Meeting Called to Order
Meeting was called to order at 6:50 p.m.
Roll Call
Roll call was taken.
Previous Minutes: August 16, 2010, and September 20, 2010.
August 16, 2010 minutes were approved as read. Motion made by Alderman Spears and seconded by
Ms. Dubajic. Approved by unanimous voice vote. September 20, 2010 were approved as read. Motion
made by Alderman Spears and seconded by Ms. Dubajic. Approved by unanimous voice vote.
Announcement
Fire Marshal Canavan invited the committee to a demonstration in fire training and safety to be held at
Hoover Forest Preserve at October 27, 2010 at 10:00 a.m. Two structures, one with sprinklers and one
without, will be set on fire.
Agenda
Motion was made by Fire Marshal Canavan to amend the agenda in order to discuss the International
Fire Code first, followed by the International Residential Code. Motion was seconded by Mr. Duffy
and approved by unanimous voice vote.
2009 International Fire Code
Discussion
Fire Marshal Canavan explained that in some municipalities such as Sugar Grove, Oswego, Kendall
County and Montgomery, the Fire Departments have adopted the Fire Code but the Building
Department has not. Mr. Scheffrahn asked if Bristol Kendall Fire District’s jurisdiction extends

beyond city limits. Fire Marshal Canavan answered that it does and includes Kendall County,
Montgomery and approximately 80 square miles. Mr Duffy asked if the amendments would be voted
on in its entirety or separately. Fire Marshal Canavan answered that they are voted on separately. Mr.
Dontz asked for a brief overview. Mr. Zabel replied that he modified the amendments to suit the City’s
and the Fire District’s needs, as it would be the City’s code.
Section 101.1 Title
Mr. Zabel read the City’s amendment which includes the name of the jurisdiction. He explained that
the Inter-Governmental Agreement states that the Fire District agrees to enforce the City’s codes.
Alderman Spears asked that the city attorney should make this decision. Ms. Noble explained that all
recommendations will go through the city attorney before going to public hearing. Mr. Duffy asked if
a vote is needed to insert the language “United City of Yorkville” in the code section. Fire Marshal
Canavan explained that he omitted the language “United City of Yorkville” as legal protection for the
City. Ms. Noble stated that from staff’s perspective this is the City’s code that the fire district is
enforcing; the fire district is requesting that the code be the Fire District’s code, that is the conflict. As
stated in the Inter-Governmental Agreement, the fire district enforces the City’s code within the city
limits, beyond those limits it would be the Fire District’s code. Ms. Noble also explained that
regarding liability the enforcement officer would be an agent of the City and covered as such. Ms.
Noble stated that the Title Section should read “insert” not “include” the name of the jurisdiction.
Motion was made to amend Section 101.1 by Mr Duffy and seconded by Ms. Dubajic. A roll call vote
was taken and the motion passed.
Section 103.1 General
Fire Marshal Canavan read the recommendations. Mr. Dontz asked if implementation would require
fire suppression systems in each home. Fire Marshal Canavan explained that it is not addressed in this
section. Ms. Dubajic asked for clarification. Ms. Noble explained that this section names the fire
protection district as the enforcement agent of the code. Mr. Zabel used the wording “Fire Code
Official” instead of “Fire Marshal” in order to keep the wording synonymous throughout the code.
Mr. Duffy made a motion to approve 103.1 as written in the City’s memorandum and seconded by Ms.
Dubajic. Roll call vote taken motion does not pass.
Mr. Scheffrahn made a motion to approve the City’s recommendation for Section 103.1. Ms. Dubajic
seconded the motion. Roll call vote approved and the motion carried.
Section 103.2 Appointment
Mr. McCue asked for clarification of the two recommendations, the City’s reads “the Fire Marshal
shall be the Fire Code Official” and the Fire District’s said “the Fire Chief shall appoint the Fire Code
Official.”
Ms. Dubajic made the motion to approve Section 103.2 as written by the City, seconded by Mr.
McCue. Motion passed by unanimous voice vote.
