Resolution 2026-52 Expressing Official Intent Regarding Certain Capital
Expenditures to be Reimbursed From Proceeds of
General Obligation Alternate Revenue Bonds to
be Issued by the United City of Yorkville,
Kendall County,Illinois
CC 2026-35)
Mayor Purcell entertained a motion to approve a Resolution Expressing Official Intent Regarding Certain
Capital Expenditures to be Reimbursed From Proceeds of General Obligation Alternate Revenue Bonds
to be Issued by the United City of Yorkville, Kendall County,Illinois and authorize the Mayor and City
Clerk to execute. So moved by Alderman Funkhouser; seconded by Alderman Marek.
City Administrator Olson explained that the reimbursement resolution would provide the City with
flexibility to finance certain water system improvements completed in April 2026 through a future bond
issuance, if necessary. He noted that the City's WIFIA loan application for the Lake Michigan water
project remains under federal review. He stated that if the loan is not finalized before project costs
become due,the City may need to consider issuing municipal bonds as an alternative financing source.
Adoption of the resolution would allow eligible improvements to be included in a future bond issuance if
one is pursued. He further explained that the resolution does not obligate the City to issue bonds, does not
incur any costs, and would have no impact if bond financing is ultimately not needed.
Motion approved by a roll call vote. Ayes-6 Nays-0

MAYOR PURCELL: Next we have public
hearings. It is 7 :28 p .m . I am now opening the
public hearing for Project Cardinal annexation
agreement amendment.
If anyone would like to speak,
please step to the microphone, and, of course,
state your name as always.
MS. KLAUS: Mary Jo Klaus.
MAYOR PURCELL: Welcome, good to see you
again.
MS. KLAUS: I would like to see this
brought to a vote. The people's voices have been
stripped and I want their voices to be given back
to them. I want to see these data centers on the
November vote. I don't want you guys to decide
anymore.
You have led Yorkville on a downhill
spiral for the last 15 years and it has to stop,
so my suggestion is to tell Project Cardinal,
Project Steel, you're going to put it on the

MS. GORDON: My name is Christina
Gordon, I am a Yorkville resident. I have spoken
at these meetings before and I just want it to be
continuously noted that the residents, many of
them, don't agree with this. I don't agree with
this.
I think that yeah, sure, it should
be on the November ballot or it should just be

So the understanding that the data centers may
pose a danger to us is not just a local -- it's
not just on a local level, but being recognized
federally as Sanders and Ocasio-Cortez push a
bill to impose an AI data center moratorium,
pausing new data centers in the United States
until national safeguards are in place to protect
workers and consumers and ensure that
technologies don't harm the environment.
Changes from AI and robotics will
impact U .S . economy and American democracy,
Senator Sanders, included additional impact to
our privacy rights, our emotional well-being, our
environment and even our very survival as human
beings on this planet, said at a news conference
at the Capitol Congress, and the City -- City of
Yorkville Council are way behind where they

should be in understanding the nature of this
revolution and its impacts.
So I wanted to bring the issue of
the cooling systems that make the modern data
centers possible, which must be addressed.
These cooling systems are frequently
described as closed loop and, therefore,
environmentally neutral, but that framing
significantly understates both their chemical
complexity and their potential health
environmental risks.
Closed loop chiller systems are
often presented as efficient and self-contained;
however, maintaining them requires a chemically
intensive water treatment program and constant
operational oversight.
Because these systems have little to
no evaporation cycles, concentration are not the
primary concern, instead operators must
continuously manage corrosion, microbial growth
and long-term fluid stability.
The circulating medium is typically
not just water, but a treated mixture that may
include glycols such as ethylene glycol or

propylene glycol, corrosion inhibitors including
nitrates, molybdates, phosphates and azo
compounds like benzotriazole, and biocides such
as -- isothiazo -- hard to pronounce,
gluco-aldehydes, DB and PA and ordinary ammonium
compounds.
While essential for system
protection, these chemicals introduce meaningful
health concerns. Biocides such as
isothiazolinones and gluco-aldehydes are known
respiratory and skin sensitizers and have been
associated with occupational asthma, chronic
irritation and allergic reaction that can become
permanent with repeated exposure.
Corrosion inhibitors like nitrates
and azos raise concerns due to potential
endocrine disrupters, and long-term persistence
in water systems, while glycol degradation
products can contribute to toxic byproducts under
certain conditions.
In advanced systems, thoriated
dielectric fluids and other PFAS-related
compounds may also be presented in associated
cooling technologies, raising additional concerns

