Zoning Commission Minutes 2011 04-27-11 APPROVED W/ CORRECTIONS 5/25/11 ZONING COMMISSION MEETING Wednesday, April 27, 2011 7:00 p.m. Yorkville City Hall Conference Room 800 Game Farm Road, Yorkville, IL 60560 Committee Members in Attendance: Jeff Baker Mike Crouch Gary Neyer Greg Millen Phil Haugen Pete Huinker City Officials in Attendance: Krysti Barksdale-Noble, Community Development Director Paul Zabel, Chief Building Code Official Meeting Called to Order The meeting was called to order at 7:00 p.m. and Mr. Crouch welcomed everyone. Roll Call Roll call was taken. A quorum was established. Citizen’s Comments There were no guests in attendance. Previous Minutes Mr. Baker moved to accept the March 23, 2011 minutes and seconded by Mr. Millen. Under the 10.9.2 previous minutes, Mr. Crouch corrected the spelling of his last name and under , Mr. Baker corrected “single family swelling” to dwelling. There was no further discussion so a vote to accept was made, unanimously accepted and the motion was carried. Mr. Crouch then turned the meeting over to Ms. Noble. Ms. Noble opened the meeting by starting with Old Business: Old Business : Chapter 6: Ms. Noble said she revised the format to landscape so it was a little larger. She also made a change to Utility Uses (page 5 of the chart). It originally said “Radio and Television Towers,” but nothing was included in there with regard to cell towers or telecommunication 1 antennas and facilities so she added ‘Radio, telecommunication and television towers, antennas and facilities” to that. The last item that was revised was the use category for ‘alternative and renewable energy sources.’ She was asked to change ‘rooftop’ to ‘all permitted uses’ in all zoning districts and that was changed. The special use for small wind energy systems in the “O” district and in the “B4” district is as it appears in the revised chart. Mr. Baker wondered about rooftops in “Open Space.” Ms. Noble explained you can have some buildings permitted (sheds; recreational center) because Open Space has parks in it. Personal satellite dishes cannot be regulated on a local level. That regulation was taken away from the local level in 1997. Chapter 7: Dimensional and Bulk Regulations: Ms. Noble advised the committee that she took the map off of the bottom and added for A-1 the maximum height requirement for the District is 80’, and added a provision for 100’ for silos and a maximum of 30’ for dwelling units. She also noted that footnote 2 should include “Rte 126 and Rte 71” set backs and she will make the change. Chapter 8: PUD : There was a request the last time the committee met to incorporate a type of “flow-chart” as far as the steps involved with the process. Ms. Noble included a “Pre- Application Process” from Lincolnwood that is actually incorporated into its Ordinance. She suggested using this in lieu of the current Developmental Flow Chart. It will be changed since the UCOY is set-up structurally different than Lincolnwood. 10-13-6 Concept PUD Plan Review: On page 78, Mr. Baker would like to see the Plan Commission number (PC#) added as item “i.” for tracking purposes. 10-13-7 Preliminary PUD Plat: Mr. Baker asked to change “Park Board Review” at page 83, number 11; “E.” and page 84, 1) to “Park Board Representative (if applicable)” as discussed at last month’s meeting. Also, on page 83, number 11; item “E.”, Mr. Baker suggested merging item “E” with “D.” and then eliminate “E” because it’s not a separate meeting and he doesn’t think you want it to appear that way. 10-13-10: Conditions for Approval: Ms. Noble will make the conditions affirmative. Ms. Noble then stated that this section they just reviewed will most likely be adopted sooner than later. It’s going to be on the EDC agenda for May so the PUD ordinance will probably go to City Council in May or June for adoption and approval. Chapter 9: Agricultural District:10-9-5 Ms. Noble said the title of was changed to Dimensional and Bulk Requirements to match the language used in Chapter 7. She also moved “paddocks” to number 7 under “A”; and Mr. Crouch said he thought they were going to move it to number 8 Stables. Number 9 was added: “Farm animals, livestock, or any other domesticated animal raised in an agricultural setting; such as, but not limited to, cattle, pigs and chickens.” 2 On page 91, there was in inclusion of “Daycare facilities and preschools.” She said there was a question on the difference between daycare facility and preschool. Daycare can cover children from birth to age 12 years; but preschools are usually just for those children pre-K to K and include an educational component. 10-13-4: Procedures for Establishment Going back to , Mr. Huinker asked that B3 be changed because of the word “exceeds.” Ms. Noble asked the committee if they wanted it to read, “The benefit of the PUD plan should forward or exceed the goals established in the development standards and regulations of city ordinances . . . “ All were in agreement. 10-9-4: Accessory Uses : Ms. Noble said the language for B. changed from 4 months to 6 months for a temporary roadside stand. 10-9-5: Dimensional and Bulk Requirements : Ms. Noble said she added Routes 71 and 126 as primary thoroughfares. She also did a height maximum of 30’ for residential structures; 100’ for grain silos; and all other structures would have a maximum of 80’, which is consistent with the other districts in the city. Chapter 10 – Open Space District : Ms Noble said this is a completely new district and she is open to comments and changes. She began by reading “10-10-1: PURPOSE” as stated on page 89. Mr. Baker brought up that solar wind farms are in Open Space, and he doesn’t think the space remains “open” if there’s a wind farm in it. He asked if it should be split into “Open Space” and “Park Space” to clarify some of the intent. Ms. Noble suggested rating the district as far as intensity, similar to what is currently done with the “R” districts. It was also suggested, and agreed upon, to change “use of publically owned green space” to “use of city owned green space.” 10-10-2: Uses Permitted : Section A. 5. Public utility facilities will change to Municipal Public Works facilities. Section “B” the “City Administrator” has been replaced by the “Plan Commission.” 10-10-3: Special Uses : Under “A” – Item 14. “Public utility electric substations and distribution centers” is going to be researched by Ms. Noble. Item 15. “Wind energy systems, Large” is being changed to “Wind Farms.” 10-10-4: Accessory Uses, Buildings and Structures : A. Item number 15 should be finished as – “Other uses which are deemed compatible by the Plan Commission.” Mr. Crouch and Mr. Baker didn’t like to open-endedness of the beginning of Section B., so it was agreed to eliminate the entire section. Section C 1 and 2 will now read: “ . . . prior review by the Park Board and/or approval by the City Council.” 10-10-5: Dimensional and Bulk RequirementsSection B: Side Yards : now reads: “Each building hereafter erected or enlarged shall have a side yard on each side of each building of not Section C: Rear Yards less than the greater of ten (10) feet or 50% of building height.” and now reads: “Every building hereafter erected or enlarged shall provide and maintain a minimum 3 rear yard setback of twenty (20) feet or 50% of building height when adjacent to a residential district.” Since there was not any other business to discuss, Mr. Crouch asked if anyone had anything else to add. Since there was nothing, he asked for a motion to adjourn. The motion was so moved and seconded; all voted “Yes;” and the meeting was adjourned.
