plan are too long. Aladdin Ossir said the plan originally had shorter cul -de -sacs, but the city staff didn't want to see so many egresses and ingresses onto the proposed collector street. Schillinger suggested a bridge be built across the creek rather than having the subdivision divided by the waterway. Kramer said he's not sure it could be done financially. Also there are likely conservation constraints that would prohibit it. i I Page 3 of 4 2. PC 2005 -52 Herb and Pam HIeinwachter and Old Second National Bank Trust 8051, petition to annex and rezone and a request for a special use permit. Kramer, representing the petitioners, said the annexation and zoning were previously approved. The only matter up for consideration should be the special use permit, he said. Day care centers need special use approval in the city, Kramer added. Miller said that in the city's ordinances there are six findings that need to be considered before approval. Those six findings are: 1. That the use is not unreasonable. 2. That it not be detrimental to surrounding properties. 3. That the establishment not impeded improvements of surrounding properties. 4. That necessary infrastructure improvements be made. 5. That adequate measures for ingress and egress are taken. 6. That the special use conforms to applicable regulations. Looking at the findings one at a time, the commissioners found no concerns with any of them. Schillinger made a motion to recommend approval of a special use permit for PC 2005- 52 as requested. Lucietto seconded the motion. The motion was unanimously approved by roll call vote. Davis, Adams, Schillinger, Jones, Crouch, Kraupner, Lucietto and Lindblom voted yes. 3. PC 2006 -22 Richard Marker Associates, Inc., petitioners, application to annex and rezone. Lindblom said the commission and city council met several months ago to discuss the southern portion to the city and the extended region. It was decided not to have commercial areas lined up and down Route 47. However, because the preliminary plan wasn't included with the information provided, Lindblom suggested tabling the request until the plan is provided. Attorney John Philipchuck, representing the petitioners, agreed to table. He said the commission needs the plan to make an informed decision. Lucietto made a motion to table PC 2006 -22. Jones seconded the motion. The motion was unanimously approved by voice vote. 4. PC 2005 -33 Chally Farms — Preliminary Plan Rich Guerard said some changes have been made since the concept plan was presented. One road was realigned to align with the subdivision to the north. The detention area was moved to a natural greenway and a trail system will now run though that area. There also are a few less lots and more open space in the plan. Page 4 of 4 Miller said staff and EEI have few technical items that need to be finished, but approval of the plan is recommended subject to staff comments. Crouch asked if the archeological issues that arose with the plan was first presented have been resolved. Guerard said the site is still being reviewed and if anything is found, an archeological dig will be conducted before any building could begin. Lucietto made a motion to recommend approval of the preliminary plan for PC 2005 -33 subject to staff comments. Jones seconded the motion. The motion was unanimously approved by roll call vote. Adams, Schillinger, Jones, Crouch, Kraupner, Lucietto, Davis and Lindblom voted yes. 5. PC 2006 -17 Grande Reserve Unit 18 — Final Plat 6. PC 2006 -18 Grande Reserve Unit 19 — Final Plat 7. PC 2006 -19 Grande Reserve Unit 20 — Final Plat Consulting Engineer Bill Dunn from EEI said all of the final plats are OK. Miller also said the city staff had no additional comments on the final plats. Lucietto made a motion to recommend final plat approval for PC 2006 -17 subject to staff comments. Jones seconded the motion. The motion was unanimously approved by roll call vote. Schillinger, Jones, Crouch, Kraupner, Lucietto, Davis, Adams and Lindblom voted yes. Lucietto then made a motion to recommend final plat approval for PC 2006 -18 subject to staff comments. Crouch seconded the motion. The motion was unanimously approved by roll call vote. Jones, Crouch, Kraupner, Lucietto, Davis, Adams, - Schillinger and Lindblom voted yes. ADDITIONAL BUSINESS Miller said there are nine or ten items for discussion in June. Of those, five are final plats, three are public hearings and one is a concept plan presentation. Lindblom said he'd rather have two short meetings in June than one long one. Schillinger said he figures on having two meetings a month for the next several months because of the caseload. Also, Crouch said a lot of people who come to the public hearings leave before the plan commission discusses the issue. He'd like to see the commission have its discussion after the public hearing at times when there's a big crowd at the public hearing. The 22 first item on the agenda is PC 2005 -19, 23 Woodlands, Incorporated, and Meadowbrook Homes, 24 Incorporated, petitioners, have filed an Depo Court Reporting Service (630) 983 -0030 4 1 application with the United City of Yorkville, 2 Kendall County, Illinois, requesting annexation 3 to the United City of Yorkville and rezoning from 4 Kendall County A -1 to United City of Yorkville 5 containing R -2 One- Family Residence District. 