due to their extreme environmental persistence
and potential long-term health impacts.
Although exposure is typically
limited during normal operation, workers may see
elevated risk during maintenance, flushing, leaks
or equipment failure when these substances can
become airborne, aerosolized or present in
concentrated waste streams.
These systems are also particularly
vulnerable to microbial growth and material
incompatibility if water treatment programs are
not precisely matched to system design,
metallurgy and flow characteristics, making them
far less forgiving than what the term closed loop
implies.
From an operational standpoint, the
biggest weakness arises from not continuous
emission, but from following and performing
degradation over time.
Mineral scale, biofilm and suspended
solids can accumulate on heat transfer surfaces,
and even thin layers of build-up can
significantly reduce efficiency.
Biofilms in particular are highly

insulating and can reduce heat transfer far more
than mineral scale alone, forcing chillers to
work harder to maintain temperature set points.
This increases energy consumption, raises
compressor load and accelerates mechanical wear.
The compressor, the largest energy
consumer in most chiller systems, must operate
under high pressure conditions when following is
present, increasing electrical demand and
reducing overall system efficiency.
Over time this creates a cycle of
rising energy use, higher operating costs and
increased maintenance needs, turning what is
marketed as a stable system into one that
gradually degrades without continuous chemical
and mechanical intervention.
These systems also create
environmental burdens during maintenance and
disposal. Periodic flushing is required to
remove build-up and restore performance, and this
can involve turning over the system multiple
times, generating waste water that contains
residual chemicals, metals and treatment
additives.

This waste water must be handled
under regulatory oversight from the U .S .
Environmental Protection Agency while -- and
Illinois Environmental Protection Agency. While
limited operation produces limited direct
discharge, maintenance events, leaks and system
failures can still release contaminated liquids
into waste water systems or the environment.
Increasingly, data center projects
across the United States are also facing public
scrutiny and regulatory challenges due to water
use and discharge concerns, including rejection
and the delay of projects.
Other regions have encountered
permitting delays related to river discharge,
wetlands and thermal pollution, while agencies
such as Ohio Environmental Protection Agency are
developing updated waste water framework
specifically for data center operation.
The broader pattern is clear. Once
full life cycle impacts are assessed, these
systems increasingly require tighter oversight,
longer review timelines or outright
reconsideration before expansion proceeds.

I and the people in this room urge
you, we need a moratorium. A moratorium is not a
rejection of technology, it's a refusal to let
speculation outpace reality.
It will be the people in this room,
the people who have been trying to open your eyes
to what the grim reality could look like for us,
and that is the risk we do not want to have to
take.
Please consider with your hearts
these words we all spoke here tonight and
previously in other meetings before you allow
this poison to infiltrate our community.
Thank you.
MAYOR PURCELL: Thank you. Anyone else
like to speak? Please step to the microphone.
MR. LANDOVITZ: Good evening. Keith
Landovitz.
MAYOR PURCELL: Oh, Keith.
MR. LANDOVITZ: Just write my name here.
So I have both testimony and comment, so I will
start with testimony, and for that purpose I will
consider myself to have been duly sworn for the
public hearing.

I assume given the overall structure
you will take the comment right after the
testimony, but I will do that however you like.
MAYOR PURCELL: Have at it.
MR. LANDOVITZ: Okay. So for testimony,
I would like please just to read into the record
the following information.
First, I would like to read prices
from the w holesale electric market for what are
called the capacity auctions conducted by
something called PJM.
You have heard about PJM before in
some of the meetings on the topic of these data
centers. PJM is what's called a regional
transmission organization.
That, the RTO and a similar type of
thing called an independent system operator, an
ISO, those are kind of the backbone of the US
electric market, and then the public utilities
like ComEd, the retail and commercial utilities,
are members of that regional transmission
organization or independent system operator, so
PJM is the regional transmission organization of
which ComEd, our ComEd, is a member.

