PUBLIC SAFETY COMMITTEE MEETING
City Hall, Conference Room
Thursday, April 24, 2008 — 6:00 P.M.

Chairperson Spears, Committeemen Sutcliff, Werderich
ABSENT:

Lieutenant Don Schwartzkopf, Assistant City Administrator Bart Olson
Chairperson Spears called the meeting to order at 6:10 p.m. in the Conference Room of City
Hall.

NEW BUSINESS:
1. PS 2008-16—Police Reports for March, 2008
The following discussion took place:
• Chairperson Spears asked Lieutenant Swartzkopf to inform Molly that
the report format is great. He stated that if there is other information
that the committee would like to see in the report that they should
contact Molly directly.
This item is informational only.
2. PS 2008-17 — Ordinance Amending City code Adopting Smoke Free
Illinois Act
Assistant City Administrator Olson stated that this change will allow the city
to process local ordinance violation tickets which also allows the City to
receive a larger portion of the fines.
With no further discussion, this item was moved to the Consent Agenda.
OLD BUSINESS:
1. PS 2007-43 — Parking Restrictions for Select Arterial and Collector
Streets
Committeeman Sutcliff stated that on Cannonball Trail approximately 180'
south of Independence, there is a distance of 3 houses that Bill McCue would
like to have parking allowed while he is building and selling the homes.
Chairperson Spears stated that Chief Martin feels that this is a collector street
and it would be difficult to change the parking restrictions at a later time.
After discussion, it was determined that this section of roadway would be
added back to the proposed restricted roadways.
Chairperson Spears stated that she would prefer to start the no parking
restriction on West Countryside after Palmer Drive. Lt. Swartzkopf added
that Chief Martin would prefer not to make that change as the street is used as
a cut-through and a raceway. If residents in the area require additional
parking, they can call the Police Department to get special permission.
a) Restrict Parking on East Kendall Drive
Chairperson Spears stated that the concern is a home daycare center located at
305 E. Kendall Drive. At the present time, the resident places cones on the
driveway so that the parents who are dropping off and picking up children
can't park in the driveway. This requires parents to park on the roadway for
drop off and pick up. However, residents of the apartment complex park on
the roadway as well. Committeeman Werderich stated he didn't feel this
roadway qualified as a collector street. Lt. Swartzkopf stated that while it is
not officially a collector street, it is used as one, similar to Somonauk. It was
determined that Lt. Swartzkopf would personally speak with the resident to try
to come to a resolution.
The discussion regarding East Kendall Drive will return to this committee for
further discussion. The remainder of the parking restrictions will be sent to
the Consent Agenda of May 13, 2008.
2. PS 2008-05—Administrative Adjudication
Attorney Orr was not present to discuss this matter, however, Committeeman
Werderich discussed his concerns with her via telephone. His concern was
that constitutional rights would be taken away by using the process for traffic
violations as the statute says that the burden of proof is on the defendant,
therefore they are guilty until proven innocent. However, Attorney Orr
explained that Illinois Vehicle Code violations are excluded.
Committeeman Sutcliff stated that Committeeman Plocher is concerned about
section 1-13-6a2 in that it states `owner or operator' and the owner could be
cited for someone else's error. Chairperson Spears stated that Attorney Orr
explained that is someone other than the owner is operating the vehicle; the
operator could be brought into the matter. This item will be addressed with
Attorney Orr when this matter goes before City Council.
This item will move forward to City Council.
3. PS 2007-28—Ice Cream Vendors/Soliciting Ordinances
Chairperson Spears stated that this item was before the committee last year.
Attorney Orr has advised that the City cannot legally ban vendors. Assistant
City Administrator Olson added that he believes that Mayor Burd has
increased the cost of the background check to $25.00.
This item was moved t the City Council Consent Agenda.
ADDITIONAL BUSINESS:
Committeeman Sutcliff—none
Committeeman Werderich — He attended the Raintree Village neighborhood watch
meeting last week and wished to commend the Police Department for the way they
conducted the meeting. They got people excited about becoming involved. They
were very positive and he was very impressed with the meeting. Lt. Swartzkopf will
pass this along to Sergeant Groesch and Detective Mott who conducted the meeting.
Additional discussion took place regarding other neighborhood watch groups. Lt.
Swartzkopf stated that the meetings would start taking place again.
Lt. Swartzkopf — A burglary suspect was apprehended the evening of that
neighborhood watch meeting. The suspect confessed and a lot of property was
recovered including laptop computers, passports, etc. Additionally, the suspect burnt
2 vehicles. He was not charged with arson due to lack of evidence. That evening
there was no supervisor on duty for the Police Department and the most senior officer
had 2 years experience. It was a great example of good police work. A press release
should be distributed today. Lastly, please remember to lock your cars.
