The meeting was called to order at 6:00pm by Chairman Craig Soling.
Citizen Comments: None
Previous Meeting Minutes: June 16, 2026
The minutes were approved as presented.
New Business:
1. PW 2026-56 Capital Improvement Project Updates
Mr. Sanderson said this is the typical quarterly report. There are many projects underway now and he
highlighted the large road program which has only minor items left to complete. The MFT portion of the road
program has a pre-construction meeting scheduled for next week with work slated to start mid to late-August.
He also said the 2026 water main replacement funded through low interest loan funds has started. There are
many smaller projects being done at this time as well. He said the quiet zones are progressing. Delineators are
being ordered, striping has been completed and they will be finished in October. These are the 2 eastern-most
crossings for BNSF.
It was also noted that Public Works will move into their new facility in August.
2. PW 2026-57 Quarterly Bond and Letter of Credit Reduction Summary
This is also the typical quarterly report with a large amount of activity and several reductions, some in Grande
Reserve and Kendall Marketplace, reported Mr. Sanderson.
3. PW 2026-58 Water Meter Replacement Program – Change Order
Mr. Dhuse said there is a $67,000 increase to the cost. It was found that MSI missed some water meters and it
was not caught until after the bid. In addition, some re-plumbing and re-piping needed to be done. When the
replacement project is finished, all meters will be on radio-read. He noted that the scrap value of the old meters
Page 2 of 3
was $62,000 with more received today. This will move to the City Council
4. PW 2026-59 Resolution Approving an Engineering Agreement with Engineering Enterprises, Inc.
(Kennedy Road Roadway Improvements – Phase II)
Mr. Dhuse said this is the usual design engineering agreement and is for the stretch of Kennedy Rd. between
Emerald Lane and Freedom Place. It is part of a grant from the Kane Kendall Council of Mayors. Both phases
of engineering are not eligible for grant reimbursement and the city is responsible for that amount. He said the
total amount is $437,000 over 2 budget years. For this year, $305,000 is budgeted. Next year it is $285,000,
some of which includes land acquisition for right-of-way. This moves to the City Council.
5. PW 2026-60 Resolution Approving an Engineering Agreement with Engineering Enterprises, Inc.
(Adams and Van Emmon Retaining Wall – Design Engineering)
Staff has been trying to move this project forward over the past year, said Mr. Dhuse. He noted a correction in
the contract cost of $84,785 shown in the staff memo. He said $45,000 of that is for the sub-consultant for
structural design. He said the wall would run from lower Adams to upper Adams where it meets Van Emmon
and is about 300 feet long. Administrator Olson asked what it may look like. No decisions have been made yet,
but EEI will bring treatment options to the next meeting. Alderman Soling asked if the wall would be drilled in,
which it will be. He noted that gravel had been laid down to help the problem, however, it washed away. He
said the resident there had their house struck by a semi-truck. This will move to the consent agenda.
6. PW 2026-61 Eldamain Water Main Loop – South – Change Order No. 3 - Balancing
Mr. Sanderson said this is the final balancing Change Order and will close out the project. It was funded by
Cyrus 1 for installing water main to their site. It was decreased by $69,000. This moves to the consent agenda.
7. PW 2026-62 Bluestem Water Main Improvements – Change Order No. 3 – Final Balancing
This project is also nearing completion and the contract was reduced by $84,000. It is recommended for
approval by Mr. Sanderson and this also moves to the consent agenda.
8. PW 2026-63 East Alley Water Main Improvements – Change Order No. 2 – Final Balancing
This project will be closing out and was for water main and sewer work in the east alley. Some additions were
made during the course of the project, but overall the contract cost was reduced by $260,000. Mr. Sanderson
commented on the reasons for the reduction. He said they were very conservative with the design and the soils
showed some contamination in that area. It was thought the soils would need to be hauled away, however, that
was not the case which resulted in savings. Also, the soil borings had shown a rock formation, however, it was
soft and could easily be excavated out without special equipment. The sanitary sewer costs were able to be
reduced due to less work than thought. This moves to the consent agenda.
9. PW 2026-64 Resolution Approving an Engineering Agreement with Engineering Enterprises, Inc.
(Lake Michigan – Water Source Transfer Plan)
Mr. Dhuse said this study shows how the city water reacts to the Lake Michigan water in the copper pipes. It
will show where the water feeds are, how to flush and treat it and is required by the EPA. The cost is not to
exceed $167,000 and $187,500 is budgeted. This moves to the Council consent agenda.
10. PW 2026-65 Route 47 Utility Relocation – Illinois Department of Transportation Agreement
This is a draft agreement from IDOT for funding of some of the water main replacement along Rt. 47 from
Waterpark Way to Carpenter St. There are 2 areas of conflict, one in front of Wrigley and the other north of
Corneils on the west side. Fortunately the city has water main in existing easements, since IDOT will now pay
for relocation of main, based on their policy. This agreement spells this out and a substantial amount of main
needs to be moved resulting in a cost of about $3 million. About 74% will be paid for by IDOT and the city has
the rest of the cost. All the details and terms are in the agreement. The city needs to front-fund and then seek
reimbursement. A cost estimate was just sent to IDOT and a final version of the agreement should be received in
a couple weeks. This matter will move to the City Council on the 28th provided all the materials have been
received from IDOT.

