COUNTY OF KENDALL ) I Ordinance No. 2009 - AN ORDINANCE OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS, APPROVING FINAL PLAT OF SUBDIVISION FOR CANNONBALL TRAILS I WHEREAS, the United City of Yorkville (the "City ") is a duly organized and validly existing non home -rule municipality created in accordance with the Constitution of the State of Illinois of 1970 and the laws of the State; and, WHEREAS, First National Bank of Ottawa Trust 2466, the owner of approximately 6.0 acres located at the northeast corner of Route 34 and Cannonball Trail (the "Subject Property "), legally described in Exhibit A, attached and made a part of, has submitted an application and petition for final plat of subdivision for the development of Cannonball Trails; and, WHEREAS, the Subject Property is located within the corporate limits of the City and is zoned PUD; and, WHEREAS, the Cannonball Trails final plat of subdivision has been determined to be in substantial conformance with the Yorkville Subdivision Control Ordinance, being Title 11 of the Yorkville City Code. NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of Yorkville, Kendall County, Illinois, as follows: Section 1. The above recitals are incorporated and made a part of this Ordinance. Section 2. The Corporate Authorities hereby approve the final plat of subdivision submitted by First National Bank of Ottawa Trust 2466 for the approximately 6.0 acres located at the northeast corner of Route 34 and Cannonball Trail. The Petitioner has resubmitted the Preliminary PUD Plan (including Landscape Plan) and Final Subdivision Plat (including final Engineering and Final Subdivision Plat) for staff review August 18, 2009 addressing the staff comments as of August 5, 2009. Staff Comments and Recommendations: The Preliminary PUD and Final Subdivision plat proposed is in substantial conformance with the PUD agreement and the Concept PUD Plan approved for this property. Preliminary PUD Plan: The lot configuration and land uses on the proposed Preliminary PUD are in compliance with the approved Concept PUD. The Preliminary PUD Plan does not include a gasoline filling station, as approved by Special Use in 2008 for the property. The Preliminary PUD Plan includes a restaurant and retail uses in this area of the plan along with a daycare use and a bank use, which were approved by the Concept PUD Plan and Annexation Agreement in 2008. The Preliminary PUD Plan submittal is in compliance with Chapter 13 of the Zoning Ordinance. Staff recommends approval of the Preliminary PUD Plan. Final Engineering Plan: In additional to the comments prepared by Bill Dunn, EEI August 20, 2009 (attached) staff recommends the following items be addressed on the Final Engineering Plans: General: • The scale used on Sheets C3 -05, C8, C11, and C14 should be identified. • Identify the lot numbers on Sheets C4 and C5. • Separate plans must be submitted for review for the required improvements along Cannonball Trail and along Route 34. 1 • Remove the word "preliminary" from the title of this document. Add a note on the cover sheet stating that the areas outside Lot 1 are not yet complete. • The existing 12" outfall storm sewer should be evaluated to confirm that excess capacity exists to serve Cannonball Trails as well as the property immediately to the east. Sheet C -3 • Show the existing trail and Kendall Marketplace entrance monument on the west side of Cannonball Trail. • Call for Heavy Duty pavement for the roadway stub to the east located north of Lot 3. • Provide a special detail for the French Drain system. • Move Hydrant #1 to a point 30 feet west of STM 3. Move Hydrant #2 to a point 65 feet south of STM 13. Eliminate Hydrant #5. • Call for the watermain leg to Hydrant #3 to be 8" diameter. • Call for two 45° bend fittings instead of one 90° bend fitting where the 12" watermain bends near the entrance on Route 34. • Move the water service for Lot 2 to be off the watermain parallel to Route 34, • For all water services, a 6" shut -off valve should be located 5 feet from the city watermain. • Move the 8" watermain stub to the east, located north of Lot 3, to be under pavement and in line with the 12" E -W watermain. • Revise the water and sanitary service design for the multiple units on Lot 1 per EEI Comment Nos. 10 and 11. The sanitary sewer running along the back of the buildings will end at a manhole, and will be a public sewer. • Revise the storm structure table to specify that STM 37 has an 8' diameter. • Revise the restrictor manhole detail to specify a rim elevation of 636.5, • Is STM 33 near the south end of Lot 2 in the correct location, or is the connecting storm sewer shown incorrectly? • STM 1 and STM 2 should be should be located at least 5 feet back -of -curb. The landscape plans indicate a structure STM 40 between these two structures. Revise accordingly. • Provide data for the structures shown on the French drain system. Sheet C -5 • Show the