So as you have heard before, PJM
conducts periodic auctions to plan for future
capacity, right, to have guaranteed capacity of
electricity, so the prices -- and these auctions
are held a couple of years in advance of the
actual purchases, kind of like buying futures to
establish a future price.
So the prices from the -- I 'm going
to read the prices from the 2024-2 0 25 auction,
the 2025-26 auction, the 26-27 auction and the
27-28 auction.
From the 24-25 auction, the
wholesale electric price on the capacity
market -- there is also, you know, a spot market
for when demand -- additional generating capacity
is needed urgently, but this is what's planned in
advance.
The price on the capacity market,
24-25, was $28.92 per megawatt day; in the 25-26
auction the price was $269.92 per megawatt day,
which was a record at the time of that auction;
for the 26-27 auction, the price was $329.17 per
megawatt day, also setting a record; and for the
27-28 auction, which I believe was conducted last

December -- and that's not testimony, just on my
information and belief -- that auction, the price
was $333.44 per megawatt day, also setting a
record, and that is the largest wholesale price
in any PJM-conducted capacity auction.
Regarding those prices, I 'm now
quoting from a report with the absolutely
captivating and heart-stopping name, Analysis of
the 2025-2026 RPM Base Residual Auction, Part G ,
and this report was published last year, about a
year ago, June the 3 rd, 2025.
The report is published by an outfit
called Market Analytics, which sounds probably
like some shadowy CIA front organization. It's
actually something called an independent market
monitor, or the independent marketer for PJM, or
each RTO or ISO would have one.
The independent marketer is part of
the U .S . energy regulatory framework, and their
job is to be sort of an independent watchdog for
the RTOs and ISOs , so from this report published
last year, I am quoting, the base conclusion of
this analysis is that data center load growth is
the primary reason for recent and expected

capacity market conditions, including total
forecast load growth, the tight supply and demand
balance, and high prices.
Skipping ahead, it is misleading to
assert that the capacity market results are
simply just a reflection of supply and demand.
The current conditions are not the result of
organic load growth; the current conditions in
the capacity market are almost entirely the
result of large load additions from data centers,
both actual, historical and forecast.
The growth in data center load and
expected future growth in data center load are
unique and unprecedented and uncertain and
require a different approach than simply
asserting that it is just supply and demand.
So now again, not testifying, but I
will just comment on that, that that sounds to me
like a description of market failure or a broken
market.
That concludes my testimony, turning
then to comment. So I realize, first of all,
that the matter here -- and I want to establish a
connection between my testimony and my reason for

being here and the purpose of this hearing, I
realize that this is a hearing on an amendment to
an annexation agreement and that there is not
total freedom to renegotiate everything that's
already been proposed and agreed with the
applicant at issue here, but I think wherever
there is a negotiation in business, there is
always an opportunity for both parties to take a
step back and to reassess the entire relationship
from top to bottom, right, looking at the big
picture, and I think this -- this request,
petition to amend the annexation agreement for
Project Cardinal, offers an opportunity to
re-evaluate the value proposition for both
parties, and that's not -- I am not proposing at
all that the outcome of such evaluation be
eliminating the project.
I am proposing a couple of things.
First, that -- and I will always say I 'm not
against data centers in principal, in fact, in
many ways I think they are a wonderful industrial
use with comparatively -- with low impact
compared to other potential industrial uses.
But, you know, there is no free

lunch, right, everything has a price, everything
has impact, and I worry about -- when I see kinds
of industrial projects being advanced in many
places, including Yorkville nowadays, I worry
just about how large they are, and I think the
tendency to do things on sort of this gargantuan
scale to me personally is a bit of an obscenity,
that's just a personal opinion from my own
ethical perspective, but I think from a public
policy perspective, the size at which some things
are done nowadays amplifies whatever unintended
consequences they may have.
In some cases those may be good, in
other cases they may be bad, but the risk of that
amplification and of amplifying adverse
consequences can be mitigated by perhaps doing
things on a smaller scale.
So my proposition is that there may
be opportunity in this renegotiation to shrink
the scale of the proposed development. That
might yield a better balance of benefits and
impacts and might also mitigate the risk of
adverse unintended consequences.
So in terms of the decision that you

ultimately face, right now we are developing an
evidentiary record for you to make a decision
about what's in the best public interest, I would
also propose that a couple of things require
evaluation.
First, with the available data about
electrical prices, I think the tax benefits and
other benefits in terms of infrastructure
improvements and so forth, we need to be sure
that those have been assessed net of anticipated
electric rate increases, which I think with the
data available now publicly can be attributed
with some certainty to data center load growth,
so we should factor that into our considerations
of benefit and our models.
Second, the strategy that PJM has
developed in response to challenges that this
data center load growth creates for it includes
some changes in operational strategy, including
possibility of shedding data center loads in
times of insufficient capacity on the electric
generation network, and the consequence of that
could be more operation of the private generator
infrastructure, so I would urge you all also to

consider and your staff to consider if the models
developed as part of the original proposals
correctly factor the amount of time -- and this
is with respect to all impacts, noise, air
pollution and so forth, correctly factor an
accurately expected amount of time that
generators will be running considering what ComEd
and PJM can expect in terms of having to shed
load in times of stress.
So that concludes my comments.
Thank you very much.