Additional Business:
Alderman Corneils said some cleanup of stone and dirt is needed on Center Parkway in Countryside following
some sidewalk replacement. Mr. Dhuse said it will be done.
Alderman Soling said several residents of his neighborhood called after the July 4th parade and requested the city
to contact the township to restrict parking to only one side of the streets and on Leisure, for that event. It would
be a safety factor so that emergency vehicles could get through. Also, the residents were upset because work and
landscaping that was just done, was destroyed and drivers caused big ruts in the yards. He requested the
township to erect signs or place barriers. Mr. Soling said some of the residents parked their own cars or put
other barriers in place to prevent parking.
There was no further business and the meeting adjourned at 6:22pm.
Minutes respectfully transcribed by Marlys Young, Minute Taker

STANDARD TERMS AND CONDITIONS
Agreement: These Standard Terms and Conditions, together with the Professional Services Agreement, constitute the entire
integrated agreement between the OWNER and Engineering Enterprises, Inc. (EEI) (hereinafter “Agreement”), and take precedence
over any other provisions between the Parties. These terms may be amended, but only if both parties consent in writing. However, to
the extent that the Scope of Work differs from the Standard Terms and Conditions, the Scope of Work document controls.
Standard of Care: In providing services under this Agreement, the ENGINEER will endeavor to perform in a matter consistent with
that degree of care and skill ordinarily exercised by members of the same profession currently practicing under same circumstances
in the same locality. ENGINEER makes no other warranties, express or implied, written or oral under this Agreement or otherwise, in
connection with ENGINEER’S service.
Construction Engineering and Inspection: The ENGINEER shall not supervise, direct, control, or have authority over any
contractor work, nor have authority over or be responsible for the means, methods, techniques sequences, or procedures of
construction selected or used by any contractor, or the safety precautions and programs incident thereto, for security or safety of the
site, nor for any failure of a contractor to comply with laws and regulations applicable to such contractor’s furnishing and performing
of its work.
The ENGINEER neither guarantees the performance of any contractor nor assumes responsibility for contractor’s failure to furnish
and perform the work in accordance with the contract documents.
The ENGINEER is not responsible for the acts or omissions of any contractor, subcontractor, or supplies, or any of their agents or
employees or any other person at the site or otherwise furnishing or performing any work.
Shop drawing and submittal review by the ENGINEER shall apply to only the items in the submissions and only for the purpose of
assessing if upon installation or incorporation in the project work they are generally consistent with the construction documents.
OWNER agrees that the contractor is solely responsible for the submissions and for compliance with the construction documents.
OWNER further agrees that the ENGINEER’S review and action in relation to these submissions shall not constitute the provision of
means, methods, techniques, sequencing or procedures of construction or extend or safety programs or precautions. The
ENGINEER’S consideration of a component does not constitute acceptance of the assembled items.
The ENGINEER’S site observation during construction shall be at the times agreed upon in the Project Scope. Through standard,
reasonable means the ENGINEER will become generally familiar with observable completed work. If the ENGINEER observes
completed work that is inconsistent with the construction documents, that information shall be communicated to the contractor
and OWNER for them to address.
Opinion of Probable Construction Costs: ENGINEER’S opinion of probable construction costs represents ENGINEER’S best and
reasonable judgment as a professional engineer. OWNER acknowledges that ENGINEER has no control over construction costs of
contractor’s methods of determining pricing, or over competitive bidding by contractors, or of market conditions or changes thereto.
ENGINEER cannot and does not guarantee that proposals, bids or actual construction costs will not vary from ENGINEER’S opinion
of probable construction costs.
Copies of Documents & Electronic Compatibility: Copies of Documents that may be relied upon by OWNER are limited to the
printed copies (also known as hard copies) that are signed or sealed by the ENGINEER. Files in electronic media format of text, data,
graphics, or of other types that are furnished by ENGINEER to OWNER are only for convenience of OWNER. Any conclusion or
information obtained or derived from such electronic files will be at the user's sole risk. When transferring documents in electronic
media format, ENGINEER makes no representations as to long term compatibility, usability, or readability of documents resulting from
the use of software application packages, operating systems, or computer hardware differing from those used by ENGINEER at the
beginning of the project.
Changed Conditions: If, during the term of this Agreement, circumstances or conditions that were not originally contemplated by or
known to the ENGINEER are revealed, to the extent that they affect the scope of services, compensation, schedule, allocation of
risks, or other material terms of this Agreement, the ENGINEER may call for renegotiation of appropriate portions of this Agreement.
The ENGINEER shall notify the OWNER of the changed conditions necessitating renegotiation, and the ENGINEER and the OWNER
shall promptly and in good faith enter into renegotiation of this Agreement to address the changed conditions. If terms cannot be
agreed to, the parties agree that either party has the absolute right to terminate this Agreement, in accordance with the termination
provision hereof.
Hazardous Conditions: OWNER represents to ENGINEER that to the best of its knowledge no Hazardous Conditions
(environmental or otherwise) exist on the project site. If a Hazardous Condition is encountered or alleged, ENGINEER shall have the
obligation to notify OWNER and, to the extent of applicable Laws and Regulations, appropriate governmental officials. It is
acknowledged by both parties that ENGINEER's scope of services does not include any services related to a Hazardous Condition.
In the event ENGINEER or any other party encounters a Hazardous Condition, ENGINEER may, at its option and without liability for
consequential or any other damages, suspend performance of services on the portion of the project affected thereby until OWNER:
(i) retains appropriate specialist consultant(s) or contractor(s) to identify and, as appropriate, abate, remediate, or remove the
Hazardous Condition; and (ii) warrants that the project site is in full compliance with applicable Laws and Regulations. ENGINEER
agrees to cooperate with the OWNER, as necessary, to remediate a Hazardous Condition, but same may result in additional costs to
the OWNER.

