The real property consists of approximately 5.07 acres at 8591 Route 126. See attached. PC 2003-13 Runge Property IRED Development Ventures, Inc., petitioner, has filed an application with the United City of Yorkville, requesting annexation to the city and rezoning from Kendall County A- 1 Agricultural to Yorkville B-3 Service Business District, R-2 One-Family Residence District, and R-3 General Residence District. See attached. PC 2003-14 Go-Tape Service Stations, Inc. See attached. NEW BUSINESS PC 2003-12 Yorkville Hill Landscaping Commissioner Kerry Green commented that B-3 is the broadest zoning allowed. Page 2 of 4 Chairman Tom Lindblom said he would like to see the petitioner and Mary Block work out an agreement regarding berms identical to the agreement Block reached with the Windham Deerpoint developers. Mary Block, who spoke at the public hearing, asked for the same type of landscaping and barriers the Windham Deerpoint is installing in their subdivision development, which also will neighbor her farm. Attorney John McAdams, attorney representing Yorkville Hill, said this is the first time the matter has been brought up and that his client is open to discussion. Landscaping, he said, certainly wouldn't be a problem. City Planner Mike Schoppe said the city already requires commercial business to put in landscaping. However, he said the agreement reached between the Blocks and Windham Deerpoint is more stringent than what would be required under city ordinance. Block said the type of berm she's asking for is not only landscaping, it would serve as a barrier. City Attorney Kelly Kramer said some of the concerns are premature and an agreement could be attempted through a meeting with the parties involved. Owner Gerardo Barajas said he would be willing to work together with Mrs. Block to reach an agreement. In response to a question about why the need for rezoning, McAdams said the owner wants to store his landscaping equipment on the property, which he is already allowed to do under Kendall County zoning. However, he also would like to annex the property to the city and at some point in the future have a building with limited showroom ability. While someone is now living on the property to ensure that no one vandalizes or attempts to steal the landscaping equipment, if the rezoning is allowed, a fence would be installed around the property and no one would be living on site, McAdams said. Commissioner Andrew Kubala said he had concerns about the B-3 zoning. He said once it's allowed, there's nothing to limit what type of business could go on that property in the future. Kubala made a motion to recommend the annexation of PC 2003-12. Commissioner Brian Schillinger seconded the motion. The motion was unanimously approved in a roll call vote. Kerry Green, Clarence Holdiman, Anne Lucietto, Bill Davis, Sandra Adams, Brian Schillinger, Andrew Kubala and Tom Lindblom voted yes. Kubala made a second motion to recommend the B-3 zoning with the exception relative to berms, fencing and landscaping on all property lines excluding Route 126 be brought to the same standards as Windham-Deerpoint Homes. Schillinger seconded the motion. Page 3 of 4 The motion unanimously failed by roll call vote. Holdiman, Lucietto, Davis, Adams, Schillinger, Kubala, Green and Lindblom voted no. Commissioner Lucietto voiced reservations about the B-3 zoning stating that it would leave potential uses wide open. City Planner Mike Schoppe said landscaping businesses are not allowable under B-1 zoning. However, he said the commission could recommend a single lot planned unit development. In that case, landscaping and other concerns could be spelled out. And, the property would have to be rezoned for any other potential future uses. Kubala moved to recommend a single lot B-3 PUD for PC 2003-12 recognizing the landscaping concerns of Mary Block. Lucietto seconded the motion. The motion was unanimously approved in a roll call vote. Lucietto,Davis, Adams, Schillinger, Kubala, Green, Holdiman Lindblom voted yes. PC 2003-13 Runge Property Kubala suggested the plan needs an additional road stub adjacent to the residential and R- 2 multi-family area. He also said that the street that goes next to the park should be the street that goes to Baseline Road and not the adjacent street. Green asked what the plans are for Rob Roy Creek. Schoppe said there would need to be a bridge or culvert over the creek. Kubala made a motion to table PC 2003-13 until the next meeting. Lucietto seconded the motion. The motion unanimously passed in a roll call vote. Davis, Adams, Schillinger, Kubala, Green, Holdiman, Lucietto and Kubala voted yes. PC 2003-14 Go-Tape Service Stations, Inc. Kubala said he doesn't understand the drawing submitted because the property in question is not shown on the drawing. The petitioner went on to explain where the property is located. Green made a motion to recommend the annexation of PC 2003-14. Kubala seconded the motion. The motion was unanimously approved by roll call vote. Adams, Schillinger, Kubala, Green, Holdiman, Lucietto, Davis and Lindblom voted yes. Kubala made a motion to recommend approval of B-3 zoning for PC 2003-14. Green seconded the motion. Schillinger, Kubala, Greene, Holdiman, Lucietto, Davis, Adams and Lindblom voted yes. PC 2002-06 Mendard's Residential—Preliminary Plan Schoppe said when the plan was reviewed at Planning Council the council didn't have all of the exhibits. They have since been submitted. Page 4 of 4 In general, he said the plat looks good. He said he has not been able to review the plat against the PUD ordinance yet. Lindblom asked if the Plan Commission should move forward and trust the pending review or should the plat be returned to the Plan Commission for recommendation upon review? Gary Colby, representing Mendard's, said the plan has been before the commission many times and he believes it is time to move forward. He said it has to come back to the Plan Commission for final plat approval anyway. Kubala said he is concerned about not having all of the T's crossed and I's dotted. But, he added he felt it would he okay for the Plan Commission to give its recommendation based on comments from city staff knowing that the fmal plat would come before the Plan Commission later. Kubala made a motion to accept the plat for PC 2002-06 with the caveat that the staff and Schoppe complete the review and agree with it. Davis seconded the motion. The motion was defeated in a 3 to 5 vote. Davis, Kubala and Lindblom voted yes. Adams, Schillinger, Green Holdiman and Lucietto voted no. ADDITIONAL BUSINESS Update on Grande Reserve Subdivision and PUD agreement John Whitehouse from Engineering Enterprises Inc. said the developers have applied for a mass-grading permit and should begin mass grading in about 2 weeks.