Section 104.8 Modification
Fire Marshal Canavan read the City’s recommendation. Ms. Dubajic read the Fire District’s
recommendation. Fire Marshal explained that whenever there are practical difficulties the Fire Chief
shall have the authority to grant modifications. Mr. Zabel read the section in the code book. Mr. Duffy
stated that the sentence the City added, “A signed copy of the Fire Chief’s decision shall be kept in the
permit file and furnished to the permit applicant” makes the section more complete.
Mr. Duffy made the motion to approve Section 104.8 as written by the City. Ms Dubajic seconded.
Motion passed by voice vote.

Section 105.1.1 Permits Required
Both recommendations were read by the Fire Marshal. He then explained how the City and the Fire
District work together to issue permits for fire suppressions systems. Fire Marshal Canavan
recommended that the permit fees be listed in Section 105.1.1. Ms. Noble explained that changing or
amending the fees in the code would require a lengthy public process, as opposed to setting the fees in
the Inter-Governmental Agreement where a public hearing would not be required to make a change to
the fees.
Motion to approve Section 105.1.1 as written by the City was made by Mr. Scheffrahn and seconded
by Mr. McCue. Motion approved by unanimous voice vote.
Section 105.4.1 Submittals
Fire Marshal Canavan read both recommendations. The Fire District’s recommendation differed from
the City’s in the amount of drawings required for submittal. Mr. Zabel asked for 4 sets of paper plans
along with an approved electronic file per each submittal, the Fire District requires 2 sets of paper
plans and 1 set of approved electronic files.
Mr. Duffy made the motion to amend Section 105.4.1 to read “two sets of plans and specification with
2 copies of approved electronic files.” Motion seconded by Ms. Dubajic and approved by unanimous
voice vote.
Section 105.6 Required Operational Permits
The City’s recommendation to amend Section 105.6 was read by the Fire Marshal.
Mr. Scheffrahn made the motion to amend Section 105.6, seconded by Ms. Dubajic and approved by
unanimous voice vote.
Section 105.6.2 Amusement Buildings
Committee asked for the definition of an amusement building. Mr. Zabel explained that an amusement
building is an assembly type of building.
Mr. Duffy made the motion to delete Section 105.6.2 in its entirety, seconded by Ms. Dubajic. Motion
carried by unanimous voice vote.
Section 105.6.11 Cutting and Welding
Mr. Duffy made the motion to delete Section 105.6, seconded by Ms. Dubajic. Motion carried by
unanimous voice vote.
Section 105.6.17 Floor Finishing
Mr. Duffy made a motion to delete Section 105.6.17, seconded by Ms. Dubajic.
Discussion:
Fire Marshal Canavan stated that because of the Class 1 and 2 flammable chemicals used in the
process of floor finishing he would like the requirement for an operational permit to remain. He also
pointed out that in some structures where the chemicals are used the buildings are not sprinkled.
The motion to delete does not pass and an Operational Permit is required.

Ms. Noble stated in addition to the Fire District’s recommendation she would like to keep the fee
structure out of the code sections and in the Inter-Governmental Agreement. Mr. Zabel agreed and
explained that Operational Permits are in the codes. He recommended all fees be kept in the
agreement.
Section 105.6.30 Open Burning
Motion was made by Ms. Dubajic to approve the recommendation amending Section 105.6.30 to
comply with the City’s Code Ordinance No. 2010-28. Motion seconded by Alderman Spears and
carried by unanimous voice vote.
Section 105.6.32 Open Flames and Candles
Motion to delete Section 105.6.32 was made by Mr. Scheffrahn, seconded by Ms. Dubajic and carried
by unanimous voice vote.
Section 105.6.34 Places of Assembly
Mr. Zabel read the code section. Mr. Duffy asked how an assembly is determined or how it differs
from occupancy. Ms. Noble answered that use is determined in the zoning ordinance.
Ms. Dubajic made the motion to delete Section 105.6.34, seconded by Mr. McCue and carried by
unanimous voice vote.
Section 105.6.47 Laboratory/Research Facility
Ms. Noble explained that there might be flammable or combustible chemicals in this type of use and
an operational permit should be required.
Mr. Duffy made the motion to approve Section 105.6.47, seconded by Alderman Spears and carried by
unanimous voice vote.
Section 105.6.48 Child Care (Home Occupation)
Ms. Noble stated that it is in the best interest of the Fire District to know where a child care facility is
located. Mr. Duffy asked if there are other licensing procedures for this type of home occupation. Ms.
