Chairman Tom Lindblom called the meeting to order at 7 p.m.
ROLL CALL

MINUTES
Minutes from the Aug. 10, 2005 Plan Commission were unanimously approved by voice
vote. Commissioner Clarence Holdiman made the motion to approve the minutes.
Commissioner Sandra Adams seconded the motion.
Commissioner Michael Crouch made a motion to open the public hearings. Adams
seconded the motion. The motion was unanimously approved by voice vote.
PUBLIC HEARINGS
1. PC 2005-51 Janice Van Riper,Donald and Charlotte Morris; James and Lynn
Hall, petitioners, application to rezone.
See attached.
Crouch made a motion to close the public hearing. Commissioner Charles Kraupner
seconded the motion. The motion was unanimously approved in a voice vote.
NEW BUSINESS
1. PC 2005-51 Janice Van Riper,Donald and Charlotte Morris; James and Lynn
Hall, petitioners, application to rezone.

Crouch said his biggest concern about the request to rezone is that R-3 zoning would
surround the property in question Eventually,he said, there will be businesses all along
Route 47, but at this point,rezoning one parcel would be akin to spot zoning.
Lindblom pointed out that there are two parcels of residential property between this
parcel and the next one with business zoning.
Holdiman also said the request seemed like one for spot zoning.
Kraupner made a motion to recommend approval to rezone PC 2005-51 as requested.
Adams seconded the motion. The motion failed in a 2-3 vote. Kraupner and Crouch voted
yes. Holdiman,Adams and Lindblom voted no.
2. PC 2005-49 Oak Grove Subdivision— 1 % Mile Review
Attorney Kelly Kramer, representing the petitioners, said the proposed subdivision is a 28
lot single-family development along High Point Road. The proposed development abuts
the Tanglewood Subdivision.
She said final plat is in conformance with the preliminary plat, which was approved a
year ago.
City Planner Mike Schoppe said the proposed use is consistent with the guidelines in the
city's estate district. And, if the property was ever annexed to the city, it would be
consistent with city standards,he said.
Engineering consultant John Whitehouse said city engineer Joe Wywrot reviewed this
project and said all of the concerns seem minor and should be resolved without issue.
Wywrot did suggest that Long Grove Road be rerouted. In his comments, he suggested
that the intersection of Long Grove Road and Highpoint Road should be at least 400 feet
from the Tanglewood Trails Drive intersection. The proposed distance is about 290 feet.
However, Kramer said the plan as it stands is already in process with the county and she
said the developer intents to continue with the plan as it stands.
Holdiman made a motion to recommend approval of the 1 %2-mile review for PC 2005-
49 per the engineering recommendations. Crouch seconded the motion. The motion was
unanimously approved 5-0 in a roll call vote. Kraupner,Holdiman, Adams, Crouch and
Lindblom voted yes.
3. PC 2005-16 Kendallwood Estates—Preliminary Plan
Patti Bernhard representing Kendall Land Development said the proposed development is
located on Route 126 south of Van Emmon Road between Routes 71 and 47. The
property consists of 51.56 acres. Plans are to build 94 single-family homes on the
property with an overall density of 1.82 units per acre. The density would be in
compliance with the city's R-2 standards. The minimum lot size would be 12, 000 square