whatever, CyrusOne, Project Steel, Project

resources, hell, even ComEd has stated that where
are they going to get the power due to the
infrastructure.
Like I said, I used to build them
before, I built the one -- CyrusOne in Franklin
Park, the one in Elk Grove Village, and I can
tell you with honesty , they're not telling the
whole truth.
I know that -- who is it, Global --
Global Infrastructures that has a big partner
that's financing, Blackrock. Did you guys know
that? It's public knowledge.
Farmland is the foundation of our
society. You're going to destroy the farmland,
so that means you're going to destroy the food.
There is other lands out there it can be built up
on, but hey, money talks, right? I get it. I 'm
an entrepreneur, too, so --
I have lived in Yorkville for -- I
used to live in Plano for what, more than
ten years, moved to Yorkville. Man, I love
Yorkville. It's peace and quiet just like --

well, not as quiet as it is in Plano, but sorry.
Okay.
But Yorkville is fine, I love it,
love the restaurants, I love my peace and quiet,
and to have a massive data center like CyrusOne,
Google, Microsoft, and having what a huge, huge,
huge, what is that, little mini plant in the
middle of it, all that noise frequency, frequency
does mess up people's quality of life. Sorry, I
am very passionate about what I do and I do a lot
of research and everything.
I hope this comes to a vote, will be
on the ballot, because it's very valuable. Look
at what Kevin is doing, Mr. Wonderful in
Colorado, in Utah. They stopped it because the
research that they found is true.
They don't have enough water, we
don't have enough water. Where are we going to
get the water? Where are we going to get the
power for this?
When Elon Musk came and said I want
to bid -- I want to build my megawatt factory,
City of Chicago, ComEd said we don't have the
power for you, we don't , so where is ComEd going

to get the power for this massive data center?
The one in Joliet, they put a stop
to it. Why? Not enough power. Where are we
going to get that power? Our power grid is
delicate, so where are we going to get the power?
Solar panels? Not enough. Solar Farms? Not
enough. Do the math. Nope, math won't happen.
People say oh, yeah, it adds up,
yeah, if you play with the numbers, if you add
this, this and that, but there are smart people
out there. I am one of them. I do my research,
I do my homework on people, and this is all
public knowledge out there.
So if Blackrock is going to fund it,
there is a lot of protests out there with data
centers, I think there is what, two states, two
or three states already banned data centers
already, because where is the resources coming
from? Where? We don't have it. And to waste
farmland just like that to me is a shame.
We need food. We need our resources
to live off the land. That's all I 've got to
say. Thanks.

MS. MAYO: Patty Mayo. I guess what I
want to say is outside of the money, what is the
initial fascination? Like what else are these
going to bring to the community outside of the
money?
Because in listening to what
everybody else is saying, and the gentleman that
was here previously, gees, that's pretty --
that's amazing crap that guy did, and it's not
baloney either. The guy knows what he is talking
about, and I would venture to say that not one of
you knows half of what he just presented to you,
and I find that pretty amazing. Like that's
stuff that you should know if you are making a
step towards something this large.
I would think that I would want --
this lady back here very nicely said, you know,
bringing it to the community. Can you imagine,
you have people like that that have knowledge
like that in the community, can you imagine if
you opened it up to the community and let them
share this and the knowledge that you would have
now if you had done it two years ago? Amazing.
Amazing.