PAGE 2
Consequential Damages: Notwithstanding any other provision of this Agreement, and to the fullest extent permitted by law, neither
the OWNER nor the ENGINEER, their respective officers, directors, partners, employees, contractors, or subcontractors shall be liable
to the other or shall make any claim for any incidental, indirect, or consequential damages arising out of or connected in any way to
the Project or to this Agreement. This mutual waiver of consequential damages shall include, but is not limited to, loss of use, loss of
profit, loss of business, loss of income, loss of reputation, or any other consequential damages that either party may have incurred
from any cause of action including negligence, strict liability, breach of contract, and breach of strict or implied warranty. Both the
OWNER and the ENGINEER shall require similar waivers of consequential damages protecting all the entities or persons named
herein in all contracts and subcontracts with others involved in this project.
Termination: This Agreement may be terminated for convenience, without cause, upon fourteen (14) days written notice of either
party. In the event of termination, the ENGINEER shall prepare a final invoice and be due compensation as set forth in the Professional
Services Agreement for all costs incurred through the date of termination.
Either party may terminate this Agreement for cause upon giving the other party not less than seven (7) calendar days’ written notice
for the following reasons:
(a) Substantial failure by the other party to comply with or perform in accordance with the terms of the Agreement
and through no fault of the terminating party;
(b) Assignment of the Agreement or transfer of the project without the prior written consent of the other party;
(c) Suspension of the project or the ENGINEER’S services by the OWNER for a period of greater than ninety (90)
calendar days, consecutive or in the aggregate.
(d) Material changes in the conditions under which this Agreement was entered into, the scope of services or the
nature of the project, and the failure of the parties to reach agreement on the compensation and schedule
adjustments necessitated by such changes.
Payment of Invoices: Invoices are due and payable within 30 days of receipt unless otherwise agreed to in writing.
Third Party Beneficiaries: Nothing contained in this Agreement shall create a contractual relationship with or a cause of action in
favor of a third party against either the OWNER or the ENGINEER. The ENGINEER’S services under this Agreement are being
performed solely and exclusively for the OWNER’S benefit, and no other party or entity shall have any claim against the ENGINEER
because of this Agreement or the performance or nonperformance of services hereunder. The OWNER and ENGINEER agree to
require a similar provision in all contracts with contractors, subcontractors, vendors and other entities involved in this Project to carry
out the intent of this provision.
Force Majeure: Each Party shall be excused from the performance of its obligations under this Agreement to the extent that such
performance is prevented by force majeure (defined below) and the nonperforming party promptly provides notice of such prevention
to the other party. Such excuse shall be continued so long as the condition constituting force majeure continues. The party affected

