PC 2003-02—Pride Pantry—Special Use for Gas Station Overview This property is located on the east side of Route 47 across from Town Square Park. Petitioner is requesting a special use for a gas station to strengthen his ability to compete economically. Years ago this was a gas station. Tom Hughes knows the history of the site and the owners asked him to be involved in this request. The owners are planning to remove the front portion (8x14) of the building for extra room. Site Plan Issues—Planning Coordinator ➢ Ms. Kurtzman reviewed scope of approval and process. This will go before the Plan Commission, EDC, COW and City Council for consideration and approval. Land use issues and impact, and life safety issues will be reviewed. There will be a Public Hearing before the Plan Commission which is scheduled for 3/12/2003. ➢ It was suggested that the petitioner review the City's Zoning Ordinance, Special Use section. The Plan Commission's recommendation is based on findings of fact. Ms. Kurtzman advised that the petitioner review them and identify that their proposal meets the requirements. Some of the findings of fact that were reviewed were; impact on immediate area, life safety issues like layout to minimize issues, and whether this is an economic detriment to the area-no. ➢ Variances should also be identified. There is a Zoning Ordinance section on findings of fact for variances. 1 ➢ Ms. Kurtzman has been in contact with Rick Powell, IDOT. IDOT will only respond to approve or disapprove if a permit is required. It appears, at this point, that a permit is not required. They will consider the future of Route 47, as well as the current. ➢ A change of use permit may also be required from IDOT due to the access points. The possibility of closing the south driveway to reduce entrances onto the highway was discussed. IDOT may require it. The standard for driveway width was discussed as well. ➢ Mr. Dettmer explained the city's proposed zoning Overlay Ordinance,business/residential. This does not apply to the fire marshal. The most restrictive use will be followed,which is residential. Site Plan Issues—City Planner ➢ Mr. Schoppe recommended that with review of this site plan, the location be brought up to current city standards (current ordinances) including the number of parking spaces, setbacks (pavement to property and building location), minimizing impact to the neighbors and landscape screening. ➢ More information is needed on the site plan including,number of parking places, scaled drawing, dumpster site, a landscape plan is needed, existing sidewalk and entrances should be shown along with the changes proposed. This should be submitted to Anna Kurtzman as the city's point person. Plat Issues—Engineering A few comments were discussed; ➢ Setbacks need to be determined. IDOT needs to be contacted. ➢ A State Fire Marshal permit will be required. Their office is speaking with the contractors; other permits needed are unclear at this point. The underground storage tanks may be located on the north side. Standards and history need to be investigated. ➢ The State Fire Marshal & IDOT will review the placement of the underground storage tanks. IDOT will review based on the planned widening of Route 47. ➢ IDOT and IEPA should be contacted. There was a gas station previously on this site years ago that contaminated the soil. There is an IEPA agreement in place that my impact future site development. Ms. Kurtzman will research. ➢ The petitioner's engineer needs to be prepared to answer questions for Plan Commission regarding how they are planning safety for cars coming in and out. Mr. Graff asked that the petitioner bring in projections of increased use and new customers. The petitioner stated that he owns 3 other locations and we are welcome to visit one at 143rd and LaGrange Rd. in Orland Park which is similar. 2 The city encourages viability. Issues need to be worked out prior to City Council approval taking in to account now and the future. The accident rate at the entrances were discussed. Sgt. Diederich stated that when traffic increases, accidents increase, they go hand in hand. There are ways to reduce the threat of accidents. He will speak with IDOT. Sgt. Diederich will check the actual numbers. If new or additional plans are being submitted for Plan Commission, they need to be here before March 5th to allow for review by the city planner, building and zoning and engineering. The public hearing may be continued if no additional information is submitted. Should the petitioner choose to wait until the April Plan Commission meeting,plans are needed by March 17th.
