Ms. Lucietto introduced the speaker, Kathleen Elliot, a attorney and partner at Tressler, Soderstrom, Maloney, & Priess,LLP. Ms. Elliot shared with the members that state statute, 65ILCS 5/11-12-9, that addresses unincorporated territory, and the manner in which jurisdictional boundary lines are agreed upon The initial term of such an agreement may not exceed 20 years. This section was amended in 1987, stating that the purposes and matters of annexing property are distinct from the planning. The Court in 1987 held that when an intergovernmental agreement establishes an annexation boundary line,that a landowner who wishes to annex on the opposite side of the line cannot do so. Some topics for consideration when establishing a boundary agreements are: 1)public improvements; 2) recapture agreements; 3) whether public services may cross boundary lines; 4) extraterritorial applicability of ordinances; 5) current boundary lines; and 6) terms of the agreement and if the agreement can be amended. Questions asked were 1) who would receive tax revenue if materials are hauled from a mine in the county; 2) if a city was under any obligation to have a boundary agreement; and 3) if state property(ex. state park) can be `jumped over' when considering a review.