and owing hereunder shall in no event be delayed by the payer because of a force majeure affecting the payer.
Additional Terms or Modification: All prior understandings and agreements between the parties are merged into this Agreement,
and this Agreement may not be modified orally or in any manner other than by an Agreement in writing signed by both parties. In the
event that any provisions of this Agreement shall be held to be invalid or unenforceable, the remaining provisions shall be valid and
binding on the parties.
Assignment: Neither party to this Agreement shall transfer or assign any rights or duties under or interest in this Agreement without
the prior written consent of the other party. Subcontracting normally contemplated by the ENGINEER shall not be considered an
assignment for purposes of this Agreement.
Waiver: A party’s waiver of, or the failure or delay in enforcing any provision of this Agreement shall not constitute a waiver of the
provision, nor shall it affect the enforceability of that provision or of the remainder of this Agreement.
Attorney’s Fees: In the event of any action or proceeding brought by either party against the other under this Agreement, the
prevailing party shall be entitled to recover from the other all costs and expenses including without limitation the reasonable fees of
its attorneys in such action or proceeding, including costs of appeal, if any, in such amount as the Court may adjudge reasonable.
Fiduciary Duty: Nothing in this Agreement is intended to create, nor shall it be construed to create, a fiduciary duty owed to either
party to the other party. EEI makes no warranty, express or implied, as to its professional services rendered.

Rubino Engineering, Inc.
SCOPE OF SERVICES DISCUSSION
The following sections outline the scope of services developed based on the information provided
by the client and the information listed above in order to provide a geotechnical exploration the
planned project. The exploration will be performed in general accordance with both the requested
proposal information and Rubino’s current understanding of the project.
Site Access
Based on current site topography, surface conditions, and project discussions, Rubino anticipates
that the project site will be accessible to track-mounted Geoprobe drilling equipment.
Traffic Control
Rubino anticipates that traffic control will be necessary along Beecher Road. Rubino will
subcontract a traffic control company to provide flaggers.
Boring Locations
The approximate proposed boring locations are shown below. Rubino recommends that the
borings be located and surveyed for elevation by others prior to drilling. If the borings cannot be
surveyed, Rubino will locate the borings in the field by measuring distances from known, fixed
site features.
SPT - Soil Sampling
Soil sampling will include split-barrel samples (ASTM D 1586) or thin-walled tube samples on
cohesive soils (ASTM D 1587) at 2 ½ - foot intervals to a depth of 5 feet.
Completion of Borings
Upon completion of drilling, the borings will be backfilled with soil cuttings and capped with similar
existing material and/or asphalt cold patch. Some damage to ground surface may result from the
drilling operations near the work areas and along ingress/egress pathways. Rubino will attempt
to minimize such damage, but no restoration other than backfilling the soil test borings is included.
Proposed Beecher Road Reconstruction in Yorkville, Illinois July 21, 2026
Rubino Proposal No. Q26.396g Page 4 of 11
Rubino Engineering, Inc.
It should be noted that over time, some settlement may occur in the bore hole. If Rubino is
requested to return to the site for the purpose of filling any bore holes that may have settled,
additional time and material charges may apply.
Geotechnical Laboratory Testing
The soil samples obtained during the field exploration program will be transported to the
laboratory for classification and a limited number of laboratory tests. The nature and extent of the
laboratory testing program is at the discretion of Rubino Engineering, Inc. and will depend upon
the subsurface conditions encountered during drilling.
Laboratory testing will be performed in accordance with ASTM procedures and may include
examination of selected samples to evaluate the soils’ index properties and relative strength
characteristics.
Based on the proposed quantity of soil borings, anticipated depths, and project type, a list of the
anticipated laboratory tests are summarized below.
Laboratory Test Estimated
Quantity Sample Type
Natural Moisture Content 20 Split spoon
Atterberg Limits 2 Split spoon
Organic Content 2 Split spoon
CCDD TESTING – LPC 662 ONLY
Rubino will obtain a “Potential Impacted Property” (PIP) evaluation of the area near the proposed
improvements.
If the PIP evaluation indicates no further testing is needed for form LPC-662, Rubino will
composite soil samples from each borehole for soil analytical testing in general compliance with
the IEPA CCDD requirements.
• PIP Evaluation (Historical & Regulatory)
o 2 Eris Report
• Soil Analytical Tests:
o pH (10 total tests)
• P.E. Certification (LPC #662)
• LPC-662 CCDD Certification, as applicable
Please note that CCDD certification requirements vary depending on the dump site. The above
scope should be reviewed by the proposed dump site to determine compliance with the site’s
specific requirements.
GEO REPORT
Upon completion of field and laboratory work, Rubino will prepare a geotechnical engineering
report using the collected data. The geo report will include the following:
• Summary of client-provided project information and report basis
Proposed Beecher Road Reconstruction in Yorkville, Illinois July 21, 2026
Rubino Proposal No. Q26.396g Page 5 of 11
Rubino Engineering, Inc.
• Overview of encountered subsurface conditions
• Overview of field and laboratory tests performed including results
• Summary table of encountered pavement and subbase stone thickness with photo
documentation
• Geotechnical recommendations pertaining to:
• Subgrade preparation
• Subgrade Stability
• Estimated IBV value at each boring location
• Construction considerations, including temporary excavation and construction control of water
An electronic copy of the report will be provided. The report will be addressed to Engineering
Enterprises, Inc.
PROJECT SCHEDULE
Rubino proposes to initiate work on this project within 5 working days after receiving written
authorization to proceed and we will follow the schedule below in order to complete the project:
Task Number of Working Days
Utility clearance and rig mobilization 5 – 10
Field work including site layout and drilling 2
Geo Laboratory Testing 5 – 10
CCDD Lab Testing 8 – 12
CCDD and Geo Reporting 5 - 10
Project schedules can be affected by weather conditions and changes in scope. If the report
needs to be delivered by a specific day, please notify us as soon as possible. Preliminary verbal
recommendations can be made to appropriate parties upon completion of the field investigation
and laboratory testing. Rubino will need to receive a signed copy of this proposal intact prior to
mobilizing the drill rig.
UTILITY LOCATE AND OUTSIDE SERVICES
Rubino will coordinate contacting the Utility “One-Call” for public utility clearance prior to the start
of drilling activities. It is Rubino’s experience that this service does not mark the locations of
privately owned utilities. This proposal is based on privately owned utility locates being
coordinated by the owner prior to drill rig mobilization.
FEES
Rubino proposes to charge the fee for performance of the outlined scope of services on a lump -
sum basis. Based on the scope of services outlined above, the lump-sum fee will be:

Please see the attached fee schedule for additional unit rates for services requested after issuing
the geotechnical report (drawing / spec review, scope or site layout change, etc.).
Scope Limitations
Project services do not include a site evaluation to determine the presence or absence of
wetlands, hazardous substances, or toxic materials.
Rock coring is not included in the scope of this exploration, therefore, the character and continuity
of refusal materials, if encountered, can be determined only with a more comprehensive scope of
services. Therefore, the borings will be advanced to the depths referenced above, or to refusal,
whichever is shallower.
Boring, sampling and testing requirements are a function of the subsurface conditions
encountered. The proposed lump-sum fee is based on the existence of adequate bearing
materials being encountered within the proposed boring depths. Should conditions be
encountered which require a deepening of borings or additional investigation, Rubino will notify
you to discuss modifying the outlined scope of services. Additional work beyond the lump -sum
fee will not be performed without your prior authorization.
AUTHORIZATION
If this proposal is acceptable to you, Rubino will perform the work in accordance with the attached
General Conditions that are incorporated into and made a part of this proposal. Please sign below
as notice to proceed and return one copy of this proposal intact to our office. Rubino will proceed

Water Audit and Non-Revenue Water Reduction Consultation – Engineering Agreement
Public Works Committee – August 18, 2026
Majority
Approval
Proposed PSA from EEI for yearly services to assist with water audit and
non-revenue water loss reduction planning.
Eric Dhuse Public Works
Name Department
Summary
A proposed PSA from EEI to provide services for the City’s annual water audit and non-
revenue water loss reduction plan.
Background
As part of our Lake Michigan allocation, we are required to reduce our non-revenue
water loss below 10% before we receive Lake water. That 10% number is produced from our
annual water audit, that is why these two items are together in one PSA.
This item is before you now because the “water year” is October 1 – September 30 of
each year. Water year 2026 is about to end on September 30th, we will then get EEI all the data
they need to start the water audit. Once the audit is complete, we will then take those numbers
and update our non-revenue water reduction plan with the new figures.
EEI is proposing a PSA in the estimated amount of $55,000 for these services. This
money is budgeted in the approved FY27 budget
Staff has been working with EEI for a number of years to perform our annual water audit
and improve our non-revenue water loss percentage.
Recommendation
Staff recommends approval of this PSA from EEI in the amount of $55,000.

