The meeting was called to order at 9:00 am by Joe Wywrot.
PC 2009-04 Windmill Farms Annexation and Zoning
PC 2009-06 Windmill Farms Amendment to PUD
Travis Miller explained to staff after the last plan council, that the petitioner has
submitted a revised concept plan including the 1.6 acre, parcel M. With the addition of
this land the realignment of Route 126 will be affected.
Mr. Kramer explained to staff that when IDOT reconfigured this intersection they
initiated voluntarily acquisitions and condemnations of properties in this area. The M
parcel, owned by the Davis family, was condemned, which has a court order on it. When
the intersection was reformed, it left a dead area between the new Rt.126 right of way and
the overall Jake Group parcel, on the south side. Mr. Kramer said IDOT is now
requesting it be treated as a state section of land for sale,meaning that application must
be made, two appraisals made, then the sale is approved by the legislature (this is not
even a quarter of an acre). Mr. Kramer hopes to exchange some land with IDOT rather
than go through the entire sales process. IDOT has this land because they did not vacate
what was between the newly acquired land and the formerly acquired land,between the
two adjoining owners (an oversight on their part).
Mike Mueller will forward an exhibit of this piece of land and the legal description to
Joe Wywrot. All provisions in the current PUD agreement will be applicable to parcel
M. Any dedication of right of way is a 45 day provision (see Item L#2 on page 4).
Dan Kramer has an updated traffic study from KLOA. The petition will have Mr.
Kramer's address listed, rather than Mr. D'Arcy's.
Mr. Mueller gave staff a spreadsheet on the parking analysis. Ms. Boettcher said the
daycare number of teachers and employees is requested for Ms. Kurtzman's final
calculations. Mr. Miller believes the bank should be calculated on (3) per teller stacking
spaces. The spreadsheet is being requested as an exhibit to the PUD agreement, after any
corrections are made.
Staff would like to know the intention of blank lots. Mr. Kramer said all townhomes
have been removed for the time being and assisted living tax credits have been revoked
for lack of funding. The petitioner does not wish to make any changes to the zoning,just
bring in parcel M,with no changes on entitlement, and change Rt. 126 access. Mr. Miller
suggests that all the entitlements be shown on the new concept plan, and this exhibit
would be included in the amended PUD agreement.

The access point on the east parcel will also change and should be reviewed. The
Raintree extension onto Rt. 126 will be a public road. Lot 16 potentially will be open
space. There is a trail along the north side of Rt. 126 (point G, under site development,
on page 4). The new concept plan should have the trail easement shown on the plan.
This will be at the May 14 Plan Council.
PC 2009-05 Haehner Annexation
Mr. Wywrot is concerned about the meaning of the "2 inch" connection fee, clarifying
that the petitioner would buy the meter, and if this is a residential or commercial
connection. Recapture is due upon final plat, per language from the MPI agreement.
Clarification on the Haehner agreement should specify whether interest is applicable on
MPI recapture funds.
Joe Wywrot suggested that we require right-of-way dedication for a possible
roundabout intersection at Ament and Ashley roads. Dedication of properties language
should be clarified in the agreement (right of ways,parks, etc)
The city is requesting that the petitioner cap the number of residential units at 210.
The flow on the comprehensive plan is more agricultural in this area. There will
potentially be collector street, drainage areas issues, and R-2 estate zoning allows
flexibility for residential clustering.
Ms. Boettcher will check the Aux Sable Creek Water shed plan for a final draft, and ask
the petitioner to comply with the plan.
Ms. Kurtzman suggested to staff that the "agribusiness"term might be better clarified,
assuring in the language that the home owners will be paying property tax, and further
determine the term "commercial building" in the agreement.
This petition will be at the Park Board meeting on April 23 and at Plan Commission on
May 14.