6 The real property consists of 7 approximately 161 and a half acres, one - quarter 8 mile west of the intersection of Route 71 and 9 Route 47 and the north side of Route 71 in 10 Kendall County, Illinois. 11 Dan Kramer is speaking for the 12 petitioner? 13 WHEREUPON: 14 DANIEL J. KRAMER, 15 testified before the Yorkville Plan Commission as 16 follows: 17 MR. KRAMER: For the record, my name 18 is Dan Kramer. I am an attorney licensed to 19 practice law in the State of Illinois. My 20 address is 1107A South Bridge Street, Yorkville, 21 Illinois, 60560, and I represent the petitioners. 22 The main two representatives of the owner and the 23 developing entity of this property are both here 24 tonight, Profur Nassar (phonetic) on the far Depo Court Reporting Service (630) 983 -0030 5 1 right and Aladdin Nassar, who are the owners. 2 Again, their firm both owns it, will develop it, 3 and build the homes in this area. 4 The property, as most of you 5 would know from living in the town for some time, 6 is the old Harris farm, and in honor of that they 7 are naming the whole development Harris Woods. 8 It's contiguous to the City of 9 Yorkville on the its northern boundary and it's a 10 natural outgrowth to the United City of 11 Yorkville. 12 We base this on a number of 13 meetings and I have had some myself with staff, 14 they encouraged us to work with a fairly large 15 group in the southwest quadrant of the City that 16 would extend municipal utility services for that 17 property for the future growth in the 18 Comprehensive Plan. The Comprehensive Plan shows 19 it as a suburban residential district, which is 20 what we are doing. It is all single- family lots. 21 And as you can see from the way 22 it is black showing on our concept plan, they 23 have some very big challenges as owners that they 24 would prefer not to encounter, but, again, Depo Court Reporting Service (630) 983 -0030 i 6 1 working with the City planning staff, they are 2 willing to assume. 3 The two big black areas are 4 major collectors that the City would like to see 5 extended, one being Greenbriar Road, and then it 6 would become a major, and everything out there is 7 on an east -west, north - south, kind of skewed 8 angle, so you almost need a compass, but the City 9 also wanted to see another major connector come 10 up to 71 and generally work to the north on the 11 property. 12 So as we're going through the 13 annexation process with staff, those will be some 14 of the challenges; in other words, providing 15 these oversized collectors that wouldn't be 16 generated by a development normally, and then an 17 orderly extension of sewer and water. 18 We have tried to follow again 19 the Comp Plan in terms of widening it out. Lot 20 size was predominantly 12,000. We have tried to 21 cluster some 10,000 or better square foot lots 22 near the open areas and have some inner spurs. 23 Again, we've gone with the 24 curvilinear -type as opposed to a grid Depo Court Reporting Service (630) 983 -0030 7 1 development, so you'll see that there is a lot of 2 pie- shaped lots and L's and cul -de -sacs that will 3 be very large lots that will be in excess of 4 15,000 square feet. 5 So we are asking the Plan 6 Commission tonight to give a favorable 7 recommendation to the City Council for annexation 8 of this property as a natural outgrowth of the 9 City boundaries in conformance with the Comp 10 Plan. 11 We are asking for a positive 12 recommendation as to all single- family, which was 13 called again under the suburban zoning in the 14 Comp Plan, and then we have a common concept, and 15 I realize this is your first shot at it. We are 16 happy to entertain those, entertain any questions 17 from the Plan Commission or the public may have. 18 CHAIRMAN LINDBLOM: Okay. Thank 19 you, Dan. GLUCK: My name is Ron Gluck 3 (phonetic) here in Yorkville. Question is this: 4 From the information we have received to this 5 point, the north -south connector rendering has 6 not been completed as yet and can be changed at 7 any time. 8 What will remain to the west on 9 the conservation use? 10 CHAIRMAN LINDBLOM: What remains to 11 the west? 12 MR. GLUCK: It will still all be 13 conservation? Right now it's shown somewhere in 14 the middle of the Comp Plan. 15 MR. KRAMER: This will be Aladdin 16 Nassar, he has been sworn in. 17 WHEREUPON: 18 ALADDIN NASSAR, 19 testified before the Yorkville Plan Commission as 20 follows: 21 MR. NASSAR: I am a partner in the 22 development. We actually got the geometry to 23 look at the ingress and egress points of both 24 major collectors directly from EDI, John Depo Court Reporting Service (630) 983 -0030 9 1 Whitehouse, from the City's consulting engineer, 2 emailed that to us and asked us to stay as close 3 to that geometry, so that's -- our response to 4 the question. 