ATTACHMENT A - STANDARD TERMS AND CONDITIONS
Construction Engineering and Inspection: The ENGINEER shall not supervise, direct, control, or have authority over any
contractor work, nor have authority over or be responsible for the means, methods, techniques sequences, or procedures of
construction selected or used by any contractor, or the safety precautions and programs incident thereto, for security or safety of the

of its work.
ENGINEER
agrees to cooperate with the OWNER, as necessary, to remediate a Hazardous Condition, but same may result in additional costs to
the OWNER.

(a) Substantial failure by the other party to comply with or perform in accordance with the terms of the Agreement
and through no fault of the terminating party;
(b) Assignment of the Agreement or transfer of the project without the prior written consent of the other party;
The party affected
by such force majeure also shall notify the other party of the anticipated duration of such force majeure, any actions being taken to
avoid or minimize its effect after such occurrence, and shall take reasonable efforts to remove the condition constituting such force
majeure. For purposes of this Agreement, “force majeure” shall include conditions beyond the control of the parties, including an act
of God, acts of terrorism, voluntary or involuntary compliance with any regulation, law or order of any government, war, acts of war
(whether war be declared or not), labor strike or lock-out, civil commotion, epidemic, failure or default of public utilities or common
carriers, destruction of production facilities or materials by fire, earthquake, storm or like catastrophe. The payment of invoices due
and owing hereunder shall in no event be delayed by the payer because of a force majeure affecting the payer.
Headings: The headings used in this Agreement are inserted only as a matter of convenience only, and in no way define, limit,

Water Main Replacement Construction Eng. Agreement Rt. 47 Water Park to Jericho
Public Works Committee – August 18, 2026
Supermajority (6 out of 9)
Approval
A Proposed PSA with EEI for construction engineering services for the water main
Relocation on the Rt. 47 project from Water Park Way to Jericho Rd.
Eric Dhuse Public Works
Name Department
Summary
A proposed PSA from EEI for construction engineering on the relocation of water main
on the Rt. 47 project from Water Park Way to Jericho Rd.
Background
As part of the reconstruction of Rt. 47 from Water Park Way to Jericho Rd., it is
necessary for City water main to be relocated. Since we are not within IDOT right of way, IDOT
is paying for this relocation, but they will not perform any construction engineering, or pay for it.
Therefore, staff has asked EEI to propose a PSA for the construction engineering for the project.
EEI’s proposal is for $102,092 for engineering services, and $4,325 in direct expenses, for a total
of $106,417.
The majority of the work is expected to occur in FY28, although a portion of the project
may begin during the final month of FY27. After discussing the timing with Finance Director
Fredrickson, staff recommends amending the FY27 Water Fund budget to appropriate the full
contract amount, since sufficient funds should be appropriated prior to awarding the contract.
The current capital plan includes $50,000 in FY28 and $50,000 in FY29 for this work. If
the contract is awarded as proposed, the FY28 budget and future capital plan will be updated to
reflect the anticipated timing of the expenditures and the total contract amount of $106,417.
Recommendation
Staff Recommends approval of this PSA with EEI in the amount of $106,417.

The City applied for and received a 2024 Local Project funding grant from IDOT for the

grant was awarded to the City in the amount of $850,000 which will cover preliminary, design

IDOT requires a specific resolution be passed as part of projects that have State funding. A draft
resolution is attached which commits the City to pay for any costs above the amount in the joint
funding agreement.
The joint agreement specifies 100% state funding for preliminary and design engineering in an
amount not to exceed $127,000. The City Council approved the preliminary and design
engineering agreement in the amount of $76,121 at the May 26, 2026 City Council meeting.

the case of a partial termination that the reduced or modified portion of the funding award will not accomplish the purposes for
which the funding award was made, the STATE may terminate the Agreement in its entirety.
This Agreement may be terminated, in whole or in part, by the STATE without advance notice:
a. Pursuant to a funding failure as provided under Article 1.1

