November 21,2002

MINUTES
Minutes from September 12, 2002 were accepted by consensus with one correction on page five.
Tim Fairfield from the Bristol-Kendall Fire Protection District(BKFPD) stated that everything
after"or engine five..." should be deleted. BKFPD does not have an engine five. The minutes
should read"to allow better equipment access."
PC 2002-25 DANIEL LANIOSZ'Z GARDEN CENTER- 1 %MILE REVIEW
Boyd Ingemunson addressed the Council regarding the special use on an A-1 zoning within ] '/2
miles radius of Yorkville. The property is on Route 71 across from the Kendall County
Fairgrounds. It is currently uses as a grain and feed store and the owner is seeking an amendment
to the special use so that he can operate a garden center/nursery. He will grow trees and plants on
the property as well as sell plants shipped in to his location. There will be no new structures. If
Mr.Laniosz were going to grow all the plants for sale himself,he wouldn't need the special use
however it is required because things will be shipped in for sale. The County has done their
preliminary approval and Kendall Township has given their preliminary approval at their
Planning Commission. There are a few issues with the parking lot and easement access on the
west of the property that are being worked out with the County now. The County is not
anticipating any problem with the amendment.
Anna Kurtzman from the Building Department noted that there was not a site plan available in the
packet. She asked if the Yorkville Plan Commission would need to see this. Administrator Graff
asked if Mr. Laniosz would include a site plan in the information given to the Plan Commission
and noted that anything that is submitted and/or required for the County should be given to the
City.
City Engineer Joe Wywrot stated that he spoke with Jerry Dudgeon,Director of Planning,
Building and Zoning for Kendall County about this briefly and Mr. Dudgeon noted the issues
with parking and the need for special use because they wanted to sell items not raised on the
property.
Mr. Graff stated that the recommendation is to provide a site plan in order to move forward with
this. The deadline for the December 11,2002 Plan Commission meeting would be December 3,
2002.

Mr. Graff noted that he was waiting for Attorney Kelly Kramer to fax over guidelines as to the
City's role in the 1 'h mile review. Verbally, she said the City's role is to review how the
development complies with its Land Use Plan unless there is a lack of subdivision control or
zoning ordinance that specifically addresses this type of use. Kendall County has these
ordinances in place. With these is place,the City can still recommend that some of Yorkville's
subdivision control ordinances apply to the development.
Angelo Kleronomos addressed the Council. The property is question is at Hilltop and Minkler
Roads and is contiguous on two sides to the Fields of Farm Colony subdivision. They are
bringing this development into the Kendall County under a new zoning classification,RPD-2.
This is the first application of the zoning,which calls for 30,000 square foot lots and a maximum
density of.6 dwelling units/acre. There will be 41.7 acres of total landmass in open space. They
are trying to keep a country flavor as is prevalent in the Fields of Farm Colony,Farm Colony,
Oak Creek and Shadow Creek subdivisions. There will be restrictive covenants that will apply.
The home sizes will be a minimum of 2,900 square feet for two-story,2,300 square feet for ranch
and 2,500 square feet for split-level with a first floor master bedroom. There will be a 2,000
square foot clubhouse with a pool for residents and a trail system similar to the one in Fields of
Farm Colony and Farm Colony and will tie into theirs. The open space will be planted in prairie
grass, savanna type materials and indigenous trees. There will be 57 units on 98 acres. The
development is in two townships,Kendall and Oswego. They have received unanimous approval
from both. They have been to the Kendall County planning bodies accept for the County Board
and received unanimous approval there.
Mr. Graff noted that the subdivision is in compliance with the City's Comprehensive Plan for
estate neighborhood housing with larger lots; 18,000 square feet or greater and a density of no
more that 1.5 units/acre. Mr. Graff asked what Jerry Dudgeon thought regarding the cul-de-sac
length. Mr. Kleronomos stated that both fire districts signed off on the cul-de-sac length. They
discussed were the fire district split was in the development and Oswego's district has the long
cul-de-sac in their district. Also discussed was the road access points to the development. Mr.
Wywrot stated that there was a letter from Attorney Dan Kramer regarding having access out to
Minkler Road and neither fire chief felt this was necessary because there are three points of
access to the subdivision. Mr.Kleronomos stated that the length of the cul-de-sac complied with
the Kendall County ordinance. Annexation of the property was discussed and Mr. Wywrot stated
that he felt that if it were ever to annex it would be to Yorkville. Mr.Fairfield stated that the only
way it would be totally under the BKFPD would be if it annexes from one district to the other.
The fire districts have had some conversations about such things but at this time there are no
conclusions.
Mr. Graff asked about the sewer and water for the development. Mr.Kleronomos stated the
homes will be on private well and septic,no community well. The terrain in the area is
inconsistent for a community sewer system and there is no where to connect it to.
The Council went over Joe Wywrot's memo from November 5,2002 containing his comments on
the subdivision.
• The soil is moderate to good for septic fields;there is a field tile study done and a soil study
underway.