feet. The proposed setbacks are 30 feet in the front, 10 feet on the side and 40 feet in the
back, she said.
The property is a unique parcel in that it is narrow with a lot of trees, Bernhard said. The
plan for development was designed in a way to preserve as many trees and natural
features as possible.
There's access to Route 126,there's also a reserved lot, which would be used as access to
the south if that were ever developed. There's also a stub to the east, she said. Also, she
said the developer purchased additional acreage to the north so that there's access to Van
Emmon Road.
Adams said her main concern is the one-way out issue, but it does help that the property
to the north has been purchased.
For storm water, a detention area is planned on the western side of the property. Scott
Mai, with Smith Engineering, said engineers are working with city staff on the storm
water issue. Since it's a very steep, wooded site, Mai said they want to come up with
some natural detention to slow the water down. He said they'd like to do that without
cutting down any trees. He added that wetlands on the property wouldn't be touched.
Lindblom said with all of the outstanding engineering issues, it might be too premature
for the Plan Commission to take a vote on the request.
Crouch agreed. He said there seems to be some major engineering concerns in terms of
water detention.
Whitehouse commended that there are some issues, but he's not saying they can't
overcome them. The methods and exact locations need to be determined before
preliminary plat approval, he said. The storm water plan almost has to be in its final state
before the preliminary plan should be approved, Whitehouse added.
Lindblom told Bernhard the petitioners are on the right road. He said he likes the plan,
however,there are just too many issues unresolved. Lindblom asked the Bernhard if the
petitioners would be willing to table the preliminary plan approval pending the resolution
of the engineering issues. Bernhard said she'd be agreeable to tabling the request for one
month.
Crouch made a motion to table PC 2005-16. Adams seconded the motion. The motion
was unanimously approved in a 5-0 roll call vote. Adams, Crouch, Kraupner, Holdiman
and Lindblom voted yes.
4. PC 2005-53 Hudson Lakes—Concept Plan
Jim Olguin representing Kendall Creek Development LLC said the proposed
development is on 141 acres south of Raintree Village and would need to be annexed and
rezoned.

Tedd Lundquist with SEC Planning said the area is surrounded mostly by single-family
residences in suburban neighborhoods with R-2 zoning.
The plans comply with the city's comprehensive plan updates. The proposal is to build
255 single-family units with a density of 1.8 units per acre. The developer isn't seeking
any variances, Lundquist said.
Meanwhile,the proposed minimum lot size is 12,000 square feet with a maximum lot
size of 28,000 square feet and an average lot size of 14,000 square feet.
The main issue, Lundquist said, is the extension on Penman Road. He said there's a small
wetland area that they don't want to disturb.
Crouch said if the main thoroughfare is Penman Road,there needs to be a more direct
route to the proposed school site nearby. He also said the developer should work with the
School District to discuss the proposed school site. Unfortunately,people look at the
school site study the city recently conducted and wrongly assume there will be sites at all
of the proposed locations. If the planned school site north of this property isn't viable,he
said the developers might need to talk to school officials. Olguin said he's already met
with the school district officials.
Adams commented that the park areas seem to small for the size of the proposed
development. Olguin said the developers planned to speak to the Park Board the
following evening. However, initial conversations with the park board showed that
they're agreeable to the amount of land already reserved.
Schoppe said immediately north of the property is a 7-acre school site. Southeast of the
property is a school/park site. With those park areas planned,he said there should be
adequate park space to serve residents of the proposed development.
As for the general layout of the proposed development, Plan Commissioners gave their
informal approval. Lindblom said he likes that the lot sizes are varied.
Crouch made a motion to adjourn the meeting. Kraupner seconded the motion. The
motion was approved unanimously in a voice vote.
The meeting was adjourned at 9 p.m.

21 to do, there is three duplexes located on Route
22 47 , they are all white , just south of the old
23 Brenner building . I ' m sure everyone is familiar
24 with where that is at .

1 We are seeking to rezone the
2 middle duplex to B-1 for an office space . My
3 client , Janice Van Riper , is -- was in the
4 insurance industry, and that ' s what would be in
5 that -- in that -- in that building at the
6 outset .
7 I think there is about 4 , 000
8 square feet . She has 1500 square feet she will
9 use and then later down the road she will get
10 another tenant to use the remaining space .
11 There is -- As you can see on
12 the outlay that you have , there will be ten
13 spaces , including handicapped, and what ' s not
14 shown on here , there is a four-car garage , there
15 is four spaces in there, and two of which will be
16 available also immediately after -- after we
17 hopefully rezone the parcel , so we have a total
18 at the outset of 12 spaces .
19 And there is a shared driveway,
20 between Lot 2 and Lot 3 there is a shared
21 driveway, and the owners of the southern piece ,
22 Junior Brett Horton, have also kind of
23 expected -- expressed interest in rezoning their
24 piece , which they have not done yet , but they

1 have expressed interest in doing that . So 1
2 don ' t anticipate any objection from the Hortons
3 relative to our petition .

5 lot do Hortons have?

7 CHAIRMAN LINDBLOM : Lot 3 .
8 MR . INGEMUNSON : Yeah . They have
9 the duplex just to the south of the one we are
10 seeking to rezone . So that ' s it in a nutshell .