STATE's independent audit, or as a result of any duly authorized inspection or review.
3.2 Record Retention. The LPA shall maintain for three (3) years from the date of final project closeout by the STATE, adequate
books, records, and supporting documents to verify the amounts, recipient, and uses of all disbursements of funds passing in
conjunction with this contract. If any litigation, claim or audit is started before the expiration of the retention period, the records
must be retained until all litigation, claims or audit exceptions involving the records have been resolved and final action taken.
3.3 Accessibility of Records. The LPA shall make books, records, related papers, supporting documentation and personnel
relevant to this Agreement available to authorized STATE representatives, the Illinois Auditor General, Illinois Attorney General,
any Executive Inspector General, the STATE's Inspector General, and any other person as may be authorized by the STATE
(including auditors), by the State of Illinois. The LPA shall cooperate fully in any such audit or inquiry.
3.4 Failure to maintain the books and records. Failure to maintain the books, records and supporting documents required by this
section shall establish presumption in favor of the STATE for recovery of any funds paid by the STATE under the terms of this

past twelve (12) months. To keep projects active, invoicing must occur a minimum of one time within any given twelve (12)
months period. However, to ensure adequate processing time, the first invoice shall be submitted to the STATE within six (6)
months of the date of execution of this Agreement. Subsequent invoices will be submitted in intervals not to exceed six (6)
months.
4.3 Final Invoice: The LPA will submit to the STATE a complete and detailed final invoice with applicable supporting
documentation of all incurred costs, less previous payments, no later than twelve (12) months from the date of completion of work
or from the date of the previous invoice, whichever occurs first. If a final invoice is not received within this time frame, the most
recent invoice may be considered the final invoice and the obligation of the funds closed. Form BLR 05613 (Engineering Payment
Record) is required to be submitted with the final invoice for engineering projects.
4.4 Project Closeout: The LPA shall provide the final report to the appropriate STATE district office within twelve (12) months of
the physical completion date of the project so that the report may be audited and approved for payment. If the deadline cannot be
met, a written explanation must be provided to the district prior to the end of the twelve (12) months documenting the reason and
thew anticipated date of completion. If the extended deadline is not met, this process must be repeated until the project is closed.
Failure to follow this process may result in the immediate closeout of the project and loss of further funding.
4.5 Project End Date: The period of performance (end date) for state obligation purposes is five (5) years for projects under
$1,000,000 or seven (7) years for projects over $1,000,000 from the execution date of the Agreement. Joint agreement
amendments for time extensions must be received and approved prior to expiration of the project end date. Failure to extend the
end date may result in the immediate close-out of the project and loss of further funding.

2025 Water Main Replacement
Majority
Consideration of Approval
Consideration of Change Order No. 4
Brad Sanderson Engineering
Name Department
Public Works Committee – August 18, 2026
The purpose of this memo is to present Change Order No. 4 for the above-referenced project.
A Change Order, as defined by the General Conditions of the Contract Documents, is a written order to
the Contractor authorizing an addition, deletion or revision in the work within the general scope of the
Contract Documents, or authorizing an adjustment in the Contract Price or Contract Time.
Background:
The United City of Yorkville entered into an agreement with Winninger Excavating, Inc. for the
construction of the 2025 Water Main Replacement project for a value of $4,775,774.55 for the above-
referenced project. The current completion date is December 31, 2026.
This Change Order addresses miscellaneous additions encountered throughout the performance of this
project that were necessary to complete the project as originally planned. While this change order is an
overall addition to the Contract value, it is anticipated that a future balancing change order will be a net
deduction from the original bid value.
Backup documents for each addition have been included with this memo.
Question Presented:
Should the City approve Change Order No. 4 which would increase the Contract value by $174,562.51
Discussion:
The following additions were encountered throughout the construction process:
01. This addition is payment for crew downtime for the discovery of an unmarked clay tile during the
excavation of the boring pits for the casing pipe under the railroad along Hydraulic Street. Work
was suspended for 1.25 hours while City staff investigated the clay tile to determine its nature and
function. Work resumed once the determination was made that the tile was abandoned and did
not provide any drainage service. The total cost for this addition was $841.50 as shown in the
attached supporting documents.
02. This addition is payment for the installation of 8-inch HDPE DR11 water main by horizontal
directional drill method from Madison Court to Hydraulic Street. The original plan called for
water main to be open cut down a steep, densely forested slope, with special restoration. This
change removed the same quantity of open cut water main at $181.00 per foot in favor of the
HDPE at $173.00 per foot, removed the $9,000.00 special restoration that would have been
difficult to establish, removed tree removal, and provided less disturbance in a private residential
backyard. The addition added $112,104.00 of HDPE pipe, but removed $117,288 of ductile iron