Noble answered that the State of Illinois, Department of Children and Family Services licenses child
care facilities for 6 or more children.
Motion was made by Mr. Duffy to approve the additions to Section 105.6.48, seconded by Ms.
Dubajic and carried by unanimous voice vote.
Section 109.3 Violations
Fire Marshal Canavan read the City’s recommendations and those of the Fire District. The Fire
Marshal explained the procedure that he currently follows in regards to violations. Upon identifying
the violation he determines the amount of time the violator has to comply. The issue is then turned
over to the Code Official, who may or may not grant more time to comply or the matter goes to
adjudication. Mr. Duffy asked if a time frame should be given for the violation. Fire Marshal Canavan
pointed out that a deadline for compliance is written in the notice of violation. Mr. Zabel read the
code and explained that he referenced local, state and federal laws regarding the penalties for
violations, the Adjudication Officer levees the fines.
Motion to approve Section 109.3 as written in the City’s recommendation was made by Mr.
Scheffrahn, seconded by Mr. Skinner, passed by roll call vote.
Section 109.3.2 False Alarm
Fire Marshal Canavan informed the committee of the costs the fire department incurs responding to
false alarms. He would like the fees for false alarms written as part of the code. Mr. Zabel replied that

the fees for false alarms should be treated as other fees previously discussed and made part of the
Inter-Governmental Agreement.
Mr. Duffy made the motion to amend Section 109.3.2, seconded by Ms. Dubajic, passed by
unanimous voice vote.
Section 109.3.3 False Alarm, Schedule of Fees
Mr. Zabel recommended the word “fines” changed to “fees” to reflect the language in the Inter-
Governmental Agreement.
Mr. Duffy made the motion to add the word “fees” and delete the word “fines” in Section 109.3.3. Ms.
Dubajic seconded, the motion passed by unanimous voice vote.
Section 111.4 Failure to Comply
Mr. Zabel read the code section to the committee and his recommendation regarding penalty fees to
any person continuing to work after a “stop work order” has been issued.
Motion to accept Section 111.4 as amended was made by Ms. Dubajic, and seconded by Mr. Duffy.
Motion passed by unanimous voice vote.
Section 113.2 Schedule of Permit Fees
Fire Marshal Canavan explained that the permit fees are already established in the Inter-Governmental
Agreement.
Motion to approve Section 113.2 made by Mr. Dontz and seconded by Mr. Skinner.
Discussion
Mr. Duffy inquired if the Fire Marshal is requesting latitude in setting fees. Fire Marshal Canavan
answered that the fees are already established, the only fees he would like to change are; false alarm
fees and the fees for operational permits.
Motion carried by unanimous voice vote.
Section 202 General Definitions
Fire Marshal Canavan read the recommended change to define “Fire Alarm User” as any individual
owning or occupying a property.
Discussion
Mr. Duffy asked if an owner was responsible for a tenant’s actions. Ms. Noble answered that would be
stated in the landlord/renter lease agreement.
Motion to amend Section 202 was made by Mr. Scheffrahn and seconded by Mr. McCue. Approved
by unanimous voice vote.
Section 505.3 Lightweight Construction
Fire Marshal Canavan read the code section and referenced the newly constructed structures in the
City that used lightweight construction systems. These structures already provide identifying signage.
Mr. Scheffrahn made the motion to approve Section 505.3, seconded by Ms. Dubajic and passed by
unanimous voice vote.
Section 505.3.1 Emblem Required
Motion to approve Section 505.3.1 made by Mr. McCue and seconded by Ms. Dubajic.

Discussion
Mr. Duffy asked if these emblems are provided by the manufacturers of lightweight trusses. Fire
Marshal Canavan answered that they can be locally obtained and explained the placement of the
emblems.
Motion approved by unanimous voice vote.
Section 507.5.1.1 Hydrant Spacing
Fire Marshal Canavan explained the resulting effect of the travel distance from the FDC. He pointed
out the need for water speed and volume when fighting a fire. Mr. Dhuse commented that after
consulting with the City Engineer he was informed that this spacing is already in effect. Mr. Duffy
asked if this will apply retroactively and was told that it would not except in renovations, then the new
code must be complied with.