5 One of the other challenges is 6 to have a wetland area that we are protecting, 7 we're trying to infringe on a quarter of an acre 8 or less so we don't have to go to for a 9 nationwide permit. We're trying to preserve the 10 wetland as much as we can, so the placement of 11 the street connected to the wetland actually 12 carries a lighter intrusion, but we are able to 13 work around to a favorable end. So the City 14 wants -- 15 CHAIRMAN LINDBLOM: Does that seem 16 to answer your question? 17 MR. GLUCK: Yes. Thank you very 18 much. 19 CHAIRMAN LINDBLOM: Oak. Thank you. 20 Other questions? I am 2 at 10645 Route 71. My problem is is the fact 3 that Joe Harris, that you guys were saying were 4 letting him there and they have the creek there, 5 they have two parks, if you can imagine that off 6 of 71, consider where you are at. I've got 7 almost an acre and about a quarter of an acre. I 8 think Joe is here and I am the house here. Where 9 is the actual creek and tree line? 10 UNIDENTIFIED SPEAKER: These would 11 be the trees. There is a stand of trees right 12 over here. 13 MR. GARRETT: There is parks on this 14 side and a park on this side. My question is if 15 you guys would be willing to put a berm on my 16 land to separate it from the house -- the house 17 that comes to my land. Would this be it back 18 there that has a tree farm back there? 19 UNIDENTIFIED SPEAKER: I'm not 20 exactly sure. 21 MR. GARRETT: (inaudible), I have a 22 tree line and then I have (inaudible). Do you guys have any 4 detention ponds coming in there? 5 UNIDENTIFIED SPEAKER: The retention 6 ponds are these light green areas, and because of 7 the topography of the site we kind of put them 8 back this way, which will hide them so there 9 won't be any flooding, you know, the engineer 10 touched on that. We will 18 move on to the second public hearing, PC 2005 -52, 19 Herb and Cam -- Pam Kleinwachter and Old Second 20 National Bank Trust 8051, petitioners, have 21 proposed to annex to the United City of Yorkville 22 and rezone from Kendall County A -1 Agricultural 23 to United City of Yorkville B -3 Service Business 24 District and R -2 One- Family Residence District, Depo Court Reporting Service (630) 983 -0030 12 1 and for hearing as to the annexation agreement of 2 petitioner. In addition, the petitioners request 3 a special use day care center permitted by 4 Section 10 -7D -2. 5 The real property consists of 6 approximately 9.81 acres located on Route 47, 7 south of Legion Road and north of the River Road, 8 United -- Kendall Township, Kendall County, 9 Illinois. 10 Dan, do you have that? 11 MR. KRAMER: For the record, again, 12 Dan Kramer, 1107A South Bridge Street, Yorkville, 13 Illinois, 60560. I am an attorney licensed to 14 practice law in the State of Illinois and I do 15 represent the petitioners, Pam and Herb 16 Kleinwachter, and Pam.is at the very back of my 17 right tonight if you have any questions for she. 18 You folks probably remember, 19 you saw this about three months ago and you were 20 very gracious, you gave us a positive 21 recommendation for both the annexation and the 22 zoning to the City Council, although you had the 23 whole thing blurred in the application and the 24 public notice. Depo Court Reporting Service (630) 983 -0030 13 1 Really the only thing we are 2 looking for tonight when we go to your actual 3 working session is a recommendation to the City 4 Council for a special use for day care. Day care 5 does require a special use granted on the basis 6 of zoning B -3, which you have already recommended 7 to the City Council. The only change in the 8 drawing of the 9.81 acres that you folks have 9 seen are staff incurred recommendations on the 10 one hand and that was they wanted us to provide 11 the availability for street connection to the 12 north and south in case there was ever 13 development. The street that for the time being 14 we call Street B, but we-will be a little bit 15 more creative when we come back with final plat, 16 with the drive that's behind the USDA park and 17 agricultural office up there, so there will be a 18 public street there. 