pipe, $9,000 of restoration, and $5,220.00 of tree removal. The net savings for this addition was
($19,404.00).
03. This addition provided a unit cost for HMA patching to match the existing pavement thickness of
Fox Road. At the time of design, the thickness of Fox Road was not known. The addition added
$2,967.00 of 11-inch patching but removed $575.00 of 5-inch patching. The total cost for this
addition was $2,392.00.
04. This addition provided an insertion valve for shutdown capabilities to connect new water main to
existing water main without loss of pressure to a significant amount of area businesses. The total
cost for this addition was $18,764.90.
05. This addition is payment for jacking and boring a 24-inch steel casing under the railroad tracks at
State Street and Hydraulic Street in lieu of the planned 16-inch steel casing. During excavation
of the boring pit, a rock shelf was discovered in the vicinity of the proposed casing. In order to
better deal with rock removal during the jacking and boring process, the casing was upsized. The
addition added $71,553.95 of 24-inch steel casing but removed $58,100 of 16-inch casing. The
total cost for this addition was $13,453.95.
06. This payment is for utilization of a hydro excavating truck to locate existing utilities and water
main configurations unknown at the time of design. The hydro excavation was a much more
efficient process of utility locates, causing far less disturbance area than the EXPLORATORY
EXCAVATION pay item at $500 for each location. The total cost for this addition was
$24,021.25.
07. This payment is for temporarily removing and replacing an existing storm sewer in order to move
the boring pit as close as possible to the railroad crossing. The temporary storm replacement cost
$6,782.77, and the casing that was no longer needed cost $28,000.00. The net savings for this
addition was ($21,212.23).
08. This payment was for exploratory digging to verify the size, wall thickness, location, and
elevation of existing casing pipes under the railroad tracks running along Hydraulic Avenue. Due
to the presence of rock and geometric challenges with the railroad, it was determined to pull
existing main out of existing casings and reuse the existing casings for the new main installation
as a value engineering proposal. The cost of this work is shown as $2,992.89 but this meant that
134 feet of new16-inch casing would no longer be needed, saving $93,800.00. The net savings
for this addition was ($90,807.11).
09. This payment is for lead and galvanized service replacements at 609, 902, and 906 South Main
Street and 105 and 112 East Washington Street. No lead services were known at the time of
design, but were discovered through the course of construction. The total cost for this addition
was $38,940.00.
10. This payment is for the temporary installation and subsequent removal of a flushing hydrant on
East Washington Street for sanitation of the newly installed water main. During construction, the
connection geometry of the existing water main at Route 47 was found to be beyond an existing
hydrant and valve that was originally intended for flushing of the newly installed main. The total
cost for this addition was $1,969.00.
11. This payment is for the removal and reinstallation of a failing culvert under East Washington
Street. During installation of the new water main, an existing culvert was discovered to be
rapidly failing. Further inspection revealed that other portions of the same culvert were in the
same or worse state of disrepair. The total cost for this addition was $62,813.14.
12. This payment is for additional plating for adjustment of structure frames prior to paving surface
course. Crown correction of the streets was performed to improve drainage deficiencies prior to
pavement milling. As a result, existing structure frames could not be simply adjusted
immediately after milling. The existing structures were plated until binder course was completed,
and adjustments were made just prior to surface course rather than adjusted after removal without
the need for plating. The total cost for this addition was $22,173.80.
13. This payment is for the reconstruction of an existing concrete block sanitary manhole at the
intersection of Morgan and Ridge Streets. During milling of the streets, the concrete block cone
of the existing manhole failed. The top cone section was then replaced with a precast cone. The
total cost for this addition was $6,321.70.
14. This payment is for repair of an existing water service section at 607 South Main Street. The
onsite contractor performing service installations was called to repair a leaking service outside of
the service replacement. The total cost for this addition was $1,892.00.
15. This payment is for the installation of riprap shoulders along the steep sections of South Main
Street and State Street that had deep washouts next to the pavement. The total cost for this
addition was $14,800.06.
16. This payment is for jetting and televising sanitary sewer services at 601 and 907 South Main
Street and 105 East Washington Street. During construction of the water main, complaints arose
of slow sanitary sewer service flow. The Contractor was called out to investigate if the lowered
capacity was a result of the construction of the new water main. Through investigative televising,
it was determined that the perceived lowered capacity was due to root intrusion and older
conditions of the existing sanitary sewer service pipe, and not from construction activities. The
total cost for this addition was $2,610.00.
17. This payment was for reshaping and grading the parkways along South Main Street. Following
sidewalk replacement, several complaints arose relating to the lack of drainage capabilities of the
rural section parkway. Parkways were shaped and re-graded to provide drainage away from
private property as well as away from the edge of pavement. The total cost for this addition was
$73,392.55.
18. This payment is for restoration of the reshaped and re-graded parkways along South Main Street.
Topsoil was added and fine graded within the parkways. Seed, blanket and fertilizer was
installed for restoration. The total cost for this addition was $21,600.00.
Supporting documentation for each of these extras has been included for reference.