I think you guys would have a
different outlook on what's going on, and I think
when I came to this meeting first, I want to say
it was in January when I first came, I believe
that there was a comment that said well, we know
that this is what the community wants, we know
that this is what the community wants, so now
what I 'm hearing, it doesn't seem like the
community wants that, so if a small group of you
can say this is what the community wants, then a
small group of us can say this isn't what the
community wants.
We don't need to pack the house with
20,000 people, everybody that lives Yorkville, to
say no, we don't want this, because we all know
that everybody else has life, right?
Some of these people, both parents
are working, when they come home, they want to be
with their children. Like maybe things come up
and they can't come, but the whole point is the
group that is here -- and you know most of us, I
mean, you see the same people over and over
again, and we kind of like to be -- consider
ourselves maybe the representatives of the people

that are in the community, and there is nothing
wrong with that.
I mean, again, you guys, if you guys
represent us, then why can't a small group of us
represent the rest of the community?
So I beg of you, because I sit down
at night and I try to think outside of money, my
God, if we could put money aside, outside, what
else is this going to bring to this community,
and I 'm just dying to hear what that answer is,
because I can't come up with anything. Outside
of maybe some environmental ugliness, I don't
know what else it would bring.
But I just -- as far as the vote
tonight, yeah, you know, I 'd say let Project
Cardinal take another 50 years to think about it,
I 'm okay with that, and, you know, maybe in
another three years when nobody even needs data
centers anymore, then we won't have to worry
about it. So thank you.

Jason Macek, resident of Yorkville. Arrogant
eight is a pretty good description as the young
lady just stated, and I think you have heard from
many residents who brought facts and did quite a
bit of research for this meeting.
I 've been to a few of these
meetings, my wife has gotten up and spoken at a
few of these meetings.
What you're not realizing is the
residents of Yorkville really do not want this.

have listened to several of them on Zoom. The

in Yorkville. They don't live in Yorkville. Why
are they speaking at our -- at our meetings to
say what happens at our meetings?
So what is the benefit of
Yorkville -- what is the benefit to Yorkville to
have these data centers?
We just recently had to switch over
to Chicago water because evidently the aquifiers,
or aquifers, whatever they're called, in
Yorkville are not enough to handle the present
growth of Yorkville and the population of
Yorkville, so you're telling me that that was a
coincidence, that we had to spend an exorbitant
amount of money to switch over to Chicago water
and that was a coincidence that it was only for
what's -- what's in Yorkville now, it had nothing
to do with these ginormous water users, the data
centers?
So, you know, I think it's -- like I
said, I 've been to several of these meetings, you
guys have the luxury of having to listen to us,
but you have the luxury of not having to respond
to us, so why don't you actually respond to us?

ANONYMOUS: Anonymous. I have been
there as anonymous before and I will continue to
be.
I was unfortunately unable to catch
the first part of the meeting, just wondering if
there -- and obviously you're not going to answer
this so I 'm going to have to go back and re-watch
the meeting, but I 'm trying to understand why the
request for the extension.
Is this because the tax incentives
have been put on hold? Is this because the
seller isn't interested in selling?
I 'm not sure I understand what
exactly is going on yet with this request, but it
just seems quite interesting to me that there has
been a request to -- to delay the actual
purchase.
Also just wondering what -- how does
this impact both the funding, obviously because
the City of Yorkville, the Council, is expecting
this funding to help benefit the community,
right, it was supposed to help pay for school
improvements or additional schools and whatnot,
so I 'm just curious to know exactly how this is

going to impact that.
Was this -- you know, did we plan
ahead for this? What are -- what are the
ramifications of not getting this funding and
what's going to happen -- I mean, we've got a
full year and a half now where they're trying to
extend this, so if this doesn't go through, how
does this impact Yorkville's budget as it stands?
Just a few concerns, but I would
like to hear and hopefully maybe they were
addressed and I missed them and I will have to
re-watch the meeting, but, again, those are just
kind of some of -- a handful of questions that I
have. That's all.
MAYOR PURCELL: Thank you. Anyone else?
(No response.)
MAYOR PURCELL: No one else?
THERESA: Hello. Sorry, I 'm a little
short. So my name is Theresa, I have lived in
Yorkville since 2010, and I share my fellow
citizens ' concerns regarding the data centers,
and I don't see how a bit of money and a few jobs
is worth squandering the real wealth that we have
with our land, our natural resources and our

water and our power, not to mention the
well-being of our citizens, our children, our
pets, our livestock, our way of life.
So these are things that are not to
be taken lightly, and I have yet to see a single
person stand up here and stand here in favor of
it unless they are directly benefiting from it
monetarily.
MAYOR PURCELL: Thank you. Anyone else?
(No response.)
MAYOR PURCELL: No?
(No response.)
MAYOR PURCELL: Okay. 8 :10 p .m ., I will
close the hearing on the Project Cardinal
annexation agreement amendment.

in the public hearing portion of
the meeting, concluding at 8 :10
