Ordinance 2009-43 ` 11 I STATE OF ILLINOIS ) ss. COUNTY OF KENDALL ) I Ordinance No. 2009 - Lc3 AN ORDINANCE OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS, APPROVING A PRELIMINARY PLANNED UNIT DEVELOPMENT (PUD) PLAN FOR CANNONBALL TRAILS I WHEREAS, the United City of Yorkville (the "City ") is a duly organized and validly existing non home -rule municipality created in accordance with the Constitution of the State of Illinois of 1970 and the laws of the State; and, WHEREAS, First National Bank of Ottawa Trust 2466, the owner of approximately 6.0 acres located at the northeast corner of Route 34 and Cannonball Trail (the "Subject Property "), legally described in Exhibit A, attached and made a part of, has submitted an application and petition for a preliminary planned unit development (PUD) plan for the development of Cannonball Trails; and, WHEREAS, the Subject Property is located within the corporate limits of the City and is zoned PUD; and, WHEREAS, the Cannonball Trails PUD plan has been determined to be in substantial conformance with the approved Concept PUD Plan and the United City of Yorkville Zoning Ordinances, being Title 10 of the Yorkville City Code. i NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of Yorkville, Kendall County, Illinois, as follows: Section 1. The above recitals are incorporated and made a part of this Ordinance. Section 2. The Corporate Authorities hereby approve the preliminary planned unit development (PUD) plan submitted by First National Bank of Ottawa Trust 2466 for the approximately 6.0 acres located at the northeast corner of Route 34 and Cannonball Trail. Section 3.
