Plan Council Minutes 2009 03-12-09 Y APPRVED Plan Council March 12, 2009 Attendees: Joe Wywrot, City Engineer Stephanie Boettcher, Sr. Planner Jackie Dearborn, Civil Engineer Travis Miller, Dir. Of Comm. Development Sgt. Don Schwartzkopf, Police Dept. Anna Kurtzman, Zoning Coordinator Guests: Dan Kramer, Attorney The meeting was called to order at 9:00 am by Joe Wywrot. PC 2009-06 Windmill Farms Amendment to existinz PUD Dan Kramer explained to staff that Jake Land Group had recently been able to acquire parcel M, which was left as an outlet, not annexed parcel and now the petitioner is completing the annexation and amendment to the existing PUD for all of Windmill Farms. Jake Land will, hopefully,be able to place the entrance and traffic light further to the east. Mr. Kramer anticipates a new concept will be forthcoming and an IDOT approval. There have been two petitions filed. Petition PC 2009-04 is for annexing and rezoning parcel M to a PUD, and PC 2009-06 is for an amending the existing PUD, adding parcel M to Windmill Farms. Mr. Miller,before the amendment is done to the PUD, would like to know what changes may be occurring to the conceptual plan. If the petitioner wishes just to annex, with no conceptual change, the default zoning would be R-I. If the parcel is annexed and zoned R-I and no annexation agreement is completed the city may loose leverage regarding terms for uses with this zoning in place. It was make logical sense that the developer would also want to amend the PUD to include this parcel. Ms. Dearborn has completed a memo regarding the errors in parcel language on the Windmill plat of annexation. These changes will be sent to Cemcon for correction.