major storm overflow paths, both upstream and downstream of the stormwater basins. • Identify curb depression locations and typical width of depression. Sheet C -6 • The stormwater basin design deviates significantly from our ordinance requirements (EEI Comment #27), There have been recent internal discussions that could offer alternative basin design standards for non - residential properties. We will explore this matter further with the developer. • Identify the contour elevations for the south pond. • Is there a reason that the 633 contour elevation is shown with a different linetype? I 2 I Sheet C -7 • The slope between contour elevations 635 and 634 is approximately 2:1 as shown. Revise accordingly. Sheet C -11 • Revise the coverage map based on the new hydrant locations. Sheet C -12 • The special details on this sheet are not legible. Revise accordingly. • Revise the standard manhole and drop manhole special details to call for "City of Yorkville" and "Sanitary" to be cast into the lid. Sheet C -13 • Revise the Hydrant detail to call for Trench Adaptor valve box. • Provide details for dumpster enclosure and parking lot lighting. • Revise the Handicap Parking Sign detail to specify a $350 fine. • Is the valve vault detail meant to be a tapping valve detail? Revise accordingly. • Provide a valve in vault detail. All mainline valves beneath pavement shall be constructed in vaults. • Revise the valve vault, catch basin, and inlet details to call for a maximum 8" of adjusting rings. • Revise the valve vault detail(s) to call for "City of Yorkville" and "Water" to be cast into the lid. I Sheet C -14 • Delete the stop bars on Cannonball Trail at the first Kendall Marketplace entrance. • Call for End -of- Roadway markers (OM4 -1) space at 5 -foot intervals across the roadway stub north of Lot 3. Landscape Plan: The Landscape Plan prepared by Upland Design dated August 18, 2009 has been reviewed by staff and complies with the Landscape Ordinance requirements. Note that this Landscape Plan pertains to the subdivision bufferyard requirements as well as the site landscaping requirements for Lot 1. The detail provided for Lot 1 isn't required at the Subdivision Platting stage, however, the petitioner has included the detail for Lot 1 due to the site plan is being prepared simultaneously with the Subdivision Plat. The remaining Lots will be required to submit landscape plans as part of the building permit requirement when those lots develop and will be reviewed /approved administratively at that time. Final Subdivision Plat: In additional to the comments prepared by Bill Dunn, EEI August 20, 2009 (attached) staff recommends the following items be addressed on the Final Subdivision Plat: Plat of Subdivision: • The date of original plat preparation and revision dates should be added. • Revise the locations of public utility and drainage easements based on the relocation of fire hydrants and watermains discussed below. 3 • Revise the language for the Cannonball Trail ROW dedication to state "Hereby Dedicated to the United City of Yorkville ". • Add a 10 -foot wide public utility and drainage easement for the sanitary sewer to be located immediately north of the multiple units on Lot 1. • Reduce the size of the stub PU & D easement to Lot 4 to 10' wide to be for the sanitary sewer only. • Add a 15 -foot wide PU &D easement to overlap the 25 -foot wide ingress /egress easement along the north side of Lot 3. Watermain and other utilities will need this easement when the property to the east develops. • The interior easements are adequate for city utilities only. The developer should consult with Com Ed, Nicor, AT &T, etc. to determine how they will serve the various lots and provide additional easement width accordingly. . • An advertising sign is shown on the plans at the SW corner of Lot 1, in an area where a utility easement already exists. We should consider allowing the sign to be placed at this location, with a condition that the property owner would be responsible for removal and replacement costs if it ever needed to be removed to allow for maintenance of utilities within the easement. This agreement should be documented on the final plat of j subdivision. • Delete the County Engineer certificate. Staff recommends tabling action on the Final Subdivision Plat to allow the petitioner to resubmit the Final Engineering Plans and Plat addressing the staff comments above. We have reviewed following materials submitted for the above - referenced project: • Preliminary/Final Engineering Plans for Cannonball Trails prepared by Koziol Engineering Services consisting of fourteen (14) sheets with a revision date of August 18, 2009. • Stormwater Management Report for Cannonball Trails prepared by Koziol Engineering Services, Ltd. with a revision date of August 18, 2009. i • A response letter from Koziol Engineering Services, Ltd. dated August 18, 2009. • Landscape Plan for Cannonball Trails prepared