The meeting was called to order at 9:00 am by Joe Wywrot. The October 28, 2008
minutes were approved as written.

When Yorkville built the Bruell street substation, Mr. Woodworth granted an easement
to the city across the property, shown on the plan. The preliminary plat was approved by
the city. When the easement was granted, Mr. Grant advised the city that at some time in
the future, the property would be subdivided and platted into 3 lots. The city snow plows
continue to maintain the E-W leg of Gawne Lane to Lot 7 and the entire N-S leg of
Gawne Lane.
The petitioner is asking for access to Lots 1, 2 and 3. Mr. Grant and the petitioner have
decided to make Lot 2 a flag lot and make an access onto the lot to the north. Mr. Grant
is waiting for an opinion from Chicago Title. He believes that they will be guaranteed
access to Gawne Lane. Mr. Grant is of the opinion that the title commitment does not
give the city any legal weight or partiality, only that it gives the petitioner access to the
lot. Ms. Orr, will give the city her legal opinion when Mr. Grant advises the city what the
determination by Chicago Title is.
When the Lions Club property was annexed, it left a remaining wedge of
unincorporated property to the east of the Dale Woodworth's home (no finger goes to
Bruell Street). The western edge of the pool property is perpendicular to the street.
There is no current property line along the wedge. The wedge will be zoned R-1. Mr.
Olson will prepare a legal description for this parcel.
The property meets the criteria for zoning in R-1 or R-2, but Mr. Grant will be opting to
zone all lots R-2, allowing for a larger building envelope, which is needed, particularly in
Lot 2. Access does not have to come from the front yard. Lot 1 will have two front
yards, only if access is granted along the south property line.
Joe Wywrot hopes at some time, that Gawne Lane will connect to Bruell Street. The
slope is very steep to the south on Lot 2.
Ms. Boettcher stated that the petitioner should follow the guidelines of the Natural
Resources Information report from the Conservation District. The petitioner will need to
conduct a tree survey for all growth over 4" in diameter.
Mr. Wywrot stated his engineering concerns on his review, dated Nov. 5, 2008.
The petitioner will bring this back to the Plan Council on December 11.