21 live at 712 North Bridge , and I am the
22 beneficiary of that duplex, 712-714 North Bridge ,
23 which is the north part of that property .
24 I , first of all , would like to

2 zoning . What could we expect there if that area
3 is rezoned? Shall I address --
4 CHAIRMAN LINDBLOM : We will answer
5 that for you .
6 MS . AUSTIN : -- one thing at time?
7 CHAIRMAN LINDBLOM : Okay . Sure .
8 Mike , would you want to --
9 MR . SCHOPPE : If you give me a
10 minute , I will turn open the zoning ordinance for
11 the B-2 and describe the type of land uses that
12 this would allow .
13 MR . INGEMUNSON : It will be B-l .
14 MS . AUSTIN : B-1 ? Okay .
15 MR . SCHOPPE : It ' s B-1?
16 MR . WYETH : Yeah . The exhibit says
17 B-2 , Gregg, so --
18 MR . INGEMUNSON : I think it ' s B- 1 .
19 MR . SCHOPPE : Let ' s go with B- 1 .
20 The application is B-1 , okay . B-1 is the latest
21 commercial district that the city has . It allows
22 for the least intense commercial uses , but I will
23 read through a couple of the land uses .
24 Most of them are retail and

1 office-related uses . For example , antique sale ,
2 bakery, barber shop , book store , diner, a church,
3 a community center, florist sales , a health food
4 store , ice cream shop , jewelry -- a jewelry shop ,
5 a meat market , medical clinic, a funeral home ,
6 photography studio , post office , professional
7 building, doctor, lawyers , accounting office ,
8 restaurant , shoe repair, indoor swimming pool ,
9 tennis clubs , those types of activities . That ' s
10 about -- what I just read was about 75 percent of
11 the allowable land uses in the B-1 .
12 MS . AUSTIN : Then the other -- the
13 other point that I want to ask about will be the
14 parking that is involved in connection with that
15 business .
16 You see , there is kind of a
17 complication as far as our drives and so forth
18 where those three duplexes are concerned, and,
19 for example, in the plat , the line between the
20 property of 708 and 710 North Bridge , and the
21 duplex in which I live , the line is about the
22 middle of that drive , and from there out -- it
23 goes at an angle out to the street .
24 And I am wondering if parking

1 would be involved in my drive there , and the
2 other part of that drive where I live . That ' s my
3 other concern .
4 MR . INGEMUNSON : Do you want me to
5 address that , Tom?

8 MR . SCHOPPE : Before I answer that I
9 need to clarify . You live at the duplex --
10 MS . AUSTIN : I live and I am the
11 beneficiary of the trust that owns that property
12 at 712-714 North Bridge , the north duplex .
13 MR . SCHOPPE : The north duplex .
14 MS . AUSTIN : Yes .
15 MR . SCHOPPE : So you are immediately
16 north of this property .
17 MS . AUSTIN : I am north of this
18 property .
19 MR . SCHOPPE : In the map that we
20 have I can see that there is a driveway . The
21 driveway that comes in I am assuming comes in to
22 serve your property --
23 MS . AUSTIN : It serves all three
24 properties .

11 on my part .

13 that note .
14 MR . SCHOPPE : Of course they are
15 asking for rezoning tonight , they are not asking
16 for any site plan approval , as I understand it .
17 If the property were to be
18 rezoned and any redevelopment to take place or
19 change in use , they would have to file a site
20 plan, and the issues like parking would be
21 reviewed to see that there is adequate parking .
22 Generally speaking, the
23 easement probably runs with the property, so any
24 new owner of Lot 2 , of this property, would have

1 access rights to travel across the same easement
2 that ' s in place today, and through the city ' s
3 site plan review process , we would review it to
4 see that any parking on the property would be
5 consistent with the city ' s ordinances .

11 that I want to ask about , is this considered spot
12 zoning?

14 haven ' t -- The city hasn ' t asked us to do a
15 review on the zoning of this property, so before
16 I would be able to comment on that I would have
17 to do a zoning review on that point .

21 say, Mike , it is my understanding there is not
22 anything contiguous to this that is zoned in the