by Upland Design, Ltd. with revision date of August 18, 2009. • Plat of Subdivision for Cannonball Trails prepared by Harrington Land surveying, undated. Our review of these plans is to generally determine the plan's compliance with the United City of Yorkville's ordinances and whether the improvements will conform to existing City systems and equipment. This review and our comments do not relieve the designer from his duties to conform to all required codes, regulations, and acceptable standards of engineering practice. GENERAL COMMENTS We offer the following comments: 1. Permits or Sign -offs will be required from the following agencies: a. (IDNR) Consultation Agency Action_, Report regarding endangered /threatened species or natural areas. EcoCAT was filed on 08/0409 with IDNR commitment to evaluate site within 30 days. b. (IHPA) regarding preservation of cultural resources. c. Yorkville - Bristol Sanitary District regarding Sanitary Sewer Facilities. d. (IEPA) Division of Water Pollution Control regarding Sanitary Sewer Facilities. e. (IEPA) Division of Public Water Supplies regarding water supply and distribution. f. (IEPA) Division of Water Pollution Control regarding a Notice of Intent (NOI) General permit to discharge storm water. g. Illinois Department of Transportation (IDOT) regarding the proposed improvements along U.S. Rte 34. Items c, d & e will be required prior to the start of construction activities 2. In areas outside of Lot 1, the detailed design is incomplete and should not be considered final. The focus of this review shall be to verify that the general utility layout and approach is correct and that the necessary areas of construction needed to, serve Lot 1 are in general conformance with City Standards. SHEET C -2 3. Much of the topography on the lot east of the development lot has been added to this sheet. The topography along the east line of the adjoining parcel should be completed and added to the existing conditions. The pavement marking for the handicap spaces on the south side of the automotive building should be corrected. In Illinois it is illegal for two handicap stalls to share the same clear zone. 5. The Bristol Kendall Fire Department has provided commentary in their correspondence dated August 3, 2009. Their comments could imply that additional emergency vehicle access may be required around the north side of the daycare center. This issue should be clarified with fire department. SHEET C -4 6. The east Cannonball Trail parkway north of the north entrance receives ditch flow from the north that has not been accounted for in the stormwater design. The existing culvert in the proposed right lane of Cannonball Trail at the north entrance should be removed accordingly and necessary structures and sewers should be provided. (Design engineer to address) 7. Additional storm structures may be required in the parkway south of the north entrance similar to Comment #6. {Design engineer to address} 8. The status of the existing 12 -inch RCP storm sewer running N/S at the northeast corner of the intersection should be determined and incorporated into the site design. (Design engineer to address) 9. The storm sewer system to be developed in the parking areas is intended to function as a Best Management Practice (BMP). Additional thought and work needs to be put into the design of the drainage system in order to take better advantage of the infiltration ability of the islands. Locations of drainage structures should be remote with respect to curb depressions. 10. Water service for the multiple units in Lot #1 should be served by a single service fed from the front (south) side of the building and a meter room should be provided for distribution to individual tenants. Sanitary service should then be run alone the back (north) side of the building with individual service stubs for each tenant. {Repeat comment) 11. The sanitary sewer service line to serve five separate building units should not be constructed under the building. As designed, a single clog could put 5 businesses out of service. We recommend the solution stated in Comment #10. 12. The restrictor manhole detail was revise_ d as requested except that the piping on the inflow side of the manhole was unnecessarily changed. August 20, 2009 Page 4 of 7 recommend retaining the "tee" design with the submerged restrictor to prevent clogging caused by floating debris. The caps would be installed on the submerged pipe end. "Wholes" in caps should be "holes" in caps. 13. The intent behind the request for tagging of hydrants was to have them shown in a table similar to the storm and sanitary table. Finished grades should be provided for the hydrants. The valves and the pressure connection with rim elevations and top of pipe elevations would be appropriate for this table as well. SHEET C -5 14. Existing contours should be faded to prevent misinterpretation. 