Motion to approve Section 507.5.1.1 as written by the Fire District was made by Ms. Dubajic,
seconded by Alderman Spears. Motion passed by voice vote.
Section 507.5.7
Ms. Noble discussed the painting and maintenance of hydrants and corresponding no-parking areas.
Stating that after a developer has gone this would be at City’s expense and not be a good use of Public
Work’s time. Fire Marshal Canavan suggested that this section be directed at commercial and
industrial uses.
Fire Marshal Canavan made a motion to amend Section 507.5.7 to read “private, commercial, and
industrial” and delete “multi-families”. Ms. Noble suggested re-crafting the language and to revisit
this section. Mr. Dontz made a motion to table this discussion, seconded by Mr. Skinner, passed by
unanimous voice vote.
Section 511.1 Elevators
Fire Marshal Canavan discussed the requirements for commercial elevators to accommodate a
stretcher 84” in length while in the open position, and be identified with the “Star of Life”. He stated
that the City would like to address this in the International Building Code, Section 302.4 as
recommended in the City’s memorandum.
Fire Marshal Canavan made a motion to accept as recommended, Mr. McCue seconded. Motion was
passed by unanimous voice vote.
Section 901.6.2 Records
Fire Marshal Canavan read the section regarding records of all system inspections, tests and
maintenance.
Fire Marshal Canavan made a motion to approve Section 901.6.2, seconded by Ms. Dubajic.
Discussion
Mr. Zabel asked when does the 14 day deadline to forward the test to the Fire District begin. Fire
Marshal answered after the inspection. Mr. Skinner asks if the section should be amended to read “14
days after completion of inspection.” Mr. Zabel asks if private companies perform the inspections.
Fire Marshal Canavan answered in the affirmative.

Motion to amend Section 901.6.2 to include “after completion of inspection” made by Fire Marshal
Canavan, seconded by Ms. Dubajic, carried by unanimous voice vote.
Section 903.2.1.1 Group A1 Occupancies
Fire Marshal Canavan read the City’s recommendation that A1 Assembly Occupancies over 5,000
square feet be sprinkled. Currently, the code requires a structure 12,000 square feet or more to be
sprinkled. The Fire District wants all A1 Assembly Occupancies sprinkled without any fire- area size
requirement. Mr. Scheffrahn asked for the definition of fire- area. Mr. Zabel read the definition from
the code, the
fire- area is the aggregate area enclosed and bounded by fire walls, fire barriers, exterior walls and
horizontal assemblies of a building. Mr. Zabel discussed his recommendation and gave the example
that a small restaurant with a limited occupant load would have to be fire sprinkled even though it had
kitchen fire suppression systems in place.
Ms. Dubajic made the motion to approve the City’s recommendation to Section 903.2.1.1, Mr. Dontz
seconded.
Discussion
Alderman Spears said that she would like all A1 Occupancies to be sprinkled if the surrounding cities
have the same requirements. Ms. Dubajic stated that the components for fire suppression standards for
a commercial kitchen required by code is more than adequate. Mr. Duffy asked what the cost would be
for sprinkling.
Mr. Scheffrahn made a motion to table this discussion, Ms. Dubajic seconded. Motion carried by voice
vote.
Section 903.7 Commercial Multi-Tenant Occupancies
Fire Marshal Canavan read his recommendation to amend Section 903.7 to add the language “shall
have an isolation control valve for each tenant space.” Mr. Scheffrahn asked if the valves are tamper-
proof. Fire Marshal Canavan answered in the affirmative.
Mr. Duffy made the motion to amend Section 903.7, Fire Marshall seconded, passed by unanimous
voice vote.
Section 907.1.2 Fire Alarm Shop Drawings
The Fire Marshal read the recommendation to amend this section to all fire alarm systems shall be
addressable and all commercial multi- tenant spaces shall be provided with an amber strobe light at the
entrance. Fire Marshal Canavan explained these changes would help a fire fighter to easily locate the
correct tenant space.
Motion to amend Section 907.1.2 was made by Fire Marshal Canavan, seconded by Mr. Duffy, passed
by unanimous voice vote.