• Street names have been submitted to Kendall County. Tim Fairfield commented on the name
of the road that connects to Fields of Farm Colony. The map shows Audrey Avenue from
Fields of Farm Colony and changes to Jason Avenue. Mr. Kleronomos suggested to the
County that Audrey Avenue be called Audrey Lane in their development. Mr. Fairfield
stated that he would prefer if the street name stayed consistent between the two
developments. The Council further discussed this and Mr. Kleronomos stated that he would
continue to work with the County regarding the street name. Mr. Graff explained the City's
new program for adopting historical street names. He asked if all the streets were assigned
names and Mr. Kleronomos went over the street names for the development. Attorney Dean
Kleronomos stated that if they could get rid of Jason or Audrey Avenues for names they will
take a name from the area.
• Mr. Wywrot was concerned with the binder course used on the roads. Mr.Kleronomos stated
that they are compiling with the County's regulations and Mr. Wywrot stated this was not
acceptable to the City and he will forward his concern to the County.
• The cul-de-sac bulb does not meet the City's requirements but does meet the County's. Mr.
Wywrot state that the County's requirement is close to that of the City's.
• Streetlights will be placed at intersections and at the end of cul-de-sacs.
• Since there will be no sidewalks,Mr. Wywrot recommended that the trail system abut every
lot for access to the clubhouse. Mr. Kleronomos stated that due to the country profile of the
development,the roadways will be safe enough for people to walk along them to the
amenities. The trail currently abuts about 70%of the lots. Mr. Kleronomos noted that the
trails will be turned over to the homeowners association.
• Improvements on Hilltop and Minkler Roads were discussed. The developer does not see a
need for traffic lights or turn bays.
• Driveways are required to be asphalt or better and need to be installed during the first
allowable weather season. There is also a landscape requirement; sod in front yards, seeded
rear yards and each homeowner must install a minimum of$3,500.00 worth of plant material.
The plant material will include trees in the front yards: a 2-'/2 diameter tree for approximately
every 40' (if a front yard is 80' wide,two trees will be required). Landscape plans need to be
approved and the landscaping has to be installed in the first allowable growing season after
the homeowner moves in. The cost includes material and installation.
• Mr. Graff asked that the developer submit their preliminary landscape plan to City Land
Planner Mike Schoppe before they go before the Plan Commission.
• Mr. Wywrot asked that the low points along the roads and areas were culverts are needed be
shown on the plans. He also had questions about the routing of stormwater to the detention
basin. The detention basins were discussed and Mr. Graff asked if they were going to
minimize the bounce to support plant material. Steve Richardson stated that the bounce is
approximately three feet. Mr. Graff asked if Jerry Dudgeon was reviewing the natural areas.
Attorney Kleronomos stated that a Forest Preserve conservation easement was created. The
homeowners association will maintain the property but the Forest Preserve will have the right
to supervise and inspect the installation and they have a right to step in if the homeowners
don't properly maintain it. The parcels will have lot numbers assigned to them.
Attorney Kleronomos asked if Mike Schoppe had any comments and Mr. Graff stated no but that
he should touch base with Mr. Schoppe. Park&Recreation Director Laura Brown stated that Mr.
Schoppe would be at the Parks Planning meeting November 25,2002 at 7:00 P.M. and the Rose
Hill development is on the agenda.

Mr. Graff stated that the Plan Council would recommend the development to the Plan
Commission. He asked that they get a copy of their landscape plan to Mike Schoppe and notify
the fire and police departments of the street names.
Mr. Graff asked if the developer was considering the transition fee to the school district and Mr.
Kleronomos stated absolutely not because the homes are priced at a level where there isn't a
necessity of an impact fee because of the price point of the homes. Mr. Graff stated that they
should provide this information in the packet for the Plan Commission.
ADDITIONAL BUSINESS
There was no additional business and the meeting was adjourned at 10:25 P.M.