15. The proposed detention basins should incorporate curvilinear sides and corners. SHEET C -6 16. The north return of the northernmost access does not drain as shown. More detail should be provided with respect to proposed grading on Cannonball Trail. {Design engineer to address} 17. The proposed driveway grade approximately 130 feet east of the north entrance results in a transverse slope of 10 %. This area should be reviewed and corrected. {Design engineer to address} i 18. The parking lot north of the Buffalo Wild Wings store is only partially design. Based on Plan Council directives, the design engineer has pushed the drainage structures into the island areas in an effort to incorporate BMP's into the stormwater design of this development. Grading and the locations for depressed curb have to be worked on in this area to optimize the design. {Design engineer to address} 19. Stormwater basins should include "Volume Required" and "Volume Provided" and "High Water" (HW) elevation should be provided. Sideslopes should be constructed at 5:1 slope and maximum bounce should be 4 feet in accordance with the Subdivision Control Ordinance. SHEET C -7 20. The handicap stalls on the west side of the Buffalo Wild Wings store do not drain as shown. August 20, 2009 Page 5 of 7 SHEETS C -8 AND C -9 21. The SWPPP plan is of proper form. However, it is anticipated that the locations of many of the island structures will change. SHEET C -10 22. Curtain wall location(s) should be provided at overflow locations and and curtain wall detail should be provided in the plans, SHEET C -12 AND SHEET C -13 23. The Notes & Details sheet will need to be revised to incorporate language and details that conform to the City's Standard Specifications for Improvements. SHEET C -14 24. An additional protection zone should be striped in connection with the handicap stalls south of the automotive building. 25. A "No Left Turn" sign will be needed facing the eastbound traffic for the proposed eastbound right in /right out access point on U.S. 34. STORMWATER MANAGEMENT 26. The detention volume calculations used the rational method with the required 2, 25, and 100 year release rates and the 1.25 runoff coefficient factor and are generally acceptable. For the off -site area a runoff coefficient of 0.85 was used for this future development area. The calculations for the development and the off -site future development were done separately and the then the two volumes added together for the required detention volume. Depressional storage areas volumes were included in the basins to compensate for the areas that would be lost during future development. The owner of the adjacent parcel has expressed agreement with the 0.85 runoff coefficient. 27. The basins are shown as dry bottom basins with naturalized vegetation. The basins have a bounce from normal to high water level of 7.5 feet which exceeds the City requirement of 4 foot of bounce. The basin side slopes are at 4:1 with the bottom area having a 0.5% slope which does not meet the ordinance requirements of 5:1 maximum slope and 2% bottom slope. 28. August 20, 2009 Page 6 of 7 used to confirm that the vegetation plan is suitable for the basin hydraulic conditions. 29. Additional stormwater review time is requested to review finite sewer design and release rate due to the short review period for this submittal. PLAT OF SUBDIVISION 30. Easement provisions should be provided for the cross access easements. Consideration should be given to identifying all paved areas as cross access easements for the sake of simplification as was done at Kendall Marketplace. 31. Building setback lines should be shown along Cannonball Trail and Rt. 34. 32. The Stormwater Management Easement should be adjusted to accurately enclose the HWL for the detention ponds at proposed elevation 633.00 or above. 33. The name and address of the owner and developer should be on the plat. 34. Dedication for Cannonball Trail should read "Hereby Dedicated" only. 35.The P.U. &D.E. along the north line of lot 3 should extend all the way to the east line of the subdivision. 36.A larger easement around hydrant #6 should be created. We recommend a minimum of 5 feet on each side and beyond the end of the hydrant assembly. 37. The easement around hydrant #4 should be enlarged per Comment #36. 38.The P.U. &D.E along the north part of lots 1 and 3 should bemade uniform at 15' wide. 39. If the watermain stub at the northeast corner of lot 3 is to extend beyond the property line, an easement will be needed from the adjacent owner. 40. The P.I.N. at the top of page one has the same number duplicated. 41.A stormwater management easement will be required around the basins on the adjacent property. Several portions of the plans require additional work and detail before final approval can be recommended. None of the issues presented, however, appear to be serious in nature and we do not anticipate any problems going forward that would be insurmountable for the Developer.