19 The other thing that we did, 20 it's very unlikely that there will ultimately 21 need to be a connection to the north, that is 22 shown as residential on the Comp Plan and has 23 large windows of access, both at Legion Road and 24 up 47, the property owner has a very minor Depo Court Reporting Service (630) 983 -0030 14 1 parcel. We flipped the day care there, which was 2 originally going to be on the southern lot, we 3 put it on the northern lot, and Pam believes 4 there is a very big need for the service in the 5 community and frankly expanded the building, so 6 those are the only two changes in it. 7 We will be happy again to 8 answer any questions for the Plan Commission, 9 staff, or the public. The only thing we are 10 asking tonight, again, that's different is the 11 special use. 12 CHAIRMAN LINDBLOM: Dan, just for 13 clarification, what I received was a preliminary 14 land staking plan and the smaller preliminary 15 development plan, and this one shows the day care 16 center in the center of the piece. Is that the 17 same piece? 18 MR. KRAMER: No, no. This -- those 19 must have been older reduced versions. The 20 larger version should be this putting the day 21 care to the north. 22 CHAIRMAN LINDBLOM: And it does not 23 show -- this does not show the access road to the 24 south. Item 3 on 10 our agenda is PC 2006 -22. This is Richard Marker 11 Associates, Incorporated, petitioners, have filed 12 an application with the United City of Yorkville, 13 Kendall County, Illinois, requesting annexation 14 to the United City of Yorkville and rezoning from 15 Kendall County A -1 to United City of Yorkville 16 Planned Unit Development containing R -2 17 One - Family Residence District and B -3 Service 18 Business District. 19 The real property consists of 20 approximately 514 acres east of Route 47 and 21 south of Ament Road in Kendall County, Illinois. 22 John? 23 WHEREUPON: 24 JOHN PHILIPCHUCK, ' I Depo Court Reporting Service (630) 983 -0030 16 1 testified before the Yorkville Plan Commission as 2 follows: 3 MR. PHILIPCHUCK: Good evening, John 4 Philipchuck. I am an attorney with the law firm 5 of Dommermuth, Brestal, Cobine & West with I 6 offices at 123 Water Street, Naperville, 7 Illinois. 8 With me this evening is Clint 9 Marker, with Marker & Associates, Pete Huinker, 10 Smith Engineering, who is our civil engineer in 11 this case. 12 As the Staff so noted in the 13 analysis, the property is located along Route 47 14 south of Ament Road, both sides of Penman Road at 15 this location, and then Wheeler Road, and on the 16 plat will be constructed as part of the ongoing 17 plan of continuing that road. 18 Plan Commission will recall we 19 were before you a few months ago with a concept 20 plan for the property. Since that time we had an 21 opportunity to go through, get comments from Plan 22 Commission, from the City Council. We have made i 23 revisions and we are now here before you with the 24 preliminary plan and plat. I Depo Court Reporting Service (630) 983 -0030 17 1 We are looking for a portion of 2 the property zoned R -2 and a portion of this 3 property to be zoned B -3. It will all be subject 4 to the Planned Unit Development. The R -2 portion 5 is 196.8 acres and we have 86.2 acres of 6 commercial property. The city will be 7 concentrating its commercial property along Route 8 47. 9 In the earlier concept plan we 10 had some residential B -3 in here and there was 11 concern about that, the commercial areas along 12 Wheeler Road going up into a larger commercial 13 node on Ament and 347, so to eliminate that 14 concern we will have cross - access through the 15 commercial portion of this property and the -- 16 also then also service delivery to expose the 17 clubhouse facility that will have commercial 18 entites located within, we'll get from this 19 location where folks would have to cross the 20 street to get to the park area, so that now 21 access may be had to the park site and the 22 clubhouse without crossing the street and without 23 exposure to any commercial uses along Route 47. 24 You will recall that we have a Depo Court Reporting Service (630) 983 -0030 18 1 school site located on the property at Penman and 2 constructed via the road. We have had meetings 3 with Dr. Engler and the Park Board. We have 4 talked about the site. There are some trade -offs 5 with the park site, that exposure to the 6 Montalbano development, and concentrate this site 7 that will ultimately have a school on that 8 particular parcel, and some of the other area can 9 be used for recreational purposes. 10 As you recall the plan provided 11 for the various neighborhood path linkages so 12 that there is interconnections between all the 13 neighborhoods with an interior pathway system. 14 These will be constructed by the developer and 15 will be owned and maintained by the homeowner's 16 association, so the park department and the city 17 won't have responsiblity for that. 18 The Plan Commission had 19 suggested, and so had the City Council, that 20 perhaps some equal access or sharing happen, so 21 we would have an emergency access, we would have 22 construction or building of a street between 23 two of those areas -- 24 CHAIRMAN LINDBLOM: Excuse me.
