The meeting was called to order at 9:30 am by Joe Wywrot. The November 20 minutes
were approved with one correction. The engineer of Brighton Oaks has submitted the
preferred design which will go to Plan Commission Jan. 20,with staffs final
recommendation.
Rush Copley Rezoning and Preliminary PUD Plan
Rebecca Houseman stated the plan shows inaccurate zoning for the property next
to it. The setbacks are incorrect on the engineering plans. The access to the 1.29 acre
Lot 2 must be shown on the plat. The developer will put a 30 foot easement on the
northwest corner of the property. The sign code is being revised and each sign will need
a permit. Some signs are appearing in easements, and there will need to be sign
easements at these locations.
John Philipchuck said initially they are re-zoning to PUD, with B-3 standards.
Rebecca Houseman used"B-3 " standards for her reports, and"O"setbacks are on the
developers' plans. Travis Miller will verify. Mr. Kato will be asking for a parking
variance for one space for 400 patrons, and justification will be given.
Joe Wywrot stated the easement around the buildings are ingress and egress
easements, and are for the benefit of the general public. There is no language on the plat
currently. The developer hopes the site will not be used as a primary traffic route to
Beecher Rd.
Bill Dunn stated water looping on site is adequate (#14)but an offsite 16"
connection is needed along Rt. 34 and Cannonball. This site is not the same pressure
zone as Kendall Marketplace. The developer received a letter regarding the site
development permit, and the level spreader system was discussed. Mr. Dunn needs to
know the ultimate improvement will be and how the temporary solution will be
implemented. The City needs assurance that there will be conveyance easements on the
Conover/Fisher properties.
Mr. Philipchuck has given the Conovers' attorney, Mr. Grant,proposed storm
water easement agreements and proposed plans. Joe Wywrot spoke to Tom Grant and

stated the Fisher/Conover families'reluctance to issue an easement on the area near a low
basin. Mr. Grant asked for an alternative path to the river. Lot 3 of Myers subdivision
potentially is a path, and it is 400 ft. east of Fishers, and immediately next is the PNA
property. Mr. Philipchuck stated a yearly crop payment could be option in negotiations.
The developer showed staff the routing from Beecher to the parking lot. The
ingress and egress easements have not been established.
The developer is putting together auto turn exhibits,having received
measurements for emergency vehicles from the Yorkville Bristol Fire District. The City
should have the wetland delineation reports.
The developer will put a full length median down driveway B to driveway A,
discouraging left turns onto Route 34.
The tennis courts and pool will be indoors. Dave Mogle would prefer a 10 `
asphalt trail in lieu of sidewalk on the east side of Beecher Rd.,however the west side
would be acceptable. There will be sidewalk further east of this site along Rt. 34.
Kendall Marketplace has plans for a sidewalk along the north side running to Rob Roy
Creek, and staff will verify the plans for Kendall Marketplace and Rush Copley's site
will match up along the Beecher segment.
The site development letter should be included in plan commission letters. The
developer's 90' building height variance should be addressed in a memo by Bill Dettmer.
Anna Kurtzman will need a parking schematic because it is being considered required
parking.
There are spiral notebooks, showing a power point presentation, and containing
phases, signage and photometric calculations to be submitted for plan council packets.
This will be at Plan Commission on January 10th
